RESOLUTION
OF THE
BOARD OF COUNTY COMMISSIONERS

WHEREAS, Alfred H. Williams ( "Williams ") is the
owner /subdivider of that certain subdivision named and referred
to as Pilgrim Downs consisting of 18 lots generally located in
the West Lake Creek drainage in the County of Eagle, State of
Colorado, and more particularly described in Book 318 at Page
801 of the real property records of the County of Eagle, State
of Colorado; and
WHEREAS, pursuant to Section 2.06.13 of the Eagle
County Land Use Regulations, 1982, as amended, and the Planned
Unit Development Act of 1972, Section 24 -67 -101 et seq., C.R.S.
1973, as amended, Williams requested and received approval from
the Board of County Commissioners of the County of Eagle, State
of Colorado ( "Board "), for the establishment and development of
Pilgrim Downs as a Planned Unit Development; and
WHEREAS, pursuant to the aforementioned Land Use
Regulations and Act, and as a condition of the Board's approval
of Pilgrim Downs as a Planned Unit Development, Williams was
required to submit for the Board's consideration and approval a
Planned Unit Development Control Document for the purposes to
define and establish the limitations, restrictions and land uses
governing the development of Pilgrim Downs; said Planned Unit
Development Control Document being set forth in Exhibit A
attached hereto and incorporated herein by reference; and

WHEREAS, the final plat and a Planned Unit Development
Control Document for Pilgrim Downs, Filing No. 1, was previously
approved by the Board to allow the use of Lot 18 therein for a
main residence /caretaker unit, common facility with a Great Hall
for domestic employees of the other 17 units, and a bedroom area
for a maximum of 18 bedrooms with bath, living and small
kitchenette in each unit; said Planned Unit Development Control
Document being recorded in Book 345 at Page 688 of the real
property records of the County of Eagle, State of Colorado; and
WHEREAS, Williams desires to change the use of Lot 18
within Pilgrim Downs, Filing No. 1, to allow one single family
dwelling or primary /secondary dwelling; and
WHEREAS, in order to accomplish the foregoing, Williams
desires the Board to declare the previously approved Planned
Unit Development Control Document for Pilgrim Downs, Filing No.
1, null and void, and in its place and stead, to approve the
Planned Unit Development Control Document attached hereto as
Exhibit A to govern development on the 18 lots contained in
Pilgrim Downs.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT the Board hereby approves the Planned Unit
Development Control Document for Pilgrim Downs as set forth in
Exhibit A attached hereto as the document governing the
development of Pilgrim Downs.
THAT the Planned Unit Development Control Document for
Pilgrim Downs set forth in Exhibit A attached hereto shall not
be amended, modified, removed nor released except in accordance
with Section 24 -67 -106, C.R.S. 1973, as amended, and Section
2.06.13(9) of the Eagle County Land Use Regulations 1982, as
amended.

THAT a copy of this Resolution and the Planned Unit
Development Control Document for Pilgrim Downs set forth in
Exhibit A attached hereto shall be recorded in the property
records of the County of Eagle, State of Colorado.
THAT upon the recording of this Resolution and the
Planned Unit Development Control Document attached hereto as
Exhibit A, any and all previously approved Planned Unit
Development Control Documents, and in particular, the Planned
Unit Development Control Document for Pilgrim Downs, Filing No.
1, recorded in Book 345 at Page 688 of the real property records
of the County of Eagle, State of Colorado, shall be deemed and
declared null and void, and superceded in every respect
whatsoever by the Planned Unit Development Control Document
attached hereto as Exhibit A.
THAT this Resolution is necessary for the benefit of
the health, safety and welfare of the citizenry of the County of
Eagle, State of Colorado.
MOVED, READ AND ADOPTED by the Board of County
Commissioners of the County of Eagle, State of Colorado, at its
regular meeting held the day of September, 1983.

PLANNED UNIT DEVELOPMENT CONTROL DOCUMENT
FOR
PILGRIM DOWNS
USES BY RIGHT
Lots 1 through 18: Single family dwelling or primary /secondary dwelling
where the secondary unit may not exceed 1200 square feet of
liveable space. The secondary dwelling must be attached to the
primary dwelling. The total liveable area shall not exceed 6,000
square feet. Uses shall include accessory uses including
buildings for shelter or enclosure of animals or property
accessory to use of the lot for residential purposes and fences,
hedges, gardens, walls and similar landscape features. The
secondary dwelling may not be subdivided from the primary dwelling.
Equestrian Center: For the use of boarding and riding of horses and other
accessory uses including buildings for enclosure of property
and fences, hedges, walls and similar landscape features. The site
may also be used for a caretaker's unit with a maximum floor
area of 1500 square feet. This unit may not be sold from the
rest of the property.
