WHEREAS, the Legislature of the State of Colorado
in 1939 passed an Act known as County Planning as appears in
the Session Laws of 1939 commencing at Page 294 thereof, and;
WHEREAS, the Act authorizes planning and zoning of
unincorporated territory within the counties of the State of
Colorado and other matters therein contained, and;
WHEREAS, the Board of County Commissioners of Eagle
County, State of Colorado, constitute themselves a County
Planning Commission under the provisions of such Act, and;
14 EREAS$ it is believed by the Board of County
Commissioners acting as a County Planning Commission that it
is for the best interests of the inhabitants of the County of
Earle and State of Colorado and for the purpose of promoting
the health, safety, morals, convenience, order, prosperity and
welfare of the present and future inhabitants of the State of
Colorado and of the County of Eagle, that they zone the unin-
corporated territory adjacent to and bordering upon United
States Highway 24 and United States Highway 6 from where said
Highways enter Eagle County on the west border thereof and
including all of the unincorporated territory bordering and
adjacent to said Highways t!_rough the entire length of said
County of Eagle and the State of Colorado to the point where
said Highways leave the County on the east boundary or east
line of Eagle County.
THEREFORE, BE IT RESOLVED That the Board of County
Commissioners of Eagle County be and the same hereby are made
a County Planning Commission; that for the purpose of promot-
ing the health, safety, morals, convenience, order, prosperity
and welfare of the present and future inhabitants of the State
of Colorado and of the County, all of the unincorporated

territory bordering upon and adjacent to United States High-
way 24 and United States Highway 6 in their entire length
from east to west through the County of Eagle and the State
of Colorado be and the same hereby is declared a zone.
That in said zone the building or placing or sta-
tioning of so- called billboards, signs and advertising matter
is prohibited; that such prohibition extends to any and all
advertising matter however intended to be placed or erected
in the zone herein established; that no building or structure
shall be erected within two hundred (200) feet of the Highways
herein mentioned and in the zone herein created measured from
the side line or border line of said Highways at right angle
or at any angle therefrom, unless and until a building permit
has been obtained from the Commissioners and Commission herein
established; that this Commission and Board have the right to
establish rules and regulations covering sanitation, inspection
and buildings and all construction within the zone herein
established, and make all rules and regulations necessary and
proper to carry out the purposes of this zone regulation.
Read, considered, passed and approved at an open,
regular meeting of the Board of County Commissioners of Eagle
County held this 6th day of May A. D. 1940 at Eagle.Eagle
County, Colorado.
