HomeMy WebLinkAboutC25-283 Eagle County School District AGREEMENT BETWEEN EAGLE COUNTY, COLORADO AND EAGLE COUNTY SCHOOL DISTRICT THIS GRANT AGREEMENT (“Agreement”) is effective as of January 1, 2025 by and between Eagle County School District (hereinafter “Grant Recipient”) and Eagle County, Colorado, a body corporate and politic (hereinafter “County”). RECITALS WHEREAS, the County, through its Department of Public Health and Environment (“ECPHE”) works to promote the health, safety and welfare of County residents of all ages; and WHEREAS, the County uses outside providers and professionals to enhance the ability of County to promote such health, safety and welfare; and WHEREAS, this Agreement is entered in reference to Eagle County Ballot Measure 1A, approved by voters on November 2, 2017, which provides for a sales and excise tax on recreational marijuana to establish earmarked funding to further the valid public purpose of addressing mental health needs in Eagle County (“Marijuana Tax Revenue”); and WHEREAS, ultimate approval for use of Marijuana Tax Revenue lies with the Eagle County Board of County Commissioners (“Board”); and WHEREAS, Eagle County Resolution No. 2018-007 established a Mental Health Advisory Committee (“MHAC”) within ECPHE to provide recommendations to the Eagle County Board of County Commissioners regarding the use of Marijuana Tax Revenue; and WHEREAS, the MHAC has identified a community need for funding of services dedicated to the ‘health promotion’ and ‘recovery or aftercare’ phases of care, and on the recommendation of the MHAC, the Board has allocated Marijuana Tax Revenue funds to address this community need by supporting programs and services offered by local organizations providing culturally responsive care to the public; and WHEREAS, Eagle County School District has agreed to provide services which increase youth access to school-based mental health programming throughout the Eagle County School District to provide accessible mental health services to students. This program focuses on prevention and early intervention to reduce crises and improve student well-being, ultimately fostering a healthier school environment; and WHEREAS, the parties acknowledge and agree that the programs and services funded by Marijuana Tax Revenue promote the health, safety and welfare of the people of Eagle County and Docusign Envelope ID: 91D43CB7-931A-4B03-BB23-4F73F33C5FD4 2025 Eagle County Mental Health Advisory Board Funding are intended to serve a valid public purpose and provide services that could otherwise be performed by County directly; and WHEREAS, Grant Recipient has elected to perform services that help create and sustain a healthy, environmentally and economically vital and socially diverse community in Eagle County on its own and County has, therefore, elected to compensate Grant Recipient to perform the Services for the public to fulfill an important public purpose; and WHEREAS, compensation paid by County to Grant Recipient enables Grant Recipient to perform the services for the public and County shall have no responsibility for the performance of the services; and WHEREAS, Grant Recipient is authorized to do business in the State of Colorado and has the time, skill, expertise, and experience necessary to provide the Services as defined below in paragraph 1 hereof; and WHEREAS, this Agreement shall govern the relationship between Grant Recipient and County in connection with the Services. AGREEMENT NOW, THEREFORE, in consideration of the foregoing premises and the following promises, Eagle County and Grant Recipient enter into this Agreement for payment of the grant award in the amount of one hundred thousand, eight hundred Dollars ($100,800, the “Grant Award”) to Grant Recipient. A. Grant Recipient agrees that funds awarded by County may be used and expended solely for the provision of school-based mental health programming throughout the Eagle County School District as specified in the 2025 MHAC Funding Application and Grant Application Budget Section, attached hereto as Exhibit A (“Grant Application), and incorporated herein by reference. All funds must be expended by Grant Recipient the one calendar-year grant period, with grant period closure taking place exactly one year from contract execution. The Grant Award set forth herein has been allocated for the specified Grant Period and the County makes no representations, nor should Grant Recipient rely on this award as a representation of, any future awards for other grant periods. B. In return for the Grant Award, Grant Recipient agrees to the terms of funding, deliverables, and deadlines outlined in the Scope of Work attached hereto as Exhibit B, and incorporated herein by reference. Grant Recipient shall submit periodic reports detailing how the Grant Award was expended, progress on deliverables as outlined in the Grant Application and in Exhibit B, and how they tie back to creating and sustaining a healthy environmentally and economically vital and socially diverse community. The reports will be due at mid-grant, roughly July 2025, and at grant closure, roughly December 2025. Grant Recipient agrees to use the Colorado Common Grant (CCG) Report format which can be downloaded and printed from the following website: http://www.coloradocommongrantforms.org/CGR/default.htm. Payment of the Grant Award will be made in one installment upon execution of this Agreement. D. The Grant Award must be used and expended within the Grant Period. Any portion of the Grant Award not used or expended during the Grant Period must be returned to County. E. If, after payment of the Grant Award, Eagle County reasonably determines that payment was improper because the purposes for which the payment was made were misrepresented, or the terms of this Agreement were breached, then upon written notice of such determination and request for reimbursement from Eagle County, Grant Recipient shall forthwith return such payment to Eagle County. F. Grant Recipient shall comply at all times and in all respects with all applicable federal, state and local laws, resolutions and codes; and specifically, with the requirements of the Civil Rights Act of 1964 and Section 504, Rehabilitation Act of 1973, concerning discrimination on the basis of race, color, sex, age, religion, political beliefs, national origin or handicap. G. Grant Recipient shall not assign any of its rights or duties under this Agreement to a third party without the prior written consent of the County. The County shall terminate this Agreement in the event of any assignment without its prior written consent, in which case, any unused Grant Funds must be returned to County. H. Grant Recipient agrees that no agent, employee or volunteer of Grant Recipient shall be deemed an agent, employee or volunteer of County. I. Grant Recipient shall maintain, for a minimum of three (3) years, adequate financial and programmatic records for reporting to County on performance of its responsibilities hereunder. Grant Recipient shall be subject to financial audit by federal, state or county auditors or their designees. Grant Recipient authorizes County to perform audits or to make inspections during normal business hours, upon 48-hour notice to Grant Recipient for the purpose of evaluating performance under this Agreement. Grant Recipient shall cooperate fully with authorized Eagle County representatives in the observation and evaluation of the program and records. Grant Recipient shall have the right to dispute any claims of misuse of funds and seek an amicable resolution with County. J. This Agreement shall be governed by the laws of the State of Colorado. Jurisdiction and venue for any suit, right or cause of action arising under, or in connection with this Agreement shall be exclusive in Eagle County, Colorado. K. This Agreement supersedes all previous communications, negotiations, and/or agreements between the respective parties hereto, either verbal, or written, and the same not expressly contained herein are hereby withdrawn and annulled. L. This Agreement does not, and shall not be deemed or construed to confer upon or grant to any third party or parties any right to claim damages or to bring any suit, action or other proceeding Docusign Envelope ID: 91D43CB7-931A-4B03-BB23-4F73F33C5FD4 2025 Eagle County Mental Health Advisory Board Funding against either Grant Recipient or County because of any breach hereof or because of any of the terms, covenants, agreements and conditions contained herein. M. The invalidity, illegality or unenforceability of any provision of this Agreement shall not affect the validity or enforceability of any other provision hereof. N. To the extent required to perform the services under this Agreement, Grant Recipient represents and warrants that it has the expertise and personnel necessary to properly perform the services for which the Grant Award has been allocated, and its professional personnel are duly licensed to perform said services. O. No failure or delay by either party in the exercise of any right hereunder shall constitute a waiver thereof. No waiver of any breach shall be deemed a waiver of any preceding or succeeding breach. P. The signatories to this Agreement aver to their knowledge, no employee of the County has any personal or beneficial interest whatsoever in the matters described in this Agreement. The Grant Recipient has no beneficial interest, direct or indirect, that would conflict in any manner or degree with the performance of the Agreement and Grant Recipient shall not employ any person having such known interests. Q. Grant Recipient shall be responsible for the completeness and accuracy of its performance under the Agreement, including all supporting data or other documents prepared or compiled in performance of the Agreement, and shall correct, at its sole expense, all significant errors and omissions therein. The fact that the County has accepted or approved the work performed shall not relieve Grant Recipient of any of its responsibilities. Grant Recipient shall perform services under this Agreement in a skillful, professional and competent manner and in accordance with the standard of care, skill and diligence applicable to Grant Recipients performing similar services. This paragraph shall survive termination of this Agreement. S. Grant Recipient shall carry workers compensation insurance as required by law and automobile and commercial general liability insurance as necessary and appropriate during the term of the Agreement. T. The Grant Recipient shall indemnify and hold harmless County, and any of its officers, agents and employees against any losses, claims, damages or liabilities for which County may become subject to insofar as an such losses, claims, damages or liabilities arise out of, directly or indirectly, this Agreement, or are based upon any performance or nonperformance by Grant Recipient or any of its sub-recipients hereunder including claims for bodily injury or personal injury including death, or loss or damage to tangible or intangible property; and Grant Recipient shall reimburse County for reasonable attorney fees and costs, legal and other expenses incurred by County in connection with investigating or defending any such loss, claim, damage, liability or action. This paragraph shall survive expiration or termination hereof. U. Grant Recipient certifies that it has read the Agreement, understands each and every term and the requirements set forth herein, and agrees to comply with the same. Your Hope Center's school-based clinicians are a cornerstone of community efforts to suppor t children. Your Hope Center places clinicians in every public and char ter school in the Eagle River Valley, providing critical mental health care for students. Our work began in 2018 when the community, led by first responders, Eagle County Government, citizens, and Vail Health, requested the Aspen Hope Center to provide crisis co-response and school-based clinicians in the Eagle River Valley. Over two years, the programs expanded to meet the specific needs of our community. In January 2021, Your Hope Center was established as an independent 501(c)(3) organization to serve the Eagle River Valley. Over six years, there has been significant growth in the number of students seeking help. With extensive philanthropic suppor t, in 2022 Your Hope Center achieved a goal of placing clinicians in every Eagle County School District (ECSD) school. During the 2023-24 academic year, the program provided nearly 17,500 sessions for more than 1,000 students, representing 15% of the ECSD student population. Your Hope Center's school-based clinicians focus solely on behavioral health care, without additional academic or social responsibilities, allowing them to provide specialized suppor t to students. The presence of clinicians in schools ensures students have immediate access to mental health resources, reducing barriers to care and promoting early intervention. Goals for the School-Based Clinician Program Expand Reach and Accessibility: Increase the number of sessions provided annually to reach more students. Work with Vail Health to schedule student sessions increasing our efficiency. Engage Vail Health case managers for high-needs families to assist with social determinants of health and Medicaid registration. During the past two years, we made significant steps towards increasing our sustainability: Starting in July 2022, Your Hope Center began billing Medicaid to cover the cost of providing care to approximately 30% of the students we serve. Through our par tnership with Eagle Valley Behavioral Health and its status as a Community Mental Health Center, we are reimbursed at special rates that are higher than normal rates. We estimate this will help us recoup approximately $450,000 annually, slightly more than 10% of our $4,000,000 budget. We will continue work with ECSD and community par tners to ensure eligible children and families are enrolled in Medicaid On July 1, 2024 Your Hope Center entered an agreement with Vail Health through which our clinicians use Vail Health’s electronic health records system and Vail Health bills Medicaid and private insurance. This reduces Your Hope Center’s Medicaid billing expenses and increases our revenue by allowing private insurance payments at Vail Health’s negotiated rates. Throughout this year our clinicians will become more efficient at coding for insurance billing. In addition, Vail Health is directly scheduling clients with our school- based clinicians to increase access and efficiency. Your Hope Center has also connected with I Matter Colorado and The Second Wind Fund to provide additional suppor t for students. Your Hope Center is continuing to pursue individual and foundation philanthropic suppor t. Our overarching goal is to secure sustainable revenue streams to provide our life-saving behavioral health care for students and families in our community. As noted above, first responders, Eagle County Government, citizens, and Vail Health, helped to bring Hope Center Aspen into the Eagle River Community. Bringing Your Hope Center into our community, and par ticularly into our schools, played a critical part in adapting our local systems to better suppor t the mental wellbeing of our community. Public schools are the most diverse and population-intersecting organizations in our community. By providing bilingual care in schools and serving 15% of all ECSD students, we reach across many segments of our community. Though not solely due to Your Hope Center, the success of these effor ts is reflected in the positive outcomes reported by the Healthy Kids Colorado Survey. The survey indicates notable improvements in various mental health metrics among students: Percentage of students who felt so sad or hopeless almost every day for two weeks or more in a row during the past 12 months that they stopped doing some usual activities: Middle School: 2017: 32% - 2023: 18% High School: 2017: 32% - 2023: 21% Percentage of students who seriously thought about killing themselves: Middle School: 2017: 24% - 2023: 15% High School: 2017: 18% - 2023: 10% Percentage of students who made a plan about how they would kill themselves: Middle School: 2017: 18% - 2023: 10% High School: 2017: 15% - 2023: 8.2% Percentage of students who ever tried to kill themselves: Middle School: 2017: 9% - 2023: 4.3% High School: 2017: 8% - 2023: 4.2% Your Hope Center's work is perfectly aligned with the Mental Health Advisory Committee’s vision adapting systems for better mental wellbeing. The school-based clinician program has made significant strides in improving the mental health of students and families in the Eagle River Valley. Your Hope Center currently has eight clinicians who are bilingual with an additional bilingual practicum student. Approximately 29% of Eagle County residents are Hispanic, with 15.3% of residents foreign-born. Nearly one-third of residents speak a language other than English at home (26%). Hispanic students make up 50% of enrollment in the Eagle County School District. We provide special stipends for bilingual clinicians, as well as professional development and team building to help us retain these valued team members. In addition, we will try to fill any positions that open with bilingual clinicians. We have had great success in identifying and recruiting Spanish-speaking staff who grew up in our community. Four of our eight bilingual clinicians grew up in our local Hispanic communities. In addition, we have a local bilingual case manager working towards his MSW to become a clinician. With the massive shor tage of bilingual and bicultural clinicians across the United States, to have more than 40% of our clinicians as bilingual is beneficial for our community. As noted above, more than 40% of Your Hope Center’s school-based clinicians are bilingual and 20% are bilingual and bicultural Eagle County natives. With the specialized training required of clinicians and the nationwide shortage of clinicians, we are for tunate to be fully staffed and to have such a representative population of clinicians. In addition to our diverse staff, Your Hope Center works closely with local organizations, schools, law enforcement, and healthcare providers to understand the needs of various sectors of our community. Other professionals and clients with lived experience inform our priorities and approaches. Client feedback and evaluations also play a significant role in helping us adjust programs, select trainings, and augment services to provide care in a culturally responsive manner. From the 2017 Healthy Kids Colorado Survey we know 32% of our community’s middle and high schoolers felt sad or hopeless to an extent that they stopped doing normal activities. The root causes of this depression and anxiety are diverse. With early intervention by our school-based clinicians, we help youth identify and address root causes, as well as provide them with training, techniques, and lifestyle changes to help them overcome anxiety and depression. Working with children, and their families, before they reach crisis level plays a critical role in improving health and wellness. Our school-based clinicians accept walk-in clients, as well as referrals from teachers, counselors, administration, other students, Vail Health, and other clinicians. All school-based care is voluntary, but the rappor t our team has developed in schools makes it easier for students to seek help. The steady growth of our services and the improvement in student behavioral health measures demonstrate that our work to reach the root causes of student behavioral health issues is working. In addition to our addressing root causes to prevent behavioral health crises, Your Hope Center’s school- based clinicians provide wrap-around recovery/after care for students returning from crisis or hospitalization. During the 2023-24 school year, there were 35 crisis evaluations at schools resulting in 3 M1 holds. Your Hope Center school-based clinicians, working in conjunction with our Community Stabilization Program and Vail Health were an integral par t of the recovery/after care team for these students. Project Description: This project serves to increase youth access to school-based mental health programming throughout the Eagle County School District to provide accessible mental health services to students. This program focuses on prevention and early intervention to reduce crises and improve student well-being, ultimately fostering a healthier school environment. III. Definitions: Community Voice: An approach to decision-making, project management, and strategic planning which incorporates direct feedback and redistributes power to community members most impacted by the project or programming. Root cause: A descriptor for the underlying reasons that create the differences seen in health outcomes which originates from the community in which people live, and the systems that dictate accessibility to resources and opportunities necessary for survival. Systems change/systems-level-work: The shift of responsibility for poor health outcomes from individual behavior, to the community systems which individuals rely on, where inequities in access to opportunities for success exist. This addresses population health measures on social, racial/ethnic, economic, and physical factors- often referred to as social determinants of health. Culturally Responsive Care: A provider, organization, and system’s understanding of an individual’s culture (the combination of a body of knowledge, a body of belief and a body of behavior with personal identification, language, communication preferences, customs, beliefs, value) when providing resources, education, and services in an effort to provide equitable, effective and respectful care and services. Objective Ia: Contractor will report budgetary, programmatic, and evaluation progress with MHAC, point of contact being ECPHE staff member, at a minimum of two (2) occurrences throughout the funding cycle, taking place at mid-grant and grant closure, in adherence to transparency, participation, and project-specific expectations. Contractor will provide MHAC (via ECPHE staff contact) with budget updates with specificity and transparency in direct correlation with the funded project using the MHAC-provided reporting template. The number of contact hours for each counselor provided at each school in the district per month b. The number of students seen by mental health counselors at each school per month c. Wait times for each visit (time from referral from individual student, parent or school personnel to the time that the student is first seen by the counselor) d. Contractor will assess current organizational capacity for the incorporation of community voice in decision-making, including but not limited to staff and board representation, community-member advisory roles, community boards, etc narratively using MHAC-provided template. To be reported at end-of-grant report, roughly July, 2025 (specific date to be determined). Goal IV: Contractor will collaborate with partners of shared population(s) served in an effort to establish, determine, and/or strengthen the Organization’s role within the population’s systems/system of care. Contractor will provide ECPHE updates regarding School-Clinician program leadership’s role in participation of regular (monthly, quarterly, etc) youth mental health-focused coalitions, groups, strategies, and/or similar convenings and share this with MHAC (via ECPHE staff contact) using MHAC-provided template. Mid-grant, roughly July, 2025, and end of grant, roughly December, 2025 (specific date to be determined). 2. Contractor will provide ECPHE evidence of Eagle County School District’s strategizing efforts with key partners within the youth mental health- focused, including additional partners crucial to the efficacy of meeting the needs of Eagle County School District students. Contractor will share this information in narrative format with MHAC (via ECPHE staff contact) using MHAC-provided template. Mid-grant, roughly July, 2025, and end of grant, roughly December, 2025 (specific date to be determined). 3. Contractor will share referral processes, both to and from, the funded project and share with MHAC (via ECPHE staff contact) using MHAC-provided template. Monitoring: The Mental Health Advisory Committee members and/or Eagle County Public Health and Environment will monitor this Contract for compliance with performance requirements throughout the Contract period. Methods used will include progress meetings with MHAC and/or ECPHE as needed/requested with required documentation provided by the contractor. The Contractor’s performance will be evaluated in December of 2025 prior to the release of final payment of contract funds, at the end of the contract period, with an evaluation discussion required one-year following contract closure. VI. Resolution of Non-Compliance: The Contractor will be notified in writing within 15 calendar days of discovery of a compliance issue. Within 30 calendar days of discovery, the Contractor and Mental Health Advisory Committee members and/or Eagle County Government will collaborate, when appropriate, to determine the action(s) necessary to rectify the compliance issue and determine when the action(s) must be completed. The action(s) and timeline for completion will be documented in writing and agreed to by both parties.
