HomeMy WebLinkAboutR83-073 Lease of real property with BLM for sanitary landfille.V RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 83- '�,3 AUTHORIZING THE CHAIRMAN OF THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, COLORADO, TO EXECUTE CERTAIN DOCUMENTS NECESSARY TO APPLY FOR THE LEASE OF REAL PROPERTY UNDER THE JURISDICTION OF THE BUREAU OF LAND MANAGEMENT FOR A SANITARY LANDFILL SITE WHEREAS, pursuant to Sections 30 -20 -101 et spec., 30 -11 -101 and 30 -11 -107, respectively, C.R.S., the Board of County Commissioners of the County of Eagle, State of Colorado, hereinafter referred to as the "Board," is empowered to provide for, operate and maintain a county sanitary landfill; and WHEREAS, the Board desires to apply for and enter into a lease agreement with the United States Department of the Interior, Bureau of Land Management, hereinafter referred to as the "BLM," for the use of an approximate 160 acre parcel of land generally located in Sections 2 and 11, Township 4 South, Range 83 West of 6th Principal Meridian, as a County sanitary landfill. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, David E. Mott, in his capacity as the Chairman of the Board, is hereby authorized certain lease application to the Public Purposes presented to the copy of which is attached hereto take such other action as may be order to effectuate the delivery and directed to execute that BLM for Land for Recreation and Board concurrently herewith, a for reference purposes, and to necessary or appropriate in of a completed lease application to the BLM; provided, however, that any such incidental action shall be in accordance with the intent of this Resolution. SPECIFIC INSTRUCTIONS (Items not listed are sell- explanatory) :: em 2 If land is surveyed, give complete legal description. If :and is unsurveyed, description should be by metes and bounds -onnected, if feasible, by course and distance with a corner ,.f public land survey. If possible, approximate legal sub - -iivisions of unsurveyed lands should be stated. Acreage applied for must not exceed that specified by regulations. 3a Generally, title to lands will not be granted upon initial ipproval of an application. In order to assure proper develop - ent or use plans, the general practice will be to issue a lease 'r lease with option to purchase after development is essen- :lally completed. In any case, term of lease may not exceed '0 years for non - profit organizations or 25 years for govern - -iental agencies, instrumentalities or political subdivisions. 4 Leases and patents under this act are conditioned upon -ontinuing public enjoyment of the purposes for which the land is classified. The plan of development, use, and maintenance -rust show, at a minimum: a. A need for proposed development by citing population trends, shortage of facilities in area, etc. b. That the land will benefit an existing or definitely proposed public project authorized by proper authority. c. Type and general location of all proposed improve- ments, including public access (roads, trails, etc.). This showing may take the form of inventory lists, maps, plats, drawings, or blueprints in any combina- tion available and necessary to describe the finished project. Site designs should be provided for inten- 4em sive use sites and generalintcrmation about irnprove- ments existing or planned on lands within the over- all project. d. An ezitimate of the construction costs, how the pro- posed project will be financed, including a list of financial sources, and an estimated timetable for actual construction of all improvements and facilities. e. A plan of management to include operating rules, pro- posed source and disposition of revenues arising from the proposed operation, personnel requirements etc. f. A specific maintenance plan to include, for example, sewage and garbage disposal, road maintenance, upkeep and repair of grounds and physical facilities, etc. g. Applications for solid waste disposal sites must comply with guidelines established by the Environ. mental Protection Agency (40 CFR 240 and 241) and must include a detailed physical description of the site (including a map showing 5 —foot contours at a scale of 1 inch = 200 feet), description of ground water situation, soil characteristics and management plan. 6. This may consist of a copy of a delegation of authority, resolution or other evidence of authority from the governing board of the applicant's organization, copy of the by -laws of the organization, or the like.
