RESOLUTION VACATING THE RIDGWAY HOMESITES FINAL PLAT N N
WHEREAS, on February 16, 1988,the Board of County Commissioners for the County of o
Eagle, State of Colorado (the "Board") approved the the Ridgway Homesites Final Plat (the
"Final Plat"), which was subsequently recorded at Reception No. 375263 in the Office of the o
Eagle County Clerk and Recorder; and T o

WHEREAS,the Final Plat established three (3) lots,which were 9.1 acres, 6.0 acres, and 5.8 T el (71

WHEREAS, on February 26, 2025, the owner of the lots established by the Final Plat, the
Charles P. Ridgway -Julianne Tolbert Ridgway Trust (the "Owner"), submitted a request to the
Board to vacate the Final Plat,which is attached hereto and incorporated herein as Exhibit A;
and
II/ WHEREAS,the Owner desires to vacate the Final Plat and consolidate the lots established by
the Final Plat with an adjacent parcel identified as parcel number 2109-132-00-008 and the
Owner has consented to vacation of the Final Plat; and
WHEREAS,the Owner has submitted a Land Survey Plat consolidating the lots established by
the Final Plat with the adjacent parcel, which is attached hereto and incorporated herein as
Exhibit B; and
WHEREAS,there has been no development on the lots established by the Final Plat and
vacation of the Final Plat will not result in any violation of the Eagle County Land Use
Regulations or Building Resolution; and
WHEREAS, the Board of County Commissioners is willing to vacate the Final Plat.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT,the Ridgway Homesites Final Plat is hereby vacated and such property shall be deemed
returned to its original pre-subdivision status in consolidation with parcel number
2109-132-00-008 as set forth in Exhibit B.
• THAT, the vacation of the Final Plat shall not serve to vacate any of the public or private
easements depicted in Exhibit B.

THAT,the Board hereby finds, determines and declares that this Resolution is necessary for the
• public health, safety and welfare of the residents of the County of Eagle, State of Colorado.

Re: Vacation and Consolidation of Ridgway Homesites Final Plat
Dear Troy:
Mauriello Planning Group,LLC represents the Ridgways with regard to their property located
on Salt Creek Road in Eagle County. This letter is to formally request that the Board of County
Commissioners(BOCC)vacate the three lots that comprise the entirety of the Ridgway
Homesites Final Plat. These lands will be consolidated with the adjoining parcel identified as
Parcel Number 2109-132-00-008 to create one larger parcel.
• The Ridgway Homesites Final Plat was initiated and completed by Charles Ridgway and
approved by the BOCC in 1988. The three lots within this subdivision are 9.1 acres,6.0 acres,
and 5.8 acres,respectively. The property is zoned Resource and while the minimum lot area
required in the Resource zone district is 35 acres,these three parcels were allowed to be
subdivided at less than 35 acres. The vacation of the final plat and consolidation with the
adjoining 99.64 acre parcel will create a larger conforming lot.
It was determined by county staff that due to a lack of an adopted process for the vacation of a
subdivision and the fact that the result is a consolidation of parcels(not a subdivision),that
action by the BOCC in the form of a resolution was the appropriate process to formalize the
vacation. Any easements created by separate instrument will be maintained across the
property as well as the 50' right-of-way and Parcel A created for Salt Creek Road(total acreage
of Salt Creek right-of-way of 0.7426 acres).
A Land Survey Plat is also provided and can be filed with the County showing the new
boundaries of the consolidated parcel once the vacation has been approved.
