HomeMy WebLinkAboutR83-004 approval special use pemrit Chipeta SubdivisionRESOLUTION .���M BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION No. 82 - ',/ APPROVAL OF SPECIAL USE PERMIT - Chipeta Subdivision FILE No. - ZS- 157 -82 WHEREAS, Les Shapiro and Louis Kirk did file an application with the Eagle County Department of Community Development on or about June 2, 1982 , within the Agricultural Residential Zone District; and WHEREAS, a public hearing was held by the Board of County Commissioners of the County of Eagle, State of Colorado, on December 13, 1982, and WHEREAS, based on the evidence, testimony, exhibits, study of the Master Plan for the unincorporated areas of Eagle County, comments of the Eagle County, comments of the Eagle County Department of Community Development, comments of public officials and agencies,the recommendation of the Eagle County Planning Commission, and comments from all interested parties, the Board of County Commissioners of the County of Eagle, State of Colorado, finds as follows: 1. That proper publication and public notice was provided as required by law for the hearing before the Planning Commission and the Board of County Commissioners. 2. That the proposed special use conforms to the requirements of Section 2.09 of the Eagle County Land Use Regulations. 3. That the proposed land use will be compatible with existing uses in the area. 4. That for the above - stated and other reasons, the proposed zoning is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Eagle County. � tr NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of the County of Eagle, State of Colorado: That the application of Les Shapiro and Louis Kirk, File No. ZS-157-82 -, for approval of a special use of a special design cluster project within the Agricultural Residential Zone District in the following described unincorporated area of Eagle County be approved: Tract 68A Sections 19 & 30 in Eagle County, Colorado A parcel of land located in Tract 68A, Sections 19 and 30, Township 5 South, Range 83 West of the 6th Prinicipal Meridian according to the independent resurvey of said township and range as accepted by the U.S. Surveyor General in Denver, Colorado on June 20, 1922. Said parcel being more specifically described as follows: Beginning at a point on the northerly right -of -way of Salt Creek Road, whence angle point 5 of said Tract 68A bears North 57° 13' 29" East, 75.00 feet, thence South 570 13' 29" West 62.23 feet long the northerly right -of -way of Salt Creek Road; thence 91.65 feet along a curve to the right with a central angle of 146 44' 2911, a radius of 356.23 feet, a chord of 91.40 feet and a chord bearing of South 640 35' 42 "West; thence North 050 47' 21" East, 193.74 feet; thence North 230 56' 39" Nest, 124.39 feet; thence North 21° 12' 49" East, 213.44 feet; thence North 330 57' 09" East, 200.70 feet; thence North 130 34' 55" East, 776.65 feet to a point on the line 1 -2 of Tract 68A; thence South 89° 56' 59" East 1154.38 feet along line 1 -2 of Tract 68A; thence South 000 00' 00" East 1313.82 feet to a point on the line 5 -6 of Tract 68A; thence North 890 55' 59" West 1222.20 feet along line 5 -6 of Tract 68A to a point on the northerly right -of -way of Road; thence 145.87 feet along a curve to the left whose central angle is 320 50' 32 ",radius of 254.48 feet, chord of 143.88 feet, and a chord bearing of South 730 38' 45" West to the place of beginning. THAT the Board of County Commissioners directs the Department of Community Development to provide a copy of this resolution to the applicant. -r.
