Rose requested the Board of County Commissioners of the County
of Eagle, State of Colorado ( "Board "), for ._n exemption from the
Eagle County Subdivision Regulations c-rith respect to the
transfer of an approximate 0.108 acre of land form Argo Lode
Mining Clai.i (Gulf U i4estern) to Mike and Sandy Rose; said
parcel of land being generally located in the unincorporated
territory of Eagle County adjacent to the Town of Red Cliff, and
more particularly described in Exhibit "A" attached hereto and
incorporated 'herein by this reference; and
4HEREAS, Mike and Sandy Rose have represented to the
Board that the aforementioned transfer is for the expressed
purpose of clearing up the present encroachment of the Poses'
residence upon the said parcel of land described in Exhibit "A ";
and
WHEREAS, Section 2.15.03 of the Eagle County Land
Regulations, 1982, as amended, allows the Board to exempt from
the provisions of the Eagle County Subdivision Regulations, any
division of land if the Board determines that such division is
not within the purposes of the Subdivision Regulations, and, in
addition, the method of disposition adopted is not for the
purpose of evading the provisions of the Subdivision
Regulations; and
