ASD-009484-2024, Cornerstone PUD,Appeal of Staff's Decision Troy Hangen, Community Development Executive Summary: Consideration of an Appeal of Staffs Decision/Interpretation, of Section 5-210.D.4 - Determination of Sufficiency,per Section 5-2400 of the Eagle County Land Use Regulations. Hearing Date: November 20,2024 Project Name: Cornerstone PUD File No.: ASD-009484-2024 Location: 20351 Highway 82, El Jebel area(Parcel Nos. 2465-111-00-027,2465-111-00-015,2465-111-00-016, and 2465-111-00-017) Owner/Applicant: Christ Community Church of Basalt Colorado,Inc. Representatives: Jon Fredricks,LANDWEST, LLC,Andrew Nussbaum,First&Fourteenth,PLLC Staff Planner: Troy Hangen, Senior Planner Recommendation: Affirm the Planning Director's Decision On October 29,2024, Christ Community Church of Basalt Colorado, Inc., also known as the Cornerstone Christian Center("Cornerstone"), submitted an Appeal(the"Appeal"), included as Attachment 1, of a County sta decision under Section 5-2400-Appeals of Staff Decisions/Interpretations of the Eagle County Land Use Regulations(the "ECLUR"). Specifically,the Appeal challenges the Planning Director's determination that Cornerstone's consolidated application for a Zone Change,File no. ZC-009315-2022, and a Consolidated Sketch and Preliminary Plan for Planned Unit Development,File no. PDSP-009314-2022, (the"Application")are insufficient per ECLUR Section 5-210.D.4-Determination of Sufficiency. Staff previously reviewed the Application and determined it is insufficient due to the omission of an affordable housing plan as required by the ECLUR and the 2020 Eagle County Affordable Housing Guidelines. Both the application and the appeal were related to property located at 20351 Highway 82 in the El Jebel area. Background: Cornerstone has been operating a church and a school on the property under a Special Use Permit granted by Eagle County in 1996(Resolution 94-183)and amended in 2000 (Resolution 00-115). Currently there are five existing buildings on the property, including a church sanctuary, school buildings that support pre-K through 9th grade, and an office and extended school building. Cornerstone would like to increase their student occupancy, 1 11/20/2024 worship services, and space for gatherings and public functions on the 4.47-acre Property. As outlined above,the Application includes a request for a Zone Change and a Combined Sketch and Preliminary Plan for PUD and proposes approximately 46,000 square feet of commercial space and six(6)residential units. The Application was submitted on or about November 4, 2022 and staff subsequently began review of the Application consistent with ECLUR Section 5-210.D.4 -Determination of Sufficiency,which provides"[t]he Planning Director shall determine if the application is sufficient and includes data in adequate detail to evaluate the application to determine whether it complies with the appropriate substantive requirements of these Land Use Regulations." Pursuant to this review, staff determined that numerous provisions of the ECLUR and the Affordable Housing Guidelines require 1 submittal of an affordable housing plan in conjunction with the Application. Staff was recommending that the Board of County Commissioners AFFIRM the Director's decision that the Application is insufficient without the omitted Housing plan. Chairman Scherr opened the meeting. Troy Hangen,Eagle County Community Development, stated that he would present the appeal. He introduced Tori Frank,Eagle County Housing/Resiliency Director. Andrew Nussbaum, an attorney out of Colorado Springs, spoke on behalf of the applicant. He stated that the applicant wished to withdraw the appeal on the record. Many members of the Corner Stone Christian Center were here today, and he thanked them for attending the meeting and being prepared to offer comments. Chairman Scherr stated that,presumably,the applicant would be back to present an application. Matt Peterson,Assistant County Attorney, added that any future hearings would be held in El Jebel.
