COUNTY OF EAGLE ) The Board of County Commissioners of Eagle County, Colorado met in regular session at the Eagle County Courthouse in Eagle, Colorado, the regular meeting place of said Board, at the hour of 10:00 o'clock a.m., on Thursday, the 24th day of February, 1983. Present: Commissioners: County Clerk and Recorder: County Attorney: David E. Mott, Chairman Danny Williams Johnnette Phillips Beth A. Whittier Absent: Commissioner Keith Troxel Thereupon, the following proceedings, among others, were had and taken. A hearing on the Service Plan and related documents for the Gypsum Fire Protection District was held by the Board of County Commissioners pursuant to the provisions of Part 2 of Article 1, Title 32, C.R.S. 1973, as amended and in accordance with the resolution adopted by the Board on the 27th day of January, 1983. Thereupon, Commissioner Williams moved that the Commis- sioners find the Service Plan with amended boundaries acceptable in all respects except as regards the exclusion of the Eagle County Airport property; that additional testimony on whether the Airport should or should not be excluded is required; and, therefore the Hearing be "continued to March 2, 1983 at 1:30 p.m. at the same location. The motion carried. Thereupon, the bearing was reconvened on March 2, 1983 at 1:30 p.m. Present were the following Commissioners: David E. Mott, Chairman Keith Troxel Danny Williams Absent: Following additional testimony on the Service Plan and related documents, Commissioner iN ', introduced and moved the adoption of the following Resolution: 1 RESOLUTION /d 0 ° X-3 - /'�) WHEREAS, pursuant to the provisions of Part 2 of Article 1 of Title 32, C.R.S. 1973, as amended, the Board of County Commissioners of Eagle County, Colorado, on Thursday, the 24th day of February, 1983, held a public hearing on the Service Plan and related documents for Gypsum Fire Protection Dis- trict, and continued said hearing to March 2, 1983; and WHEREAS, notice of this hearing was duly published in Eagle Valley Enterprise, Eagle, Colorado, a newspaper of general circulation within Eagle County, said publication occurring on February 3, 10 and 17, 1983 as required by law, forwarded to the Petitioners, and mailed to the governing body of each municipality and special district which has levied an ad valorem tax within the next preceding tax year and which has boundaries within a radius of three miles of the proposed district, the Division of Local Government, and to the Eagle County Planning Commission; and WHEREAS, the Board has considered the Service Plan and all other testimony and evidence presented at the hearing; and WHEREAS, it appears that the Service Plan should be approved with condition; THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COM:'1168IONERS OF EAGLE COUNTY, COLORADO: 1. That the Board of County Commissioners of Eagle County, Colorado, does hereby determine that all of the requirements of Part 2 of Article 1 of Title 32, C.R.S. 1973, as amended, .relating to the filing of the Service Plan for Gypsum Fire Protection District have been fulfilled and that notice of the hearing was duly given in the time and manner required by law. 2. That said publication of the Notice of Hearing on Service Plan in Eagle Valley Enterprise, a newspaper of general circulation within the County, is hereby approved. 2 3. That the boundary changes proposed at the hearing and continued hearing do not constitute a substantial amendment to the original boundaries proposed, and should be approved. 4. That the Service Plan of Gypsum Fire Protection District is hereby approved with condition, which conditions are as follows: A. The boundary of the proposed Gypsum Fire Protection District is amended to: 1. Reflect the changes suggested by the County Assessor and introduced as Applicants' Exhibit "F" at the February 24th hearing. 2. Include the airport property, previously pro- posed to be excluded from the boundaries of the District. Said amended boundary is attached hereto as Appendix "A" B. The District shall not be responsible for air traffic fire protection and suppression except through the terms of a contract which may later be drawn with Eagle County. C. The District shall not be expected to maintain, unless compensated by Eagle County, specialized hazardous materials handling equipment which may be required by inclusion of the airport. D. The Commissioners recognize a shortage of fire suppression storage water and will take steps to bring available storage up to District standards. E. The District shall have the opportunity to request funding from Eagle County should inequities result from District fire protection costs as compared with airport revenue. 5. That all resolutions, or parts thereof, in conflict with the provisions hereof, are hereby repealed, except that this repealer shall not be construed so as to revive any resolution or part thereof heretofore repealed. 3 6. That a certified copy of this Resolution be filed in the records of Eagle County and submitted to the Peti- tioners for the purpose of filing in the District Court of Eagle County, Colorado. COUNTY OF } I, Johnette Phillips, County Clerk and Recorder of the County of Eagle, State of Colorado, do hereby certify that the foregoing pages number 1 to 5, inclusive, constitute a true and correct copy of the record of proceedings of the Board of County Commissioners of said County, taken at a regular meeting thereof held on Thursday, the 24th day of February, 1983, at 10:00 a.m. and continued to March 2, 1983, in Eagle, Colorado, insofar as said proceedings relate to a Resolution, a copy of which is therein set forth; that said copy is a full, true and correct copy of the original of said Resolution as adopted by the Board of County Commis- sioners at said meeting; that the original Resolution has been duly signed and approved by the presiding officer of the Board of County Commissioners and myself, as County Clerk and Recorder, sealed with the seal of the County and recorded in the Book of Resolutions of the County kept for that purpose in my office. I further certify that the Chairman and -_ members of the Board of County Commissioners were present at said meeting and that 3 -_ members of the Board voted in favor of the adoption of the Resolution as set forth in the minutes of the meeting.
