HomeMy WebLinkAboutR83-021 special use permit Blue Lake Gravel PitRESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION No. 83- ol I APPROVAL OF SPECIAL USE PERMIT - The Blue Lake Gravel Pit FILE No. ZS- 169 -82 WHEREAS, Robert M. Larson and Byrd William Eppley application with the Eagle County Department of Community Development on or about November 30, 1982 , within the Resource Zone District; and WHEREAS, a public hearing was held by the Board of County Commissioners of the County of Eagle, State of Colorado, on February 9 , 19 83; and WHEREAS, based on the evidence, testimony, exhibits, study of the Master Plan for the unincorporated areas of Eagle County, comments of the Eagle County Department of Community Development, comments of public officials and agencies, the recommendation of the Eagle County Planning Commission, and comments from all interested parties, the Board of County Commissioners of the County of Eagle, State of Colorado, finds as follows: 1. Th�it proper publication and public notice was provided as required by law for the hearing before the Planning Commission and the Board of County Commissioners. 2. That the proposed special use conforms to the requirements of Section 2.09 of the Eagle County Land Use Regulations. 3. That the proposed land use will be compatible with existing uses in the area. 4. That for the above - stated and other reasons, the proposed zoning is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Eagle County. NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of the County of Eagle, State of Colorado: That the application of The Blue Lake Gravel Pit File No. ZS- 169 -82 , for approval of a special use of A Gravel Pit within the Resource Zone District in the following described unincorporated area of Eagle County be approved: LEGAL DESCRIPTION A parcel of land located in Lots 5 and 10, the North- west One- Quarter of the Southeast One- Quarter (N1VSE4), and the South One -Half of the Northeast One - Quarter (SZNE4), of Section 33, Township 7 South, Range 87 West of the Sixth Principal Meridian, Eagle County, Colorado, being more particularly described as follows, to wit: Beginning at a point on the Northerly right of way line of Colorado Highway No. 82 whence a brass cap found in place and properly marked for the Southeast Corner of said Section 33 bears S.50059'58 "E. 2280.85 feet; thence N.00000101 "E. 1515.00 feet; thence S.86016151 11E. 200.42 feet; thence S.64058159 11E. 413.82 feet; thence S.22004104 "E. 159.70 feet; thence S.40050101 "E. 214.11 feet; thence S.90000100 "E. 35.00 feet; thence S.45000100 "E. 113.14 feet; thence S.27036116 11E. 485.31 feet; thence S.33002140 11W. 140.00 feet; thence 615.72 feet on the arc of a curve to the left having a radius of 2141.43 feet; the chord of which bears S.24048126 "W. 613.60 feet; thence S.16034113 11W. 79.84 feet to the Northerly right of way line of Colorado Highway No. 82; thence N.72010133 "W. 796.68 feet along said northerly right of way line to the point of beginning. Said parcel of land contains 31.2789 acres, more or less. THAT the following conditions shall be placed upon this approval and that violation of any condition shall be the basis for revocation of the permit: 1. There shall be an annual review. The review date is prior to February 9th of each year. 2. The applicant must obtain a State Highway Access Permit. 3. The haul road and equipment area must be oiled or otherwise treated to control dust. 4. At each annual review, a map must be presented showing site configuration and general phasing plan for the next year. At this time the phasing plan will be reviewed. 5. Operation of the permit is allowed 12 hours per day, on week days. Maintenance is allowed any time. 6. The agreement from the ditch owners, in which they approve the ditch relocation must be signed, and the permitees must indemnify the ditch owners. 7. At each annual review, permitee must present some evidence of due diligence toward the legal pro- vision for water storage in the lake. At such time as these legal steps are completed, this con- dition is of no further effect. 8. The Mined Land Reclamation Board Bond suffices for the Eagle County Bond for revegetation. 9. This permit is for 10 years, to.expire February 9, 1993, at the applicant's request. THAT the Board of County Commissioners directs the Department of Community Development to provide a copy of this resolution to the applicant. e MOVED, READ, AND ADOPTED by the Board of County Commissioners of the County of Eagle, State of Colorado, at its meeting held the _2nd day of March , 1983 , nunc pro -tune to the 9th day of February , 1983 .
