RESOLUTION NO. 80- Ll5
ESTABLISHMENT OF A TRUST FUND -- OFF -SITE IMPROVEMENTS -- SUBDIVISION
REGULATIONS OF THE COUNTY OF EAGLE, STATE OF COLORADO..
WHEREAS, pursuant to Section 30 -28 -137, C.R.S. 1973, as
amended, the Board of County Commissioners, County of Eagle, State of
Colorado, hereinafter referrred to as the "Board ", is authorized and
empowered to require a Subdivider of a subdivision located within
the unincorporated territory of the County of Eagle and as a condition
of final plat approval of subject subdivision, to enter into a
Subdivision Improvements Agreement with the County of Eagle for the
purpose of guarantying the faithful performance and completion of
certain public improvements as determined and specified by the Board; and
WHEREAS, pursuant to Section 5.02.15 of the Subdivision
Regulations of the County of Eagle, Colorado, the Board may require
a Subdivider of a subdivision and as a condition of final plat approval
of subject subdivision, to enter into a cost sharing program to upgrade
off -site access roads relative to subject subdivision by means of
the Subdivider paying in cash a proportionate share of the costs of
making improvements to such off -site access roads as determined and
specified by the Board; and
WHEREAS, the Board desires the establish a trust fund
for the purpose of placing therein monies received by a Subdivider
and for the appropriation and expenditure of monies by the County
relative to the construction and improvement of certain off -site
access roads as such roads are defined in certain Subdivision
Improvements Agreements.
NOW, THEREFORE, be it resolved by the Board of County
Commissioners, County of Eagle, State of Colorado:
THAT, the Board hereby establishes a new fund entitled
"Off -Site Road Impirovem6ntd Fund ".
THAT, such monies placed within and /or. appropriated to
said fund shall be used for the purpose of constructing and /or improving
off -site access roads pursuant to Section 5.02.15 of the Subdivision
Regulations of the County of Eagle, Colorado, and certain Subdivision
Improvements Agreements entered into pursuant thereto.
THAT, the Board hereby requests and directs the Treasurer
of the County of Eagle, Colorado, to estalish such a fund entitled
"Off -Site Road Improvements Fund ".
THAT, the Board hereby finds, determines and declares
that this Resolution is necessary for the public health, safety and
welfare of the County of Eagle, State of Colorado.
MOVED, READ AND UNANIMOUSLY ADOPTED at a regular meeting
of the Board of County Commissioners, County of Eagle, State of
Colorado, held this 9 ;t day of August, 1980.
