APPROVAL OF SPECIAL USE PERMIT - Beaver Creek mountain Club
FILE NO. - ZS- 180 -83
WHEREAS, Vail Associates, Inc. did file an application
with the Eagle County Department of Community Development on or
about April 15th, 1983, within the Resource Zone District; and
WHEREAS, a public hearing was held by the Board of
County Commissioners of the County of Eagle, State of Colorado,
on May 25th, 1983; and
WHEREAS, based on the evidence, testimony, exhibits,
study of the Master Plan for the unincorporated areas of Eagle
County, comments of the Eagle County Department of Community,
Development, comments of public officials and agencies, the
recommendation of the Eagle County Planning Commission, and
comments from all interested parties, the Board of County
Commissioners of the County of Eagle, State of Colorado, finds
as follows:
1. That proper publication and public notice was
provided as required by law for the hearing before the
Planning Commission and the Board of County Commissioners.
2. That the proposed special use conforms to the
requirements of Section 2.09 of the Eagle County Land Use
Regulations.
3. That the proposed land use will be compatible
with existing uses in the area.
4. That for the above- stated and other reasons, the
proposed zoning is in the best interest of the health, safety,

morals, convenience, order, prosperity and welfare of the
citizens of Eagle County.
NOW, THEREFORE, BE IT RESOLVED, by the Board of
County Commissioners of the County of Eagle, State of Colorado:
That the application of Vail Associates, Inc.,
File No. ZS- 180 -83, for approval of a special use of 7,000
square foot Mountain Club within the Resource Zone District
in the following described unincorporated area of Eagle
County be approved:
Homestead Entry Survey No. 274 in the Holy Cross
National Forest in Section 25 Surveyed, TSS, R82W,
Section 26 Surveyed TSS, R82W, Section 35 Surveyed
TSS, R82W, Section 36 Surveyed TSS, R82W of the
6th Principal Meridian, Colorado, Approved
October 28, 1919.
THAT the following condition shall be placed upon
this approval and that violation of any condition shall be
the basis for revocation of the permit:
1. Subject to operational requirements as set
forth in the Environmental Analysis Report for Beaver Creek
THAT the Board of County Commissioners directs the
Department of Community Development to provide a copy of this
Resolution to the applicant.
MOVED, READ, AND ADOPTED by the Board of County
Commissioners of the County of Eagle, State of Colorado, at
its meeting held the _ 8th day of June

Colorado -Ute proposes to construct, operate and maintain a
igle- circuit 115,000 volt electrical transmission line between
s Wolcott and Beaver Creek Substations, both located in Eagle
�Qunty, Colorado
The proposed transmission line will be approxi-
mately 17.6 kilometers (km) (11.0 miles (mi)) in length, of which
approximately 9.6 km (6.0 mi) will be located on public lands
managed by the Forest Service and 5.0 km (3.1 mi) located on
public lands managed by the Bureau of Land Management (BLM).
The western -most 14.1 km (8.8 mi) of right -of -way (ROW) for
the proposed transmission line will be parallel to Colorado -Ute's
existing 115,000 volt Wolcott- Avon -Vail line. The Eagle County
Board of County Commissioners approved a special use permit for
that portion on May 11, 1983. The purpose of this discussion is
to evaluate routing alternatives for the eastern -most portion of
the line for the last 3.5 km (2.2 miles) into the Beaver Creek
Substation.
Alternatives Considered but Eliminated
The alternative of paralleling the existing 115 -kv line for
its entire length was eliminated from further consideration
because the area around the eastern end of the existing line is
being subdivided for residential and commercial development
(Wildridge Subdivision and Benchmark Development). Several homes
within the Wildridge Subdivision are adjacent to the existing
ROW.
Routinq Alternatives Evaluated
General Description
Two routing alternatives were evaluated for the last 3.5 km
(2.2 miles) into the Beaver Creek Substation.
Alternative E1 is a corridor that diverges from the existing
115 -kv line and extends south to the existing Wolcott- Beaver Creek
69 -kv line (currently operated at 25 -kv); from this point the
existing wood pole support structures would be used and new con-
ductors, insulators, and hardware capable of 115 -kv operation
installed for the remaining 1.4 km (0.9 mile) into the Beaver
Creek Substation (see Figure ).
Alternative E2 diverges from the existing line and extends
south for approximately 0.6 km (0.4 mile), the southeast for
approximately 0.5 km (0.3 mile), then east southeast for 1.1 km
(0.7 mile) and then south for 0.6 km (0.4 mile) into the Beaver
Creek Substation (see Figure ). The last 0.6 km (0.4 mile) of
alternative E2 would be located on an existing unused easement
that Colorado -Ute obtained from the Benchmark Development for
future use when the existing 115 -kv line was constructed.
Environmental Considerations
Alternatives E1 and E2 would have similar impacts on vegeta-
tion because the same vegetative type (mountain brush /desert
shrub) would be crossed by both. The impact of alternative E1
would be slightly less because about one mile of existing support

structures would be used, eliminating the need for new access
roads in this area and therefore reducing vegetative impacts.
Alternatives E1 and E2 do not cross any sensitive wildlife
habitat.
Alternative E1 would have less visual impact. A route in E1
could be located in a draw that runs north - south; after the line
crossed a ridge and entered the draw it would be well - concealed
from the Berry Creek and Wildridge Subdivisions. The line
would likely be visible to I -70 travellers for only a brief time.
No additional visual impacts would occur on the last mile into the
Beaver Creek Substation since the existing structures would be
' used.
Alternative E2 would require a new corridor for its entire
length and would have a greater visual impact than E1. It would
have an east -west orientation, would cross a more prominent ridge,
and be more visible from the Wildridge Subdivision. In addition,
the eastern -most 0.6 km (0.4 mile) on the existing unused easement
would add a third circuit in a narrow, heavily congested canyon.
Use Considerations
A transmission line routed in alternative E1 would have less
impact on existing land use. E1 would cross approximately 3 km
(1.9 miles) of public domain managed by the Forest Service and 0.5
km (0.3 mile) of private land owned by Benchmark. All of the
private land and 1.0 km (0.6 mile) of public land are crossed by

public land are crossed by the existing 69 -kv line; therefore, no
additional land use impacts would occur in this 1.6 km (1.0 mile)
section. As mentioned previously, a transmission line in alterna-
tive E1 would be screened from the Berry Creek and Wildridge Sub-
divisions and would cause no new or additional impacts to the
Benchmark Development.
Alternative E2 would cross 1.9 km (1.2 miles) of public land
managed by the Forest Service and 1.0 km (0.6 mile) of private
land owned by Benchmark. Alternative E2 would be closer to the
Wildridge Subdivision than E

sion line. This alternative would have a minimal impact on vege-
tation and wildlife and less impact on land use and visual
resources.

line of the existing Colorado.Ute 115.kv Wolcott to Avon
Transmission Line crosses said east line of the NE1 /4 NE1 /4 of
Section 21, said point also being on the northerly right.of.way
line of the 100.foot wide right.of.way being described herein;
Thence northeasterly, along the southerly right.of.way line
of the existing Colorado.Ute 115.kv Wolcott to Avon rfght.of.way
as it passes through the NW1 /4 NW1 /4 of Section 22, T4S, R83W
of the 6th P.M. (the 100.foot wide right.of.way being described
herein adjoins and lies south of the existing southerly right.of.way
line of the said Colorado.Ute Wolcott to Avon 115.kv Transmission
Line right.of.way); Thence continuing parallel to and adjoining
the southerly right.of.way line of Colorado.Ute's existing
Wolcott to Avon 115.kv Transmission Line right.of.way as it
passes through Sections 15, 14, 11, and 12 all in T4S, R83W of the 6th
P.M., to a point in the SW1/4 SW1 /4 of said Section 12 where the said
existing Colorado.Ute Wolcott to Avon 115.kv Transmission Line turns in
a southeasterly direction; Thence continuing parallel to and adjoining
the southerly line of said existing Colorado.Ute 115.kv Wolcott to Avon
right.of.way as it passes through said Section 12 and through Sections
13 and 24 all in T4S, R83W of the 6th P.M.; Thence contfnuinq parallel
