RESOLUTION

BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF //COLORADO
RESOLUTION NO.
A RESOLUTION NOTIFYING THE STATE TREASURER TO
DISTRIBUTE FEDERAL MINERAL LEASING FUNDS IN
ACCORD WITH THE PROVISIONS OF SECTION
34 -63 -102, COLORADO REVISED STATUTES 1973, AS
AMENDED.
WHEREAS, Section 34 -63 -102 of the Colorado Revised
Statutes 1973, as amended, provides for a distribution of a
portion of those moneys received by the State Treasurer pursuant
to the provisions of the federal mineral land leasing act of
February 25, 1920 for the use of the public schools and
political subdivisions of the State of Colorado for the
planning, construction, and maintenance of public facilities and
for public services; and
WHEREAS, Section 34- 63- 102(3)(c), C.R.S. 1973, as
amended, provides

within the county
WHEREAS,
that each county shall notify the State
at least twenty -five percent (25 %) of the
-i Section 34 -63 -102, subsection (3), paragraph
as amended, distributed to any school district
specified; and
aforesaid statute further provides each county
shall also notify the State Treasurer to distribute tbirty -seven
and one -half percent of the money described in Section
34- 63- 102(3)(a) which exceed two hundred fifty thousand dollars
to the municipalities within the county according to that
percentage which the population within each municipality bears
to the total population of all municipalities located within the
county.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners (hereinafter "the Board "), County of Eagle, State
of Colorado:
THAT, the State Treasurer is hereby notified to have
distributed a total of twenty -five percent (25 %) of money
described in Section 34 -63 -102, subsection (3), paragraph (a),
Colorado Revised Statutes 1973, as amended, distributed to the
school districts within Eagle County.
THAT, the twenty -five percent allocated to the public
school districts within the county shall be divided in
proportion to which its average daily pupil attendance of Eagle
County pupils during the preceding school year 1981 -1982 bears
to the aggregate average daily pupil attendance in all districts
in Eagle County during said school year. The aggregate average
daily pupil attendance in Eagle County in the school year
1981 -1982 was 2,358.43 pupils. The Eagle County pupil
attendance of District RE -50J, Eagle County School District, was
1,937.5. The Eagle County attendance of District RE1 -J, Roaring
Fork School District, was 419.5. The Eagle County pupil
attendance of West Grant District JT was 1.43. Therefore,
District RE -1J should receive 17.79 percent of aforesaid 25 %.
District RE -50J should receive 82.15 percent of aforesaid 25%
and West Grant District JT should receive .06 percent of
aforesaid 25 %.
The Board further requests, in accord with Section
34 -63 -102 of the Colorado Revised Statutes 1973, as amended,
that the State Treasurer disburse the remaining seventy -five
percent (75 %) to the Treasurer of Eagle County unless such funds
exceed two hundred and fifty thousand dollars. In the case
aforesaid funds exceed two hundred fifty thousand dollars,
37 -1/2 percent of that part of the money which is described in
paragraph (a) of subsection (3) of Section 34 -63 -102, C.R.S.
1973 should be distributed to the municipalities within Eagle

County according to the percentage which the population within
each municipality bears to the total population of all
municipalities located within Eagle County.
IT IS FURTHER RESOLVED that the office of the County
Attorney is directed to mail a copy of this Resolution to the
State Treasurer as Eagle County's notification and direction as
to disbursement of mineral leasing funds.
MOVED, READ AND UNANIMOUSLY ADOPTED by the Board of
County Commissioners, County of Eagle, State of Colorado, at its
regular meeting held this 29th day of September, 1983.
