HomeMy WebLinkAboutR83-053 - 1041 Blue Grouse Club PUDEAGLE COUNTY PERMIT AUTHORITY COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 83- 53 WOK� PAOIE JO EAr Jl',� ?, P `t 53 F11'03 ADMINISTRATIVE AMENDMENT TO THE PERMIT ISSUED TO THE BLUE GROUSE CLUB APPROVING THE SITE SELECTION AND CONSTRUCTION OF A MAJOR NEW DOMESTIC WATER AND SEWAGE TREATMENT SYSTEM - THE BLUE GROUSE CLUB PLANNED UNIT DEVELOPMENT WHEREAS, pursuant to the Guidelines and Regulations for Areas and Activities of State Interest of the County of Eagle, State of Colorado, 1980, as amended, the Eagle County Permit Authority pursuant to Resolution No. 82 -42, did on July 15, 1982, approve the application from the Blue Grouse Club for a permit to conduct the following activity of state interest: Site selection and construction of a major new domestic water and sewage treatment system, on real property generally referred to as the Blue Grouse Club Planned Unit Development and more particularly described in Resolution No. 82 -42 recorded in Book 342 at Page 763 of the property records of the County of Eagle, State of Colorado; and WHEREAS, Resolution No. 82 -42 provided, inter alia, that in the event the Applicant fails to take substantial steps to initiate the permitted activity within twelve months from the date of the permit, or, if such steps are taken, in the event the Applicant fails to complete the permitted activity with reasonable diligence, the permit may be revoked by the Permit Authority; and 61HEREAS, based upon the testimony and evidence presented at the permit hearing, it was the express intent of the Eagle County Permit Authority to approve the suDject permit to conduct an activity of state interest in accordance with the conditions and requirements imposed by the Board of County Commissioners, County of Eagle, State of Colorado, relative to its approval of the preliminary plan for the Blue Grouse Club Planned Unit Development; and WHEREAS, the Eagle County Permit Authority, with the concurrence of the Blue Grouse Club, desires to amend Resolution No. 82 -42 in order to more accurately state the intent of the Eagle County Permit Authority as set forth hereinabove. NOW, THEREFORE, BE IT RESOLVED BY THE EAGLE COUNTY PERMIT AUTHORITY: THAT, Resolution No. 82 -42 is hereby amended by the amendment of the last paragraph therein which presently reads: "This permit is valid for use only by the Applicant and may not be transferred. In the event that the Applicant fails to take substantial steps to initiate the above development or activity within twelve (12) months from the date of this permit, or, if such steps are taken, in the event the Applicant fails to complete the development or activity with reasonable diligence, this permit may be revoked by the Permit Authority ", to now read as follows: "This permit is valid for use only by the Applicant and may not be -2- transferred. In the event that the Applicant fails to take substantial steps to initiate the above development or activity within three (3) years of the date of final approval of the Blue Grouse Club Planned Unit Development, or, if such steps are taken, in the event the Applicant fails to complete the development or activity with reasonable diligence, this permit may be rP•roked by the Permit Authority. Upon written request by the Applicant, the aforesaid time requirement may be extended by the Permit Authority subsequent to a Public Hearing thereon." THAT, the aforesaid amendment shall become effective upon adoption by the Eagle County Permit Authority, and the recording thereof in the property records of the County of Eagle, State of Colorado. THAT; the entirety of Resolution No. 82 -42, as herein amended, is hereby readopted. THAT, the aforesaid amendment and readoption of Resolution No. 82 -42 shall not constitute or be construed as a waiver of any violations existing at the time of adoption of this Resolution. THAT, should any section, clause, provision, sentence, or i by a court of such decision Resolution as than the part purpose, this cord of this Resolution be declared competent jurisdiction to be invalid, shall not affect the validity of this a whole, or any parts thereof, other so declared to be invalid. For this Resolution is declared to be severable. THAT, this Resolution is necessary for the public health, safety and welfare. MOVED, READ AND ADOPTED by the Eagle County -3- Permit Authority at its meeting held the day of ���, 1983.
