HomeMy WebLinkAboutC25-240 Early Childhood Partners AGREEMENT BETWEEN EAGLE COUNTY, COLORADO AND EARLY CHILDHOOD PARTNERS THIS GRANT AGREEMENT (“Agreement”) is effective as of January 1, 2025 by and between Early Childhood Partners (hereinafter “Grant Recipient”) and Eagle County, Colorado, a body corporate and politic (hereinafter “County”). RECITALS WHEREAS, the County, through its Department of Public Health and Environment (“ECPHE”) works to promote the health, safety and welfare of County residents of all ages; and WHEREAS, the County uses outside providers and professionals to enhance the ability of County to promote such health, safety and welfare; and WHEREAS, this Agreement is entered in reference to Eagle County Ballot Measure 1A, approved by voters on November 2, 2017, which provides for a sales and excise tax on recreational marijuana to establish earmarked funding to further the valid public purpose of addressing mental health needs in Eagle County (“Marijuana Tax Revenue”); and WHEREAS, ultimate approval for use of Marijuana Tax Revenue lies with the Eagle County Board of County Commissioners (“Board”); and WHEREAS, Eagle County Resolution No. 2018-007 established a Mental Health Advisory Committee (“MHAC”) within ECPHE to provide recommendations to the Eagle County Board of County Commissioners regarding the use of Marijuana Tax Revenue; and WHEREAS, the MHAC has identified a community need for funding of services dedicated to the ‘health promotion’ and ‘recovery or aftercare’ phases of care, and on the recommendation of the MHAC, the Board has allocated Marijuana Tax Revenue funds to address this community need by supporting programs and services offered by local organizations providing culturally responsive care to the public; and WHEREAS, Early Childhood Partners has agreed to provide services which improve child development and family well-being in underserved communities by providing culturally relevant parenting education, support for Family, Friend, and Neighbor (FFN) caregivers, and integrated case management services to reduce parental stress, enhance emotional resilience, and strengthen overall family health and stability; and WHEREAS, the parties acknowledge and agree that the programs and services funded by Marijuana Tax Revenue promote the health, safety and welfare of the people of Eagle County and Docusign Envelope ID: 74BB4186-E3A7-4392-9943-21056CB5B04D 2025 Eagle County Mental Health Advisory Board Funding are intended to serve a valid public purpose and provide services that could otherwise be performed by County directly; and WHEREAS, Grant Recipient has elected to perform services that help create and sustain a healthy, environmentally and economically vital and socially diverse community in Eagle County on its own and County has, therefore, elected to compensate Grant Recipient to perform the Services for the public to fulfill an important public purpose; and WHEREAS, compensation paid by County to Grant Recipient enables Grant Recipient to perform the services for the public and County shall have no responsibility for the performance of the services; and WHEREAS, Grant Recipient is authorized to do business in the State of Colorado and has the time, skill, expertise, and experience necessary to provide the Services as defined below in paragraph 1 hereof; and WHEREAS, this Agreement shall govern the relationship between Grant Recipient and County in connection with the Services. AGREEMENT NOW, THEREFORE, in consideration of the foregoing premises and the following promises, Eagle County and Grant Recipient enter into this Agreement for payment of the grant award in the amount of fifty-three thousand, one hundred forty-six Dollars ($53,146, the “Grant Award”) to Grant Recipient. A. Grant Recipient agrees that funds awarded by County may be used and expended solely for initiatives that improve child development and family well-being in underserved communities by providing culturally relevant parenting education, support for Family, Friend, and Neighbor (FFN) caregivers, and integrated case management services to reduce parental stress, enhance emotional resilience, and strengthen overall family health and stability as specified in Grant Recipient’s 2025 MHAC Funding Application and Grant Application Budget Section, attached hereto as Exhibit A (“Grant Application), and incorporated herein by reference. All funds must be expended by Grant Recipient the one calendar-year grant period, with grant period closure taking place exactly one year from contract execution. The Grant Award set forth herein has been allocated for the specified Grant Period and the County makes no representations, nor should Grant Recipient rely on this award as a representation of, any future awards for other grant periods. B. In return for the Grant Award, Grant Recipient agrees to the terms of funding, deliverables, and deadlines outlined in the Scope of Work attached hereto as Exhibit B, and incorporated herein by reference. Grant Recipient shall submit periodic reports detailing how the Grant Award was expended, progress on deliverables as outlined in the Grant Application and in Exhibit B, and how they tie back to creating and sustaining a healthy environmentally and economically vital and socially diverse community. The reports will be due at mid-grant, roughly July 2025, and at grant closure, roughly December 2025. C. Payment of the Grant Award will be made in one installment upon execution of this Agreement. D. The Grant Award must be used and expended within the Grant Period. Any portion of the Grant Award not used or expended during the Grant Period must be returned to County. E. If, after payment of the Grant Award, Eagle County reasonably determines that payment was improper because the purposes for which the payment was made were misrepresented, or the terms of this Agreement were breached, then upon written notice of such determination and request for reimbursement from Eagle County, Grant Recipient shall forthwith return such payment to Eagle County. F. Grant Recipient shall comply at all times and in all respects with all applicable federal, state and local laws, resolutions and codes; and specifically, with the requirements of the Civil Rights Act of 1964 and Section 504, Rehabilitation Act of 1973, concerning discrimination on the basis of race, color, sex, age, religion, political beliefs, national origin or handicap. G. Grant Recipient shall not assign any of its rights or duties under this Agreement to a third party without the prior written consent of the County. The County shall terminate this Agreement in the event of any assignment without its prior written consent, in which case, any unused Grant Funds must be returned to County. H. Grant Recipient agrees that no agent, employee or volunteer of Grant Recipient shall be deemed an agent, employee or volunteer of County. I. Grant Recipient shall maintain, for a minimum of three (3) years, adequate financial and programmatic records for reporting to County on performance of its responsibilities hereunder. Grant Recipient shall be subject to financial audit by federal, state or county auditors or their designees. Grant Recipient authorizes County to perform audits or to make inspections during normal business hours, upon 48-hour notice to Grant Recipient for the purpose of evaluating performance under this Agreement. Grant Recipient shall cooperate fully with authorized Eagle County representatives in the observation and evaluation of the program and records. Grant Recipient shall have the right to dispute any claims of misuse of funds and seek an amicable resolution with County. J. This Agreement shall be governed by the laws of the State of Colorado. Jurisdiction and venue for any suit, right or cause of action arising under, or in connection with this Agreement shall be exclusive in Eagle County, Colorado. K. This Agreement supersedes all previous communications, negotiations, and/or agreements between the respective parties hereto, either verbal, or written, and the same not expressly contained herein are hereby withdrawn and annulled. This Agreement does not, and shall not be deemed or construed to confer upon or grant to any third party or parties any right to claim damages or to bring any suit, action or other proceeding against either Grant Recipient or County because of any breach hereof or because of any of the terms, covenants, agreements and conditions contained herein. M. The invalidity, illegality or unenforceability of any provision of this Agreement shall not affect the validity or enforceability of any other provision hereof. N. To the extent required to perform the services under this Agreement, Grant Recipient represents and warrants that it has the expertise and personnel necessary to properly perform the services for which the Grant Award has been allocated, and its professional personnel are duly licensed to perform said services. O. No failure or delay by either party in the exercise of any right hereunder shall constitute a waiver thereof. No waiver of any breach shall be deemed a waiver of any preceding or succeeding breach. P. The signatories to this Agreement aver to their knowledge, no employee of the County has any personal or beneficial interest whatsoever in the matters described in this Agreement. The Grant Recipient has no beneficial interest, direct or indirect, that would conflict in any manner or degree with the performance of the Agreement and Grant Recipient shall not employ any person having such known interests. Q. Grant Recipient shall be responsible for the completeness and accuracy of its performance under the Agreement, including all supporting data or other documents prepared or compiled in performance of the Agreement, and shall correct, at its sole expense, all significant errors and omissions therein. The fact that the County has accepted or approved the work performed shall not relieve Grant Recipient of any of its responsibilities. Grant Recipient shall perform services under this Agreement in a skillful, professional and competent manner and in accordance with the standard of care, skill and diligence applicable to Grant Recipients performing similar services. This paragraph shall survive termination of this Agreement. S. Grant Recipient shall carry workers compensation insurance as required by law and automobile and commercial general liability insurance as necessary and appropriate during the term of the Agreement. T. The Grant Recipient shall indemnify and hold harmless County, and any of its officers, agents and employees against any losses, claims, damages or liabilities for which County may become subject to insofar as an such losses, claims, damages or liabilities arise out of, directly or indirectly, this Agreement, or are based upon any performance or nonperformance by Grant Recipient or any of its sub-recipients hereunder including claims for bodily injury or personal injury including death, or loss or damage to tangible or intangible property; and Grant Recipient shall reimburse County for reasonable attorney fees and costs, legal and other expenses incurred Docusign Envelope ID: 74BB4186-E3A7-4392-9943-21056CB5B04D 2025 Eagle County Mental Health Advisory Board Funding by County in connection with investigating or defending any such loss, claim, damage, liability or action. This indemnification shall not apply to claims by third parties against the County to the extent that County is liable to such third party for such claims without regard to the involvement of the Grant Recipient. This paragraph shall survive expiration or termination hereof. U. Grant Recipient certifies that it has read the Agreement, understands each and every term and the requirements set forth herein, and agrees to comply with the same. ECP’s efforts focus on young children from bir th to age 6, when brain development is peaking, behaviors are learned, and children are introduced to school. The emotional well-being of young children is directly tied to the functioning of their caregivers and the families in which they live, which informed ECP’s expansion of family suppor t services. Assuring that young children have access to high quality childcare and consistent, nur turing relationships with the adults in their lives can quite literally determine their health and mental health in later life. ECP’s Family Support Services include Incredible Years Parenting Classes, Make Parenting a Pleasure 2nd Edition Parenting Classes, Circle of Security Parenting Groups, Promoting Safe and Stable Families Intensive Case Management, home visitation, ECP’s Family Resource Center, Early Childhood Mental Health Consultation and parent coaching, and social connections and peer suppor t groups. All of ECP’s programs are offered free of charge to par ticipants and in both English and Spanish throughout the year. The project will focus on suppor ting those in underserved communities who may face barriers such as language, limited access to formal childcare programs, and socio-economic challenges. The ultimate goal is to reduce Adverse Childhood Experiences and strengthen the overall well-being of families and caregivers. The proposed funding will suppor t a multi-faceted initiative with three core components: culturally adapted parenting education programs, suppor t and training for FFN caregivers, and case management services. The project will target Spanish-speaking parents and caregivers in underserved communities, where there is a high reliance on informal childcare systems. Each activity has a common aim of improving child development outcomes and promoting emotional well-being. 1. Culturally Relevant Parenting Education: The project will implement evidence-based programs such as Make Parenting a Pleasure (MPAP) and Circle of Security Parenting (COSP). These programs are culturally adapted to ensure they are effective in Spanish- speaking communities. MPAP helps parents reduce stress, build emotional resilience, and improve parenting skills. COSP focuses on fostering secure attachment between parents and children, which is crucial for positive social emotional development. Both programs improve the parent-child relationship, reduce stress, and enhance emotional well-being. 2. Suppor t for FFN Childcare Providers: In Colorado, FFN care accounts for nearly 40% of childcare, with many caregivers being unlicensed providers who can lack training and access to resources. The project will provide comprehensive support for FFN caregivers, who are often essential to the care of children in underserved communities. Case management services that address barriers such as financial instability and limited access to healthcare will be provided in addition to peer connection oppor tunities, which create a supportive network for caregivers to learn from one another. The project will also provide quality improvement strategies to help caregivers enhance their caregiving practices and suppor t the emotional well-being of children in their care. 3. Integrated Case Management Services: Case management services will be offered to both parents and FFN caregivers, linking them to resource and referral services. The goal is to stabilize families and caregivers, ensuring they have the tools and resources they need to thrive. By promoting the mental well-being of caregivers, the project ensures that children receive nur turing, stable, and emotionally responsive care. Recruitment will be culturally relevant, emphasizing the benefits of the program for both children and caregivers. 2) Program Preparation: Finalize program details, including scheduling and logistics for Make Parenting a Pleasure (MPAP) and Circle of Security (COSP) parenting groups. Prepare materials, including Spanish- language adaptations of MPAP and COSP curricula. Ensure that facilitators are trained in culturally responsive practices and can deliver content in a way that resonates with the target audience. 3) Make Parenting a Pleasure (MPAP) 12-Week Sessions: o Begin the first of two MPAP sessions, targeting Spanish-speaking parents in the community. These 12- week sessions will focus on building emotional resilience, improving stress management, and enhancing parenting skills. Sessions will be held once per week, and each will last approximately 2 hours. o Childcare and Dinner Provided: To support full participation, dinner and childcare will be provided at each session. This ensures that parents can engage in the program without the burden of childcare concerns. 4) Circle of Security (COSP) 8-Week Sessions: o Begin the first COSP session, which will focus on building secure attachments and promoting emotional responsiveness between parents and children. Each COSP session is approximately 1.5 hours long. There will be two sessions offered in Spanish, and two sessions offered in English. 5) Case management and quality improvement support for FFN caregivers will be initiated once par ticipants are enrolled. Case managers will conduct home visits on a weekly or bi-weekly basis, providing tailored suppor t to FFN caregivers. Both personal goals of FFN providers and quality improvement goals will be established utilizing self-assessments and validated tools such as the CFSA 2.0. These assessments will serve as the basis for creating personalized quality improvement plans aimed at enhancing the caregiving environment and suppor ting the mental well-being of the caregiver. To reduce isolation, FFN caregivers will also be invited to par ticipate in peer suppor t groups. 6) Ongoing Monitoring: Participants will complete surveys at the beginning and end of each session (MPAP and COSP) to measure changes in mental health, stress levels, parenting practices, and child development outcomes. FFN caregivers will also complete regular self-assessments and par ticipate in evaluation surveys to assess improvements in caregiving practices and overall well-being. The final step will include compiling data, assessing outcomes, and preparing a report that highlights the impact of the project on family well-being and child development. This adaptation aligns with Eagle County's commitment to embracing its diverse populations and ensuring that mental health suppor t is available to all, regardless of language or cultural background. Suppor t for Family, Friend, and Neighbor (FFN) Caregivers: FFN care providers, a critical resource for many families in Eagle County, are often overlooked in traditional childcare and mental health suppor t systems. These informal caregivers, many of whom are par t of low- income, immigrant, and Spanish-speaking communities, play an essential role in child development. By providing targeted case management, peer suppor t groups, and quality improvement plans for FFN caregivers, the proposal strengthens the local childcare system. It also improves the well-being of caregivers—who are key to suppor ting the mental health of both children and parents—thus addressing a crucial gap in the existing mental health infrastructure. Holistic, Community-Driven Approach: The proposal takes a holistic, community-driven approach, focusing not just on individual mental health but on creating a sustainable system of suppor t that connects families and caregivers with resources, builds community networks, and reduces isolation. By prioritizing mental health in the context of caregiving, stress reduction, and emotional resilience, the project aligns with the vision of a community where mental well- being is supported throughout the lifespan, from childhood through adulthood, and where diverse populations are empowered and included in local systems of care. In sum, the proposal embodies Eagle County’s vision by adapting existing systems to meet the specific needs of its diverse populations, creating a more equitable, inclusive, and mentally healthy community. Equity in Access: Eagle County is home to a diverse population, with many community members facing barriers to accessing mental health services and formal childcare suppor t. Spanish-speaking families, in par ticular, often encounter linguistic and cultural barriers that limit their access to resources. This project specifically targets Spanish-speaking families by offering culturally adapted parenting education programs, including Make Parenting a Pleasure (MPAP) and Circle of Security Parenting (COSP), both of which will be delivered in Spanish and tailored to reflect cultural norms and parenting practices. This ensures that families receive high-quality suppor t in their preferred language, increasing the likelihood of meaningful par ticipation and positive outcomes.
