AGREEMENT BETWEEN 
EAGLE COUNTY, COLORADO 
 AND  
THE CYCLE EFFECT 
 
 
THIS GRANT AGREEMENT (“Agreement”) is effective as of January 1, 2025 by and between 
Eagle County Public Health and Environment and The Cycle Effect (hereinafter “Grant 
Recipient”) and Eagle County, Colorado, a body corporate and politic (hereinafter “County”).  
 
RECITALS 
 
 
WHEREAS, the County, through its Department of Public Health and Environment (“ECPHE”) 
works to promote the health, safety and welfare of County residents of all ages; and  
 
WHEREAS, the County uses outside providers and professionals to enhance the ability of 
County to promote such health, safety and welfare; and 
 
WHEREAS, this Agreement is entered in reference to Eagle County Ballot Measure 1A, 
approved by voters on November 2, 2017, which provides for a sales and excise tax on 
recreational marijuana to establish earmarked funding to further the valid public purpose of 
addressing mental health needs in Eagle County (“Marijuana Tax Revenue”); and  
 
WHEREAS, ultimate approval for use of Marijuana Tax Revenue lies with the Eagle County 
Board of County Commissioners (“Board”); and 
 
WHEREAS, Eagle County Resolution No. 2018-007 established a Mental Health Advisory 
Committee (“MHAC”) within ECPHE to provide recommendations to the Eagle County Board 
of County Commissioners regarding the use of Marijuana Tax Revenue; and  
 
WHEREAS, the MHAC has identified a community need for funding of services dedicated to 
the ‘health promotion’ and ‘recovery or aftercare’ phases of care, and on the recommendation of 
the MHAC, the Board has allocated Marijuana Tax Revenue funds to address this community 
need by supporting programs and services offered by local organizations providing culturally 
responsive care to the public; and 
 
WHEREAS, The Cycle Effect has agreed to provide services which integrate mental health 
support and community engagement into programs for female-identifying and non-binary youth 
in Eagle County by combining physical activity, such as mountain biking, with mental health 
education, creating a holistic approach to address the emotional well-being of participants; and 
 
WHEREAS, the parties acknowledge and agree that the programs and services funded by 
Marijuana Tax Revenue promote the health, safety and welfare of the people of Eagle County and 
are intended to serve a valid public purpose and provide services that could otherwise be performed 
by County directly; and

WHEREAS, Grant Recipient has elected to perform services that help create and sustain a 
healthy, environmentally and economically vital and socially diverse community in Eagle 
County on its own and County has, therefore, elected to compensate Grant Recipient to perform 
the Services for the public to fulfill an important public purpose; and 
 
WHEREAS, compensation paid by County to Grant Recipient enables Grant Recipient to 
perform the services for the public and County shall have no responsibility for the performance 
of the services; and 
 
WHEREAS, Grant Recipient is authorized to do business in the State of Colorado and has the 
time, skill, expertise, and experience necessary to provide the Services as defined below in 
paragraph 1 hereof; and 
 
WHEREAS, this Agreement shall govern the relationship between Grant Recipient and County 
in connection with the Services. 
 
 
AGREEMENT 
 
NOW, THEREFORE, in consideration of the foregoing premises and the following promises, 
Eagle County and Grant Recipient enter into this Agreement for payment of the grant award in the 
amount of six thousand Dollars ($6,000, the “Grant Award”) to Grant Recipient.    
 
A. Grant Recipient agrees that funds awarded by County may be used and expended solely 
for the integration of mental health support and community engagement into programs for female-
identifying and non-binary youth in Eagle County by combining physical activity, such as 
mountain biking, with mental health education, creating a holistic approach to address the 
emotional well-being of participants as specified in Grant Recipient’s 2025 MHAC Funding 
Application and Grant Application Budget Section, attached hereto as Exhibit A (“Grant 
Application), and incorporated herein by reference.  All funds must be expended by Grant 
Recipient the one calendar-year grant period, with grant period closure taking place exactly one 
year from contract execution. The Grant Award set forth herein has been allocated for the specified 
Grant Period and the County makes no representations, nor should Grant Recipient rely on this 
award as a representation of, any future awards for other grant periods. 
 
B. In return for the Grant Award, Grant Recipient agrees to the terms of funding, deliverables, 
and deadlines outlined in the Scope of Work attached hereto as Exhibit B, and incorporated herein 
by reference. Grant Recipient shall submit periodic reports detailing how the Grant Award was 
expended, progress on deliverables as outlined in the Grant Application and in Exhibit B, and how 
they tie back to creating and sustaining a healthy environmentally and economically vital and 
socially diverse community. The reports will be due at mid-grant, roughly July 2025, and at grant 
closure, roughly December 2025.  Grant Recipient agrees to use the Colorado Common Grant 
(CCG) Report format which can be downloaded and printed from the following website:

C. Payment of the Grant Award will be made in one installment upon execution of this 
Agreement.   
 
D. The Grant Award must be used and expended within the Grant Period.  Any portion of the 
Grant Award not used or expended during the Grant Period must be returned to County.   
 
E. If, after payment of the Grant Award, Eagle County reasonably determines that payment 
was improper because the purposes for which the payment was made were misrepresented, or the 
terms of this Agreement were breached, then upon written notice of such determination and request 
for reimbursement from Eagle County, Grant Recipient shall forthwith return such payment to 
Eagle County.   
 
F. Grant Recipient shall comply at all times and in all respects with all applicable federal, 
state and local laws, resolutions and codes; and specifically, with the requirements of the Civil 
Rights Act of 1964 and Section 504, Rehabilitation Act of 1973, concerning discrimination on the 
basis of race, color, sex, age, religion, political beliefs, national origin or handicap.   
 
G. Grant Recipient shall not assign any of its rights or duties under this Agreement to a third 
party without the prior written consent of the County.  The County shall terminate this Agreement 
in the event of any assignment without its prior written consent, in which case, any unused Grant 
Funds must be returned to County.   
 
H. Grant Recipient agrees that no agent, employee or volunteer of Grant Recipient shall be 
deemed an agent, employee or volunteer of County.   
 
I. Grant Recipient shall maintain, for a minimum of three (3) years, adequate financial and 
programmatic records for reporting to County on performance of its responsibilities hereunder.  
Grant Recipient shall be subject to financial audit by federal, state or county auditors or their 
designees.  Grant Recipient authorizes County to perform audits or to make inspections during 
normal business hours, upon 48-hour notice to Grant Recipient for the purpose of evaluating 
performance under this Agreement.  Grant Recipient shall cooperate fully with authorized Eagle 
County representatives in the observation and evaluation of the program and records.  Grant 
Recipient shall have the right to dispute any claims of misuse of funds and seek an amicable 
resolution with County.   
 
J. This Agreement shall be governed by the laws of the State of Colorado.  Jurisdiction and 
venue for any suit, right or cause of action arising under, or in connection with this Agreement 
shall be exclusive in Eagle County, Colorado. 
 
K. This Agreement supersedes all previous communications, negotiations, and/or agreements 
between the respective parties hereto, either verbal, or written, and the same not expressly 
contained herein are hereby withdrawn and annulled.  
 
L.  This Agreement does not, and shall not be deemed or construed to confer upon or grant to 
any third party or parties any right to claim damages or to bring any suit, action or other proceeding

against either Grant Recipient or County because of any breach hereof or because of any of the 
terms, covenants, agreements and conditions contained herein.   
 
M. The invalidity, illegality or unenforceability of any provision of this Agreement shall not 
affect the validity or enforceability of any other provision hereof.  
 
N. To the extent required to perform the services under this Agreement, Grant Recipient 
represents and warrants that it has the expertise and personnel necessary to properly perform the 
services for which the Grant Award has been allocated, and its professional personnel are duly 
licensed to perform said services. 
 
O. No failure or delay by either party in the exercise of any right hereunder shall constitute a 
waiver thereof.  No waiver of any breach shall be deemed a waiver of any preceding or 
succeeding breach. 
 
P. The signatories to this Agreement aver to their knowledge, no employee of the County has 
any personal or beneficial interest whatsoever in the matters described in this Agreement. The 
Grant Recipient has no beneficial interest, direct or indirect, that would conflict in any manner or 
degree with the performance of the Agreement and Grant Recipient shall not employ any person 
having such known interests. 
 
Q. Grant Recipient shall be responsible for the completeness and accuracy of its 
performance under the Agreement, including all supporting data or other documents prepared or 
compiled in performance of the Agreement, and shall correct, at its sole expense, all significant 
errors and omissions therein.  The fact that the County has accepted or approved the work 
performed shall not relieve Grant Recipient of any of its responsibilities.  Grant Recipient shall 
perform services under this Agreement in a skillful, professional and competent manner and in 
accordance with the standard of care, skill and diligence applicable to Grant Recipients 
performing similar services.  This paragraph shall survive termination of this Agreement. 
 
S. Grant Recipient shall carry workers compensation insurance as required by law and 
automobile and commercial general liability insurance as necessary and appropriate during the 
term of the Agreement. 
 
 
T. The Grant Recipient shall indemnify and hold harmless County, and any of its officers, 
agents and employees against any losses, claims, damages or liabilities for which County may 
become subject to insofar as an such losses, claims, damages or liabilities arise out of, directly or 
indirectly, this Agreement, or are based upon any performance or nonperformance by Grant 
Recipient or any of its sub-recipients hereunder including  claims for bodily injury or personal 
injury including death, or loss or damage to tangible or intangible property; and Grant Recipient 
shall reimburse County for reasonable attorney fees and costs, legal and other expenses incurred 
by County in connection with investigating or defending any such loss, claim, damage, liability 
or action.  This indemnification shall not apply to claims by third parties against the County to

the extent that County is liable to such third party for such claims without regard to the 
involvement of the Grant Recipient.  This paragraph shall survive expiration or termination 
hereof. 
 
U.  Grant Recipient certifies that it has read the Agreement, understands each and every term 
and the requirements set forth herein, and agrees to comply with the same.

2025 Mental Health Advisory Committee
Funding Application 
The Mental Health Advisory Committee (MHAC) of Eagle County is pleased to announce the opening of 
2025 Funding opportunities with the purpose of addressing mental health needs of our communities. 
These funds are focused on programs, projects, and/or initiatives contributing to health promotion/root 
causes of local mental health challenges, and efforts offering equity in access to culturally responsive 
care.
This one-year funding cycle will begin January 2025, with an application period beginning Wednesday, 
October 23rd, 2024, and closing Monday, November 18th, 2024. This funding is sourced by local 
marijuana tax revenue, meaning each contract will have a one-year scope without promise of continued 
funding. The decision-making entity of this funding stream, the Mental Health Advisory Committee, is the 
governing entity reviewing applications and selecting proposals for award.

The Cycle Effect's mission is to empower young women through mountain biking to create brighter futures 
and build stronger communities.
The Cycle Effect is a nonprofit organization that uses the bike as a catalyst to mentor athletes and foster 
belonging, physical wellbeing, mental health, community engagement, leadership skills and fun outside. 
With youth and adult programs in Eagle, Summit, Mesa and Routt counties of Colorado, The Cycle Effect 
provides bikes, gear, transpor tation, bilingual coaching and low-cost programming to eliminate barriers to 
entry. As a champion of equity, The Cycle Effect serves female-identifying and non-binary par ticipants, and 
reserves resources for those who identify as Latina, BIPOC and low-income. The organization also 
prioritizes riders who face obstacles like bullying and social or emotional challenges. 
The Cycle Effect focuses on three primary goal areas: physical wellness, community impact and mentorship, 
and building brighter futures. By providing an opportunity for girls to be engaged in regular, healthy 
programs that help build their self-esteem and promote overall wellness, girls are more likely to be healthier, 
stay engaged in school and set goals that suppor t their future.

Project Title: Empowering Young Women Through Mountain Biking
Description: The Cycle Effect aims to enhance our existing programs by integrating mental health support 
and community engagement initiatives specifically designed for female-identifying and non-binary youth in 
Eagle County. The mental health challenges the girls in our program are experiencing are significant, 
concerning and need to be addressed in a timely manner. Many of The Cycle Effect athletes identify with 
risk factors such as self-harm, thoughts of suicide, attempted suicide, depression, self harm, trouble making 
friends, body image issues, self-doubt, negative self-talk, as well as trouble managing emotions. By 
providing oppor tunities for physical activity, achievement, mindfulness, social connection, and positive role 
models, mountain biking and mentorship are valuable tools to help our par ticipants identify their resilience, 
improve their mental health, and develop a sense of self-efficacy. Research indicates that youth 
engagement in physical activities, such as mountain biking, can significantly improve mental health 
outcomes. A study published in the Journal of Adolescent Health found that regular physical activity is 
associated with lower levels of depression and anxiety among adolescents (Biddle & Asare, 2011). 
By combining physical activity with mental health education, we aim to create a holistic approach that 
addresses both physical and emotional wellbeing. The Cycle Effect has observed par ticipants experience 
increased intellectual, interpersonal, and social emotional growth within a year of our program.  This project 
will create safe spaces for participants to express themselves, build resilience, and foster connections with 
peers and mentors. Our goals include increasing par ticipation in our programs, providing focused mental 
health curriculum, and leveraging a suppor tive community of peers to encourage open dialogue about 
mental health challenges.

Program Development:
We’re introducing a curriculum section focused on technology behaviors, reduction, and their effects on 
health and wellbeing. This component, adapted from SHAPE America’s 2024 Health Education Standards, 
promotes balanced technology use alongside outdoor activities, supporting students’ holistic development. 
Pre- and post-surveys will assess par ticipants' engagement in physical activity, weekly screen time, 
confidence in navigating social media, and the impact of nature on mood. These surveys will provide 
insights into the relationship between technology use and mental health, guiding us in refining 
programming. A final repor t on survey data will highlight curriculum impact and inform future 
improvements, allowing us to better meet par ticipants' mental health needs.
By enhancing our mentorship curriculum, The Cycle Effect emphasizes the impor tance of balancing 
technology with physical activities, helping participants develop healthier habits and manage mental health 
challenges. This approach suppor ts mental wellness by fostering resilience and self-care practices. 
Research shows that mental health education empowers youth to understand their mental health, 
encourages open conversations, and promotes help-seeking when needed (Fisher et al., 2016). Through this 
initiative, we aim to create a suppor tive environment where par ticipants thrive both online and offline.
Outreach and Engagement:
Our outreach will prioritize connections with schools and community organizations serving Latina, BIPOC, 
and low-income youth, promoting accessibility and broadening participation among underrepresented 
groups (Gonzalez et al., 2018).
Training Coaches:
We will provide bilingual coaches with training in culturally responsive practices and mental health first aid. 
This training ensures our staff can suppor t par ticipants effectively and create an inclusive environment for 
all. Research shows that cultural competence improves service delivery and participant satisfaction (Sue et 
al., 2009).
Evaluation and Feedback:
To measure program effectiveness, we will continuously collect feedback from participants and community 
members. This feedback loop allows us to assess impact and make data-driven adjustments to meet 
evolving needs (Patton, 2018). By centering par ticipant input, we aim to offer a program that adapts to and 
addresses the mental health needs of our community.

The proposed project aligns with the MHAC Vision Statement by adapting local systems to better support 
the mental wellbeing of Eagle County’s diverse populations. Our initiative focuses on empowering young 
women through mountain biking, a spor t that promotes physical health and serves as a tool for mental 
resilience and community connection.
By creating a suppor tive environment that fosters belonging, we address the specific mental health needs of 
young women, particularly those from underrepresented backgrounds. This initiative is designed to be 
inclusive, ensuring that all par ticipants feel valued, which is essential for promoting mental wellbeing.
Our programming is rooted in culturally responsive practices that recognize and honor the diverse identities 
and experiences of our par ticipants. We will engage with community members to co-create activities that 
resonate with their cultural backgrounds, enhancing participation and engagement. This approach 
empowers young women and strengthens community ties, creating a vital suppor t network for mental 
health.
Research supports the effectiveness of community-based programs in addressing mental health disparities 
by fostering a sense of belonging and community engagement (Berkman et al., 2000). By aligning our 
project with the MHAC Vision, we aim to create a sustainable impact on the mental health of our 
participants. Our initiative will integrate peer support, mentorship, and safe gathering spaces, ensuring that 
young women have access to the resources they need to thrive.
In summary, our project is committed to adapting local systems to better support the mental wellbeing of 
Eagle County residents, par ticularly young women, by fostering an inclusive, culturally responsive 
environment that promotes resilience, belonging, and community engagement.
The Cycle Effect (TCE) is dedicated to addressing the diverse mental health needs of Eagle County 
community members by ensuring equity in access and cultural responsiveness. Our inclusive programs 
feature bilingual coaching and resources specifically designed for Latina, BIPOC, and low-income 
participants. By actively seeking input from the communities we serve, we tailor our offerings to reflect their 
unique cultural contexts, ensuring that all par ticipants feel valued. Through recruitment events, community 
conversations, and collaboration with local par tners, TCE identifies challenges and needs, leveraging 
insights from the wider community. A comprehensive needs assessment was conducted to pinpoint 
existing barriers to par ticipation, allowing us to adapt our programs effectively. Research indicates that 
culturally responsive care enhances engagement and outcomes in mental health services (Sue et al., 2009). 
By prioritizing cultural competence in our programming, we aim to foster an environment where all 
participants can thrive.

Equity and inclusion are deeply embedded in TCE's mission and practices. Since 2012, TCE has focused on 
serving young women from underrepresented communities, par ticularly BIPOC, Latina, and low-income 
individuals, by teaching them life skills through mountain biking. In 2024, we aim to serve 70% Latina/BIPOC 
and 70% low-income participants, ensuring that our programs are culturally relevant and accessible.
To achieve this, we implement several key strategies:
Intentional Hiring Practices: We prioritize recruiting coaches and mentors who share backgrounds and 
experiences with our par ticipants, par ticularly focusing on BIPOC and Latina individuals. This approach 
enhances relatability and builds trust within the community.
Bilingual Programming: Our programs are designed to be accessible to all par ticipants, with practices 
offered in both Spanish and English. This ensures that language barriers do not hinder par ticipation, 
allowing all young women to engage fully in our activities.
Community Partnerships: We actively collaborate with local organizations that serve underrepresented

Culturally Relevant Curriculum: Our Girls Mountain Bike Program incorporates culturally relevant themes and 
activities that resonate with the experiences of our par ticipants, creating a more engaging and meaningful 
experience.
Family Involvement: TCE understands that young people thrive with strong support networks, including 
family and trusted adults. To foster these connections, TCE holds monthly family dinners, inviting parents 
and suppor tive adults to engage with the program and connect with staff. These dinners build relationships 
and share the positive impacts TCE has on par ticipants’ lives. By involving families, TCE hopes to inspire 
parents and guardians to recognize the value of mountain biking and the skills it builds.
Feedback Mechanisms: We regularly seek input from participants, families, and community members to 
ensure our programming remains responsive to their needs. This feedback informs our practices and helps 
us adapt to the evolving dynamics of the communities we serve.
Through these interconnected strategies, TCE reflects the diversity of the populations we serve and 
cultivates a suppor tive environment that promotes mental well-being and a sense of belonging for all young 
women. By addressing cultural responsiveness and inclusivity, we enhance the overall impact of our

The proposed project promotes mental health by providing a platform for young women to engage in 
physical activity, which is proven to enhance wellbeing. According to the American Journal of Preventive 
Medicine, regular physical activity is associated with improved mood and reduced symptoms of anxiety and 
depression (Brown et al., 2007). Through our mountain biking programs, participants will improve their 
physical health and develop essential life skills such as teamwork, leadership, and resilience.
A significant root cause of health inequities is the lack of a sense of belonging, which can limit access to 
opportunities that promote both physical and mental health. Many young women, particularly from 
marginalized communities, face barriers to participating in recreational activities, including socioeconomic 
factors and cultural differences. By creating an inclusive environment that actively welcomes diverse 
participants, our project aims to dismantle these barriers and foster a sense of community.
In addition to mountain biking programs, we will integrate mental health workshops and peer support 
groups designed to address these inequities. By providing a safe space for young women to share their 
experiences, we aim to cultivate a supportive network that empowers them to navigate their emotional 
landscapes. Research shows that addressing root causes through education and suppor t can lead to long-
term improvements in mental health outcomes (Wang et al., 2019). By focusing on building a sense of 
belonging and ensuring equitable access to oppor tunities, we promote mental health and work towards a 
more just and inclusive community for all young women.

These provisions are to be read and interpreted in conjunction with the provisions of the 
Contract specified above.  
I. Entity Name: The Cycle Effect 
 
II. Project Description: This project serves to integrate mental health support and 
community engagement into programs for female-identifying and non-binary youth in Eagle 
County by combining physical activity, such as mountain biking, with mental health 
education, creating a holistic approach to address the emotional well-being of participants. 
 
III. Definitions: 
Community Voice: An approach to decision-making, project management, and strategic 
planning which incorporates direct feedback and redistributes power to community 
members most impacted by the project or programming. 
 
Root cause: A descriptor for the underlying reasons that create the differences seen in 
health outcomes which originates from the community in which people live, and the 
systems that dictate accessibility to resources and opportunities necessary for survival. 
 
Systems change/systems-level-work: The shift of responsibility for poor health outcomes 
from individual behavior, to the community systems which individuals rely on, where 
inequities in access to opportunities for success exist. This addresses population health 
measures on social, racial/ethnic, economic, and physical factors- often referred to as social 
determinants of health. 
 
Culturally Responsive Care: A provider, organization, and system’s understanding of an 
individual’s culture (the combination of a body of knowledge, a body of belief and a body of 
behavior with personal identification, language, communication preferences, customs, 
beliefs, value) when providing resources, education, and services in an effort to provide 
equitable, effective and respectful care and services.

IV. Work Plan  
Goal I: Contractor will report progress specific to the funded project showing transparency 
in use of funds, adherence to grant focus, and project purpose.  
Objective Ia: Contractor will report budgetary, programmatic, and evaluation progress with 
MHAC, point of contact being ECPHE staff member, at a minimum of two (2) occurrences 
throughout the funding cycle, taking place at mid-grant and grant closure, in adherence to 
transparency, participation, and project-specific expectations.

V. Monitoring:  
The Mental Health Advisory Committee members and/or Eagle County Public Health and 
Environment will monitor this Contract for compliance with performance requirements 
throughout the Contract period. Methods used will include progress meetings with MHAC 
and/or ECPHE as needed/requested with required documentation provided by the 
contractor. The Contractor ’s performance will be evaluated in December of 2025 prior to 
the release of final payment of contract funds, at the end of the contract period, with an 
evaluation discussion required one-year following contract closure.  
 
VI. Resolution of Non-Compliance:  
The Contractor will be notified in writing within 15 calendar days of discovery of a 
compliance issue. Within 30 calendar days of discovery, the Contractor and Mental Health 
Advisory Committee members and/or Eagle County Government will collaborate, when 
appropriate, to determine the action(s) necessary to rectify the compliance issue and 
determine when the action(s) must be completed. The action(s) and timeline for completion 
will be documented in writing and agreed to by both parties.
