HomeMy WebLinkAboutR83-039 - denial of special use permit R&L ConcreteRESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 83-5/ DENIAL OF SPECIAL USE PERMIT - R & L Concrete, Inc (Contractor's Yard) FILE NO. - ZS- 175 -83 WHEREAS, R & L Concrete did file an application with the Eagle County Department of Community Development on or about January 28, 1983, within the Resource Zone District; and WHEREAS, a public hearing was held by the Board of County Commissioners of the County of Eagle, State of Colorado, on April 27th, 1983; and WHEREAS, based on the evidence, testimony, exhibits, study of the Master Plan for the unincorporated areas of Eagle County, comments of the Eagle County Department of Community Development, comments of public officials and agencies, the re- commendation of the Eagle County Planning Commission, and com- ments from all interested parties, the Board of County Commissioners of the County of Eagle, State of Colorado, finds as follows: 1. That proper publication and public notice was provided as required by law for the hearing before the Planning Commission and the Board of County Commissioners. (POSSIBLE FINDINGS) 2. Permission of the State Land Board, the owner of the property, had not been obtained. NOW, THEREFORE, BE IT RESOLVED, that the petition of R & L Concrete for approval of a special use of Contractor's Yard within the Resource Zone District in the following des- cribed unincorporated area of Eagle County be disapproved; LEGAL DESCRIPTION SE4SE4, Section 36, Township 4 South, Range 83 West of the Sixth Principal Meridian. MA MOVED, READ, AND ADOPTED by the Board of County Commissioners of the County of Eagle, State of Colorado, at its meeting held the 8th day of June 1983, nunc pro tunc to the 27th day of April, 1983.
