RESOLUTION
OF THE
BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO

DENIAL OF ZONE CHANGE AMENDIJENT - Dick Jennings
File No. - ZC- 189 -83
WHEREAS, Dick Jennings did file a petition with the
Eagle County Department of Community Development on or about
August 15, 1983 to rezone the herein described property in
Eagle County from Resource Zone District to Rural Center Zone
District; and
WHEREAS, a public hearing was held by the Board of
County Commissioners of the County of Eagle, State of Colorado,
on October 12th, 1983; and
WHEREAS, based on the evidence, testimony, exhibits,
study of the Master Plan for the unincorporated areas of Eagle
County, comments of the Eagle County Department of Community -
Development, comments of public officials and agencies, the
recommendation of the Eagle County Planning Commission, and
comments from all interested parties, the Board of County
Commissioners of the County of Eagle, State of Colorado, finds
as follows:
1. That proper publication and public notice was
provided as required by law for the hearing before the Planning
Commission and the Board of County Commissioners.
2. That the proposed zoning is not in compliance
with the recommendations set forth in the r,laster Plan for the
unincorporated area of the County.
3. That the proposed land use will not be compatible
with existing and permitted land use in all directions.
4. That the disadvantages of the use requested
outweighs the advantages.
5. That changing conditions clearly do not re-
quire an amendment to the Zone District designation presently
placed on the subject property.
6. That the proposed rezoning is not necessary in
order to provide land for a demonstrated community need.

safety, convenience, order, prosperity and welfare of the
citizens of Eagle County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of the County of Eagle, State of Colorado:
That the petition of Dick Jennings, File Number
ZC- 189 -83, for a zoning amendment to change from Resource
Zone District to Rural Center Zone District be and is hereby
denied relative to the following described property located
in the unincorporated territory of Eagle County:

MOVED, READ, AND ADOPTED by the Board of County
Commissioners of the County of Eagle, State of Colorado, at

LEGAL DESCRIPTION
PARCEL TO BE REZONED
A parcel of land to be designated as a rural commercial
center being located in Section 27, Township 7 South, Range 87
West of the Sixth Principal Meridian, Eagle County, Colorado,
being more particularly described as follows:
Beginning at a point on the northerly right of way of Fender
Lane from which the Southwest Corner of the NW1 /4 NW1 /4 of Section
27 bears S75 °55'04 "W 51.55 feet distant; thence North 122.00 feet;
thence N77 °00'00 "E 281.13 feet; thence N35 100'00 "E 124.37 feet;
thence East 100.00 feet; thence South 299.00 feet to a point on
the northerly right of way of Fender Lane; thence following said
right of way 107.22 feet on the arc of a curve to the left having
a radius of 588.47 feet; the chord of which bears N84 030'19 "W
107.07 feet; thence continuing along said right of way N89 °43'29 "W
338.69 feet to the point of beginning_.
Said parcel.of land contains 2.03 acres, more or less.
