COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 83- S�'
ESTABLISHMENT OF REVENUE ACCOUNT FOR MONIES ASSESSED AND
RECEIVED BY THE EAGLE COUNTY COURT TO DEFRAY THOSE COSTS OF
THE COUNTY OF EAGLE ASSOCIATED WITH THE ENACTMENT OF
H.B. 1232 BY THE COLORADO STATE LEGISLATURE IN 1982
WHEREAS, pursuant to Section 42 -4 -1202, C.R.S. 1973,
as amended by H.B. 1232 enacted by the Colorado State
Legislature in 1982, the Board of County Commissioners of the
County of Eagle, State of Colorado, hereinafter referred to
as the "Board," in conjunction with the Eagle County Court,
the State of Colorado 5th Judicial District Probation
Department, and the Eagle County Sheriff, hereinafter
collectively referred to as "cooperating agencies,"
established a work assignment program for those individuals
convicted of an alcohol- related traffic offense and ordered
by the sentencing court to perform useful public service; and
WHEREAS, in conjunction with the aforementioned work
assignment program, the Board has established an accident
insurance plan to provide coverage for personal injuries
sustained to an individual while performing useful public
service under the County's work assignment program; the
premium of which averages from $2.00 to $4.00 per individual;
and
WHEREAS, other costs incurred by the County of Eagle
in complying with the provisions of'H.B. 1232 include, by way
of example only, the fingerprinting and photographing of an
individual convicted of an alcohol - related traffic offense
pursuant to Section 42- 4- 1202(7), C.R.S. 1973, as amended;
and
WHEREAS, based upon a review of the foregoing costs
presently incurred by the County of Eagle due to the
enactment of H.B. 1232, the Board and the cooperating
agencies have determined that a Court assessment of $10.00
against an individual convicted of an alcohol- related traffic
offense for such County costs, is warranted and justified,
and within the purview and intent of Sections 16 -11 -501,
16 -11 -502, and 16 -18 -101, respectively, C.R.S. 1973, as
amended; and
WHEREAS, the Board desires to establish a separate
and distinct revenue line item within the Eagle County
General Fund for the placement of monies received through the
Court assessment of County costs incurred as a result of the
mandates of H.B. 1232; which monies so received shall be used
solely to defray such County costs under H.B. 1232.
NOW, THEREFORE, be it resolved by the Board of
County Commissioners of the County of Eagle, State of
Colorado:
THAT, the Board hereby and herewith establishes a
revenue line item designated as number 01 -4- 0000 -454 within
the Eagle County General Fund for the purpose of receiving
monies in the form of Court assessments against convicted
alcohol - related traffic offenders under Section 42 -4- 1202(1),
C.R.S. 1973, as amended, for costs incurred by the County of
Eagle in complying with the mandates of Section 42 -4 -1202,
C.R.S. 1973, as amended in 1982 by H.B. 1232.
THAT, such monies so received and placed in the
aforementioned revenue line item shall be
defray those County expenditures mode and

assumed any responsibility or potential liability which may
arise out of or occur by reason of the Board's compliance
with the mandates of H.B. 1232.
THAT, the Board hereby and herewith requests and
directs the Eagle County Treasurer and the Eagle County
Accounting Department to take any and all steps necessary to
effectuate the intent and provisions of this Resolution.
THAT, the Board hereby finds, determines and
declares that this Resolution is necessary for the public
health, safety and welfare of the County of Eagle, State of
Colorado.
MOVED, READ AND ADOPTED at a regular meeting of the
Board of County Commissioners, County of Eagle, State of
Colorado, held this 10th day of January, 1983.
