BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION N0. 83 -'��
RESOLUTION ALLOCATING AND DIRECTING THE DISTRIBUTION OF
CERTAIN FUNDS TO BE RECEIVED BY EAGLE COUNTY PURSUANT TO THE
PROVISIONS OF SECTION 30 -29 -101, COLORADO REVISED STATUTES
1973, AS AMENDED (RELATING TO RECEIPTS FROM NATIONAL FORESTS)
WHEREAS, in September of each year the State
Treasurer of the State of Colorado pays over to the County
Treasurer of each of the counties in Colorado in which
National Forests are located, on the basis of the acreage of
National Forest land located in each county and in accordance
with information provided by the appropriate agency of the
federal government as to source and amount, a portion of the
funds received by the State from the federal government under
provisions of the Act of Congress of May 23, 1908, as
amended, relating to receipts from the National Forests; and
WHEREAS, there is National Forest land located in
Eagle County; and
WHEREAS, the Board of County Commissioners of the
County of Eagle is directed by Section 30 -29 -101, C.R.S.
1973, as amended, to allocate the money received from the
State Treasurer pursuant to the provisions of said statute to
the County Road and Bridge Fund and the School Districts in
Eagle County.
NOW, THEREFORE, BE IT RESOLVED by the Board of
County Commissioners, County of Eagle, State of Colorado:
THAT, ninety -five percent (95 %) of the funds
received by the County Treasurer of Eagle County from the
State Treasurer pursuant to the provisions of Section
30 -29 -101, C.R.S. 1973, as amended, shall be allocated to the
County Road and Bridge Fund and five percent (5 %) of the
funds received pursuant to Section 30 -29 -101, C.R.S. 1973, as
amended, shall be allocated to the public schools in the
County; and
THAT, the five percent allocated to the public
schools shall be divided among the school districts in the
County, (RE -1 -J, Re -50 -J, and West Grand JT) in the
proportion to which its average daily pupil attendance of
Eagle County pupils during the preceding school year bears to
the aggregate average daily pupil attendance in all districts
in Eagle County during said preceding school year; and
THAT, the County Treasurer is requested and directed
to obtain the pupil attendance figures required to make
allocation established by the Board of County Commissioners
in this Resolution, and then to distribute any funds received
from the State Treasurer pursuant to the provisions of
Section 30 -29 -101, C.R.S. 1973, as amended, upon receipt in
accord with the terms of this Resolution to the Public School
Districts and the County Road and Bridge Fund.
THAT, this Resolution shall remain in full force and
effect until such time as the State Legislature amends or
otherwise alters the provisions of Section 30 -29 -101,
Colorado Revised Statutes, 1973, as amended, or until such
time as it is altered by Resolution of the Board of County
Commissioners.
