HomeMy WebLinkAboutR1978-31 Authorization of Additional Expenditures - Campaing FundsRESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO Authorization of Additional Expenditures in Excess of Budget - Emergency Conditions - Campaign Funds in Support of Proposal for Countywide Sales Tax WHEREAS, the Board of County Commissioners of the County of Eagle, State of Colorado, hereinafter referred to as the "Board," did, on September 18, 1978, adopt a proposal for a Countywide sales tax pursuant to law; and WHEREAS, said proposal for a Countywide sales tax has been submitted to the electorate of this County on the ballot for the next general election to be held November 7, 1978; and WHEREAS, the Board has an official concern in said issue; and WHEREAS, the Board has determined that said proposal for a County- wide sales tax is of an emergency nature; and WHEREAS, said emergency or contingency could not have reasonably been foreseen at the time of adoption of the County budget for the current fiscal year; and WHEREAS, the Board pursuant to Sections 29 -1 -114 and 29 -1 -115, C.R.S. 1973, as amended, may authorize expediture of funds in excess of the budget for an emergency not reasonably foreseen; and WHEREAS, the Board pursuant to Section 1 -45 -116, C.R.S. 1973, as amended, may specifically approve the expenditure or use of public funds or supplies in connection with election campaigns involving issues in which the County has an official concern; NOW THEREFORE, be it resolved by the Board of County Commissioners of the County of Eagle, State of Colorado; THAT a state of emergency exists with respect to campaigning for the approval of the Countywide sales tax proposal by the majority of the electorate of this County; and THAT the Board finds and determines that due to increasing demands or mandatory requirements for County governmental services and the effects of economic inflation, the costs of County government are increasing; and a THAT the Board is required by law to maintain appropriate and adequate levels of governmental service for the public health,welfare and safety; and THAT the Board has determined that a Countywide sales tax is an appropriate, equitable and necessary alternative source of County revenue; and THAT the Board has determined and deems that it is necessary and proper to spend County funds or supplies, or use the same, to campaign for the passage of the Countywide sales tax proposal by the electorate of this County at the general election to be held November 7, 1978; and THAT the estimated cost for said campaign is in the amount of $5,000.; and THAT said 'contingency was not and could not have been reasonably foreseen at the time of adoption of this County's budget for the current fiscal year; and THAT it is hereby authorized and ordered by this Board that the sum of $5,000. be transferred from the Contingency Fund in the current fiscal year's budget for the County of Eagle, to the General Fund in said budget for the use of this Board for the purpose of campaigning for the adoption of the Countywide sales tax by the electorate of this County at the general election to be held November 7, 1978; and . THAT the Clerk of the Board is hereby directed to forward a certified copy of this Resolution for filing with the Division of Local Government in the Department of Local Affairs o� the State of Colorado; and THAT the Clerk of the Board is hereby directed to publish this Resolution in full one time in a newspaper with general circulation within the,County of Eagle, State of Colorado;.and THAT the Board hereby finds, determines and declares that this Resolution is for the public health, welfare and safety of the citizens of the County of Eagle, State of Coloraco, MOVED, READ AND UNANIMOUSLY adopted at special meeting of the Board of County Commissioners, County of Eagle, State of Colorado, held on Septe/4er 26, 1978.
