RESOLUTION

BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 83 - t�2
RESOLUTION DIRECTING THE COUNTY TREASURER
TO PAY OVER TO THE RE -50 -J SCHOOL DISTRICT
CERTAIN SCHOOL LAND DEDICATION FUNDS
WHEREAS, the Board of County Commissioners of the
County of Eagle, State of Colorado (hereinafter referred to as
the "Board "), is holding certain moneys pursuant to the
provisions of Section 30- 28- 133(4)(a)(II), Colorado Revised
Statutes 1973, as amended, and Section 2.18.01 of the Eagle
County Land Use Regulations, received in lieu of school land
dedication from subdividers; and
WHEREAS, Eagle County School District RE -50 -J has made
a formal request for such funds to be used in construction of an
addition to the Eagle Valley Elementary School which the School
District feels is reasonably necessary; and
WHEREAS, state statute authorizes that the fund
received in lieu of land be used for capital outlay purposes;
and
WHEREAS, the County Treasurer has determined that the
school land dedication funds received from subdivision within
the borders of RE -50 -J School District total $115,356.54 as of
August 31, 1983 and those funds have earned interest also being
held by the County Treasurer in the amount of $42,704.64 for a
total of $158,061.18; and
WHEREAS, the Board of County Commissioners wishes to
transfer said funds previously received in lieu of school land
dedication to Eagle County School District RE -50 -J.

NOW, THEREFORE, be it resolved by the Board of County
Commissioners, County of Eagle, State of Colorado:
THAT, the Board directs the Eagle County Treasurer to
pay over to Eagle County School District RE -50 -J the sum of
$158,061.18 from the funds being held by the Board pursuant to
Section 30- 28- 133(4)(a), Colorado Revised Statutes 1973, as
amended, said $158,061.18 representing all money being held by
the Board in lieu of school land dedication from subdivisions
within the borders of District RE -50 -J and the interest earned
on those funds while it has been held by the Board.
MOVED, READ AND UNANIMOUSLY ADOPTED by the Board of
County Commissioners, County of Eagle, State of Colorado, at its
regular meeting held this 6th day of September, 1983.
