HomeMy WebLinkAboutR83-061 - denial of special use permit George Jouflas contractor's yardRESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 83_,kj_ DENIAL OF SPECIAL USE PERMIT - George Jouflas Contractor's Yard FILE NO: - ZS- 184 -83 WHEREAS, George Jouflas did file an application with Eagle County Department of Community Development on or about June 1, 1983 , within the Resource Zone District; and WHEREAS, a public hearing was held by the Board of County commissioners of the County of Eagle, State of Colorado, on August 10th, 1983; and WHEREAS, based on the evidence, testimony, exhibits, study of the Master Plan for the unincorporated areas of Eagle County, comments of the Eagle County Department of Community Development, comments of public officials and agencies, the re- commendation of the Eagle County Planning Commission, and comments from all interested parties, the Board of County Commissioners of the County of Eagle, State of Colorado, finds as follows: 1. That proper publication and public notice was pro- vided as required by law for the hearing before the Planning Commission and the Board of County Commissioners. (POSSIBLE FINDINGS) 2. That the proposed special use does not conform to the requirements of Section 2.09 of the Eagle County Land Use Regulations. 3. That the proposed land use will not be compatible with existing land uses in the area. 4. (Specific variation from provision of Section 2.09 through 2.09.05). 5. That for the above stated and other reasons, the proposed zoning is not in the best interest of the health, safety, convenience, order, prosperity and welfare of the citizens of rt Eagle County. NOW, THEREFORE, BE IT RESOLVED, that the petition of George Jouflas for approval of a special use of Contractor's Yard within the Resource Zone District in the following unincorporated area of Eagle County be disapproved: A parcel of land situated in Tracts 57 and 60, Township 4 South, Range 83 West of the 6th Principal Meridian, said Tracts being in accordance with the Independent Resurvey of said Township and Range as approved by the U. S. Surveyor General's Office, dated June 20, 1922, more particularly described as follows: Beginning at Angle Point No. 1 of said Tract 57 being marked with an iron post and brass cap properly set and found in place; thence S.00029'W. 3147.2 feet along the Easterly line of said Tracts 57 and 60 to the True Point of Beginning; thence N.51017'W. 87.00 feet to a point on the Easterly right -of -way line of U.S. Highway 6 and 24; thence N.13057'W. 363.6 feet along said right -of -way line to a point of curve; thence along a curve to the left along said right -of- way line having a radius of 1687.1 feet an arc dis- tance of 1170.9 feet whose long chord bears N.33050'W. 1147.5 feet; thence N.530451W. 261.7 feet along said right -of -way line; thence N.62032'W. 79.6 feet along said right -of -way line; thence N.87 °43'30 "E. 369.9 feet to a point on the Southerly right -of -way line of the Denver and Rio Grande Western Railroad; thence S.52008'E. 479.5 feet along said right -of -way to a point of curve; thence along a curve to the right along said right -of -way line having a radius of 1218.5 feet and a central angle of 25002' whose long chord bears S.390371E. 528.0 feet to a point on the Easterly line of said Tract 57; thence S.000291W. 866.5 feet to the True Point of Beginning. The above described parcel of land contains 10.815 acres, more or less.
