71EREAS, the United States Forest Service has
surveyed and is contemplating the building of a truck trail
in the Holy Cross Forest in the County of Eagle and the
State of Colorado, and;
WITE'REAS, said truck trail runs frog„ a point approx-
imately at what is known as the forks of the creek on Brush
Creek south and east of the Towai of Eagle and from there to
what is known as the Yoeman Park Recreational Area to a
point somewhat above the Yoeman Park ranger station, and;
VvI EREAS, there is a change in alignment of the
present road and particularly through the lands owned by
Frank L. Nei ^:comer and his vaife, Ethelind !3. Newcomer, and;
VMEREAS, negotiations for a right of fray are at
the date of this - Resolution at a standstill, and;
1'MEREAS, it is believed that said right of way will
not be absolutely necessary for procurement until later in
the year 1940 or durine� the gear 1941, and;
t.1EREAS, it is proposed that the County of Eagle
obtain the rights of way by a. right of way deed or condem-
nation for the aforementioned truck trail, nd;

VE EREAS, the For, ^stry Service is at this date
improving said above mentioned road or truck trail with the
understanding that a proper deed. for rights of gray or right
o_ way for the proposed truck. trail as surveyed will be
obtained by Eagle County.
BE IT T;_ERy'FOtiE RESOLVED BY T.E� BOARD OF COUNTY
C011;ISSIONERS 02 EAGLE COUNTY That if and when it becomes
necessary to obtain the right of way for the aforementioned
truck trail as surveyed by the Forestry Department of the

United States,that �aF.le County will obtain such rights of
way either by deed and private negotiations ;,ith r'rank L.
Newcomer and his wife, Sthelind B. Newcomer, or by condem-
nation so that the proposed road or truck, trail can be built
on the survey as made.
Read, considered, passed and approved at a regular
meeting of the Board of County Commissioners of Eagle County
held at the Court douse at Eagle, Colorado, this lst day of
July, A. D. 1940.
