HomeMy WebLinkAboutR83-015 setting hearing for revocation of liquor license for Rowdy's PlaceRESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO J RESOLUTION NO. 83- 1`) RESOLUTION SETTING A HEARING TO CONSIDER THE SUSPENSION OR REVOCATION OF THAT CERTAIN HOTEL AND RESTAURANT LICENSE HELD BY ROWDY'S PLACE, INC. RELATIVE TO AN ESTABLISHMENT LOCATED AT 1423 STATE HIGHWAY 82, EL JEBEL, COLORADO WHEREAS, on February 7, 1983, the Board of County Commissioners of the County of Eagle, State of Colorado, in its capacity as the Local Liquor Licensing Authority, County of Eagle, Colorado, hereinafter referred to as the "Authority," received information in the form of a Complaint from Mr. Gary Bates, State Liquor Enforcement Officer of the Liquor Enforcement Division, Department of Revenue, State of Colorado, upon which the Authority could conduct a hearing pursuant to Section 12 -47 -110, C.R.S. 1973, as amended, relative to the Hotel and Restaurant License held by Rowdy's Place, Inc. for the establishment known as Rowdy's Place, located at 1423 State Highway 82, El Jebel, Colorado, hereinafter referred to as the "licensed premises "; and WHEREAS, such information received from Mr. Bates pertained to the following activities conducted at the licensed premises: 1. On February 19, 1982, Andrew Rakicsak was arrested as an intoxicated pedestrian. Immediately prior to his arrest, Andrew Rakicsak was served alcoholic beverages at Rowdy's Place. (Violation Section 12- 47- 128(5)(a), Colorado Revised Statutes 1973, as amended; Regulation 47- 105.1, Colorado Liquor Code Final Regulations.) 2. On May 27, 1982, Antonio Lopez was killed in an automobile accident. At the time of his death he was intoxicated. On the day of the fatal accident he had been served alcoholic beverages at Rowdy's Place. (Violation Section 12- 47- 128(5)(a), Colorado Revised Statutes 1973, as amended; Regulation 47- 105.1, Colorado Liquor Code Final Regulations.) 3. On November 13, 1982, Jeffrey Cheek was killed in an automobile accident. At the time of his death he was intoxicated. On the day of the fatal accident he had been served alcoholic beverages at Rowdy's Place. (Violation Section 12- 47- 128(5)(a), Colorado Revised Statutes 1973, as amended; Regulation 47- 105.1, Colorado Liquor Code Final Regulations.) 4. On April 4, 1982, Jerilyn Ross was killed in an automobile accident. At the time of her death she was intoxicated. On the day of the fatal accident she had been served alcoholic beverages at Rowdy's Place. (Violation Section 12- 47- 128(5)(a), Colorado Revised Statutes 1973, as amended; Regulation 47- 105.1, Colorado Liquor Code Final Regulations.) 5. During August, 1982, an intoxicated pedestrian was contacted by the Colorado State Patrol. Immediately prior to the contact, the pedestrian was served alcoholic beverages at Rowdy's Place. (Violation Section 12- 47- 128(5)(a), Colorado Revised Statutes 1973, as amended; Regulation 47- 105.1, Colorado Liquor Code Final Regulations.) 6. On August 13, 1982, a nineteen - year -old was arrested for driving while impaired. Immediately prior to his arrest the nineteen - year -old had been served alcoholic beverages at Rowdy's Place. (Violation Section 12- 47- 128(5)(a), Colorado Revised Statutes 1973, as amended; Regulation 47- 105.1, Colorado Liquor Code Final Regulations.) 7. On August 2, 1982, an accident took place and the driver of the vehicle involved in the accident was PA arrested for driving while intoxicated. The driver had been served alcoholic beverages immediately prior to the accident at Rowdy's Place. (Violation Section 12- 47- 128(5)(a), Colorado Revised Statutes 1973, as amended; Regulation 47- 105.1, Colorado Liquor Code Final Regulations.) 8. On July 10, 1982, police were called to a disturbance at Rowdy's Place involving an employee of the establishment. The victim was a Dennis P. Smith. (Violation Colorado Liquor Code Final Regulations Reg. 47- 105.1.) 9. On or about June 5, 1982, Rowdy's Place employed a Joseph Payne, a person not of good character and reputation. (Violation Section 12- 47- 111(vi), Colorado Revised Statutes 1973, as amended.) 10. On or about December 31, 1981, Rowdy's Place employed Mick Hensley and David Iverson, persons not of good character and reputation. (Violation Section 12- 47- 111(vi), Colorado Revised Statutes 1973, as amended.) 11. On August 11, 1982, a disturbance took place at Rowdy's Place between the owner and a patron. (Violation of Colorado Liquor Code Final Regulations Reg. 47- 105.1.) 12. On February 28, 1982, patrons of Rowdy's Place left the licensed premises in an intoxicated condition driving unsafely on the adjoining property and created a disturbance in the parking lot of the premises with other patrons. (Violation Colorado Liquor Code Final Regulations, Reg. 47- 105.1.) NOW, THEREFORE, be it resolved by the Board of County Commissioners, County of Eagle, Colorado: THAT, the Board shall hold a hearing on March 2, 1983, at 10:00 A.M. in the Board of County Commissioners' meeting room, McDonald Building, 550 Broadway, Eagle, Colorado, pursuant to Section 12 -47 -110, C.R.S. 1973, as 3 amended, and Regulation 47 -110.1 of the "Coloado Liquor Code Rules and Regulations" to determine whether the hotel and restaurant license held by Rowdy's Place, Inc. for the subject licensed premises should be revoked or suspended pursuant to the laws and regulations cited above. THAT, the Board hereby orders Rowdy's Place, Inc. to show cause at said hearing why the above referenced license should not be suspended or revoked. THAT, a certified copy of this Resolution shall be mailed to Rowdy's Place, Inc. at the address contained in its license, which shall constitute notice to the licensee of the above - referenced hearing. MOVED, READ AND UNANIMOUSLY ADOPTED by the Board of County Commissioners, County of Eagle, Colorado, at its regular meeting held the 9th day of February, 1983.
