OF THE
BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 83 -'/�
ZONE DISTRICT AMENDMENT - Colorado River and Eagle Co.(AR zone)
FILE NO. - ZC- 182 -83
WHEREAS, Colorado River and Eagle Co. did file an
application with the Eagle County Department of Community
Development on or about March 1, 1983, to rezone the herein
described property in Eagle County from Resource Zone District
to Agricultural Residential Zone District; and
WHEREAS, a public hearing was held by the Board of
County Commissioners of the County of Eagle, State of Colorado,
on April 27th, 1983; and
WHEREAS, based on the evidence, testimony, exhibits
study of the Master Plan for the unincorporated areas of
Eagle County, comments of the Eagle County Department of
Community Development, comments of public officials and
agencies, the recommendation of the Eagle County Planning
Commission, and comments from all interested parties, the
Board of County Commissioners of the County of Eagle, State
of Colorado, finds as follows:
1. That proper publication and public notice was
provided as required by law for the hearing before the
Planning Commission and the Board of County Commissioners.
2. That the proposed zoning is consistent with the
Master Plan.
3. That the area in question possesses the geo-
logical, physical and other environmental conditions com-
patible with the characteristics of the use requested.
4. That the advantages of the use requested outweigh
the disadvantages.
5. That the area for which the rezoning is re-
quested has changed or is changing to such a degree that it
is in the public interest to encourage a new use or density
in the area.
6. That the proposed rezoning is necessary in
order to provide land for a demonstrated community need.
7. That for the above stated reasons, the proposed
zoning is in the best interest of the health, safety, con-
venience, order, prosperity and welfare of the citizens of
Eagle County, Colorado.
NOW, THEREFORE, BE IT RESOLVED by the Board of
County Commissioners of the County of Eagle, State of Colorado:
THAT the petition of Colorado River and Eagle Land
Co., file number ZC- 182 -83, for a zoning amendment to change
from Resource Zone District to ARricultural Residential Zone
District be and is hereby approved for the following described
property located in the unincorporated area of Eagle County:
LEGAL DESCRIPTION
A parcel of land located in Tracts 37, 38, 44, 55, 59,
Sections 3, 4, 9, and 10, Township 5 South, Range 84 Nest
of the Sixth Principal Meridian, Eagle County, Colorado
according to the Independent Resurvey of said Township
and Range as approved by the U.S. Surveyor General in
Denver, Colorado on June 20, 1922, with all bearings con-
tained herein based on the bearing between the Eagle Town
Monuments at 5th and Broadway and at 2nd and Broadway,
which is N.00033100 "W.; said parcel being more particularly
described as follows, to wit:
Beginning at Corner No. 1 of said Tract 37, a brass cap
monument found in place; thence S.00013128 "E. 1346.79 feet
along the Easterly line of said Tract 37 to Corner No. 6
of said Tract 37, a brass cap monument found in place,
being identical to Corner No. 1 of said Tract 59; thence
S.00028104 "E. 3461.51 feet along the Easterly line of said
Tract 59 to a point on the Northerly fence line of Brush
Creek; thence along said Northerly fence line the following
five (5) courses:

line of a parcel of land known as the "3 Acre Addition
to Parcel 2802 "; thence along the Northerly and
Westerly boundaries of said parcel the following four

Corner No. 1 of Tract 58, a rebar and aluminum cap,
R.L.S. #14109, said corner being identical to Corner
No. 8 of said Tract 55; thence S.89 004143 1'L4. 404.20
feet along the Northerly line of said Tract 58; thence
North 2655.35 feet to a point on the Northerly line of
said Tract 38; thence along said Northerly line
5.89 °07'39 "E. 408.18 feet to Corner No. 1 of said
Tract 38, a rebar and aluminum cap, L.S. "4551, found
in place, said corner being identical to Corner No. 2
of said Tract 37; thence N.89 042125 "E. 2781.84 feet
along the Northerly line of said Tract 37 to the
point of beginning.
Said parcel contains 275.067 acres, more or less.
THAT the Board of County Commissioners directs the
Director of the Department of Community Development to enter
this amendment on the appropriate page of the Official District
Map and record the change in the office of the Eagle County
Clerk and Recorder.
MOVED, READ, AND ADOPTED by the Board of County
Commissioners of the County of Eagle, State of Colorado, at
its meeting held the 8th day of June , 1983 ,
nunc pro tune to the 27th day of April, 1983.
