RESOLUTION
OF THE
BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 83- -3
DENIAL OF SPECIAL USE PERMIT - BASALT TRADE ASSOCIATES
FILE No. Zs- 165 -82
WHEREAS, Basalt Trade Associates did file an
application with the Eagle County Department of Community
Development on or about September 14, 1982, for approval of a
special use of concrete batch plant within the Industrial
Zone District; and
WHEREAS, a public hearing was held by the Board of
County Commissioners of the County of Eagle, State of
Colorado, on December 29, 1982; and
WHEREAS, based on the evidence, testimony, exhibits,
study of the Master Plan for the unincorporated areas of
Eagle County, comments of the Eagle County Department of
Community Development, comments of public officials and
agencies, the recommendations of the Eagle County Planning
Commission, and comments from all interested parties, the
Board of County Commissioners of the County of Eagle, State
of Colorado, finds as follows:
1. That proper publication and public notice was
provided as required by law for the hearing before the
Planning Commisson and the Board of County Commissioners.
2. That the proposed special use does not conform
to the requirements of Section 2.09 of the Eagle County Land
Use Regulation.
3. That the proposed land use will not be
compatible with existing and future land uses in the area.
4. That the proposed use, if granted, would have a
detrimental effect on the surrounding property and character
of the neighborhood.
5. The existing street improvements are inadequate
to accommodate the traffic volumes generated by the proposed
use. The proposed use would greatly increase danger to
traffic because of existing road conditions on Willets Lane
and the intersections of Willets Lane and Colorado Route 82.
The manner in which turning movements of the
vehicles to be used in the proposed use at the Route 82
intersections would have to be accomplished would greatly
increase the risk of having a potentially fatal accident
occur. The danger in these turning movements would be
further aggravated by the weight of the vehicles involved.
6. That for the above stated and other reasons,
the proposed zoning is not in the best interest of the
health, safety, convenience, order, prosperity and welfare of
the citizens of Eagle County.
NOW, THEREFORE, BE IT RESOLVED, that the petition of
Basalt Trade Associates for approval of a special use of
concrete batch plant within the Industrial Zone District in
the following described unincorporated area of Eagle County
be disapproved:
Basalt Industrial Park Lot 14
MOVED, READ, AND ADOPTED by the Board of County
Commissioners of the County of Eagle, State of Colorado, at
its meeting held the 10th day of January, 1983, nuns pro tuns
to the 29th day of December, 1982.
