COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO: 83-
ZONE DISTRICT AMENDMENT - Neumayr & Brown
FILE NO: - ZC- 191 -83
WHEREAS, Rudi Neumayr and Ron Brown did file an appli-
cation with the Eagle County Department of Community
Development on or about October 3, 1983, to rezone the herein
described property in Eagle County from Resource Zone District
to Commercial General Zone District; and
WHEREAS, a public hearing was held by the Board of
County Commissioners of the County of Eagle, State of Colorado,
on November 23, 1983; and
WHEREAS, based on the evidence, testimony, exhibits,
study of the Master Plan for the unincorporated areas of
Eagle County, comments of the Eagle County Department of
Community Development, comments of public officials and
agencies, the recommendation of the Eagle County Planning
Commission, and comments from all interested parties, this
Board of County Commissioners of the County of Eagle, State
of Colorado, finds as follows:
1. That proper publication and public notice was pro-
vided as reauired by law for the hearing before the Planning
Commission and the Board of County Commissioners.
2. That the proposed zoning is consistent with the
Master Plan.
3. That the area in questions possesses the geological,
physical and other environmental conditions compatible with
the characteristics of the use requested.

4. That the advantages of the use requested outweigh the
disadvantages.
5. That the proposed rezoning is necessary in order
to provide land for a demonstrated community need.
6. That for the above stated reasons, the proposed zoning
is in the best interest of the health, safety, convenience, order
prosperity and welfare of the citizens of Eagle County, Colorado.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of the County of Eagle, State of Colorado:
THAT the petition of Neumayr and Brown, file number
ZC- 191 -83, for a zoning amendment to change from Resource Zone
District to Commercial General Zone District be and is here-
by approved for the following described property located in
the unincorporated area of Eagle County:
SEE EXHIBIT "A"
THAT the board of County Commissioners directs the
Director of the Department of Community Development to enter
this amendment on the appropriate page of the Official District
Map and record the change in the Office of the Eagle County Clerk
and Recorder.
MOVED, READ, AND ADOPTED by the Board of County Commissioners
of the County of Eagle, State of Colorado, at its meeting held
the day of/ 19 nunc pro tune to 23rd day
November, 1983.

A parcel of land in Tract'49, Section 5, Township 5 South, Range 86 West
of -the 6th Principal Meridian, in the County of Eagle, State of Colorado,
more particularly described as follows=
Beginning at a point on the southerly line of an existing road whence a
brass cap found in place for the Closing Corner of the North line of
said Section 5 with line 3-4 of said Tract 49 bears N. 690 52' 34" W. a
distance of 1391.68 feet;
thence S. 230 50' 32" W. a distance of 262.99 feet along the easterly
line of that parcel known as the Doolittle Tract Addition recorded in
Book 287 at Page 22 of the Eagle County Records to a corner post set in
concrete;
thence S. 49° 56' 47" E. a distance of 427.92 feet;
thence S. 620 49' 38" E. a distance of 323.53 feet'
thence S. 030 57' 00" W. a distance bf 136.07 feet to the northerly right -
of -way line of U. S. Highway 6;
thence S. 860 03' 00" E. a distance of 222.98 feet along said 'northerly
right -of -way line;
thence N. 190 55' 26" E. a distance of 52.31 feet along an existing fence
to the westerly right -of -way of said existing road;
thence N. 400 24' 00" W. a distance of 680.89 feet along said westerly
right -of -way line;
thence along said westerly right -of -way line along a curve to the left
having a radius of 1115.92 feet, a central angle of 200 00' 12••, an arc
distance of 389.59 feet, and a bong Chord of ,387.62 feet bearing
N. 500 24' 06 W, to the point of beginning, containing 4.86 acres, more
or less.
