RESOLUTION NO. 83- //i
ZONE DISTRICT AMENDMENT - Colorado River and Eagle Co. (AL zone
FILE NO. - ZC- 182 -83
WHEREAS, Colorado River and Eagle Co. did file an
application with the Eagle County Department of Community
Development on or about March 1, 1983, to rezone the herein
described property in Eagle County from Resource Zone District
_ to Agricultural Limited Zone District; and
WHEREAS, a public hearing was held by the Board of
County Commissioners of the County of Eagle, State of Colorado
on April 27th, 1983; and
WHEREAS, based on the evidence, testimony, ex-
hibits, study of the Master Plan for the unincorporated areas
of Eagle County, comments of the Eagle County Department of
Community Development, comments of public officials and
agencies, the recommendation of the Eagle County Planning
Commission, and comments from all interested parties, the
Board of County Commissioners of the County of Eagle, State
of Colorado, finds as follows:
1. That proper publication and public notice was
provided as required by law for the hearing before the
Planning Commission and the Board of County Commissioners.
2. That the proposed zoning is consistent with the
Master Plan.
3. That the area in question possesses the geo-
olgical, physical and other environmental conditions com-
patible with the characteristics of the use requested.
4. That the advantages of the use requested out-
weigh the disadvantages.
5. That the area for which the rezoning is re-
quested has changed or is changing to such a degree that it
is in the public interest to encourage a new use or density
in the area.
6. That the proposed rezoning is necessary in
order to provide land for a demonstrated community need.
7. That for the above stated reasons, the proposed
zoning is in the best interest of the health, safety, conven-
ience, order, prosperity and welfare of the citizens of
Eagle County, Colorado.
NOW, THEREFORE, BE IT RESOLVED by the Board of
County Commissioners of the County of Eagle, State of Colorado:
THAT the petition of Colorado River and Eagle Land Co.,
file number ZC- 182 -83, for a zoning amendment to change from
Resource Zone District to Agricultural Limited Zone District
be and is hereby approved for the following described property
located in the unincorporated area of Eagle County:
LEGAL DESCRIPTION
A parcel of land located in Tracts 38, 44, and 55, Sections
3, 4, 9, and 10, Township 5 South, Range 84 West of the
Sixth Principal Meridian, Eagle County, Colorado according
to the Independent Resurvey of said Township and Range as
approved by the U.S. Surveyor General in Denver, Colorado
on June 20, 1922, with all bearings herein based on the
bearing between the Eagle Town Monuments at 5th and Broadway
and at 2nd and Broadway, which is N.00033100 11W.; said parcel
being more particularly described as follows, to wit:
Beginning at a point on the Northerly line of said
Tract 38, from which Corner No. 1 of said Tract 38, a rebar
and aluminum cap, L.S. #4451, found in place, bears N.89007139 "E
408.18 feet distant; thence South 2655.35 feet to a point on
the Southerly line of said Tract 55; thence along said
Southerly line 5.89004'43 "W. 240.99 feet to a point on the
Northerly fence line of Brush Creek Road; thence along said
Northerly fence line on the following eight (8) courses:

of said Tract 38 to the Closing Corner for said Sections 3
and 4 and said Tract 38, a brass cap monument found in place;
thence continuing along said Northerly line, S.89007'39 "E.
245.60 feet to the point of beginning.
Said parcel contains 138.00 acres, more or less.
THAT the Board of County Commissioners directs the
Director of the Department of Community Development to enter
this amendment on the appropriate page of the Official District
Map and record the change in the Office of the Eagle County Clerk
and Recorder.
MOVED, READ AND ADOPTED by the Board of County
Commissioners of the County of Eagle, State of Colorado, at
its meeting held the 8th day of June , 19 83 ,
