HomeMy WebLinkAboutMinutes 10/29/2024 PUBLIC HEARING October 29, 2024 Present: Matt Scherr Chairman Jeanne McQueeney Commissioner Kathy Chandler-Henry Commissioner Jeff Shroll County Manager Matt Peterson Assistant County Attorney Kathy Scriver Deputy Clerk to the Board This being a scheduled Public Hearing,the following items were presented to the Board of County Commissioners for their consideration: Constituent Input Chairman Scherr opened public comment. Lori Diversey from Eagle spoke. She stated that the US House Oversight Committee released a report on the Biden/Harris administration's use of manipulation during the pandemic. In the Fall of 2020 Health and Human Services(HHS) outsourced critical public health communication to a full-service behavior change research firm. HHS paid over$900 million to this one company to manipulate citizens into becoming more compliant with the government. The campaign was founded on a single theory called the"health belief model." She believed that we were moving closer to accountability for what happened in 2020. The document that she was referring to had just been released and was called We Can Do This: An Assessment of the Department of Health and Human Services' COVID-19 Public Health Campaign. She believed the document was very eye-opening. Peter Suneson, Edwards resident and Eagle County Open Space Manager,thanked the community members who joined in Edwards for the Open Space open house. The draft plan was out and available,but there was still time to provide feedback. He encouraged folks to visit the county website and review the draft plan. Commissioner Updates Commissioner Chandler-Henry gave a shout-out to all the election judges and staff working for the Clerk& Recorder's office during this election. She also mentioned all the folks signing up to work for the Birds of Prey event coming up at the end of November. The Vail Valley Foundation sponsored that. Commissioner McQueeney stated that the board would not meet next Tuesday because it was Election Day. Chairman Scherr mentioned that there were 7 days and counting until Elections Day. He reminded folks to vote, although it was too late to mail your ballot. For folks who had not received their ballot,they could go to Govotecolorado.gov to check the accuracy of their information or sign up for BallotTrax. County Manager Updates Jeff Shroll hoped the weather would bring snow for the Birds of Prey race. He reminded folks that it was snow plow season and encouraged folks to exercise patience. Road&Bridge's main priorities were the main thoroughfares, school routes, and lastly residential neighborhoods. 1 10/29/2024 Consent Agenda 1. Agreement for Professional Services Between Eagle County and Mountain Family Health Centers(MFHC) - Basalt Clinic/Avon Clinic/Gypsum Clinic 2024 Maria Gonzalez,Public&Environmental Health 2. Resolution 2024-070 for Approval of an Amended Final Plat related to Planning File No. AFP-009438-2024, Cordillera Subdivision Filing 37 Troy Hangen, Community Development 3. Approval of the Minutes for the Board of County Commissioner Meetings for August 1,August 5,August 6, and August 13,2024 Kathy Scriver, Clerk&Recorder's Office Commissioner Chandler-Henry moved to approve the Consent Agenda for October 29,2024 as presented. Commissioner McQueeney seconded the motion. The vote was declared unanimous. Business Item(s) 1. Resolution 2024-071 Concerning a Reappointment to the Eagle Cemetery District Board of Directors Dani Moore,Administration Executive Summary: The Eagle Cemetery Board is recommending the reappointment of Sally Metcalf for an additional 6 year term on the board. Dani Moore,introduced the resolution and the recommendation by the Eagle Cemetery Board to reappoint Sally Metcalf. Commissioner McQueeney moved to approve the Resolution Concerning a Reappointment to the Eagle Cemetery District Board of Directors. Commissioner Chandler-Henry seconded the motion. The vote was declared unanimous. 2. Resolution 2024-072 Concerning an Appointment to the Eagle Valley Library Board-Hiren Patel Dani Moore,Administration Executive Summary: The Eagle Valley Library District is recommending the appointment of Hiren Patel for a new 5-year term to start on January 1st,2025. Tegan Davis, Director for the Eagle Valley Library District,spoke. She stated that this was a special district and had buildings in Gypsum, Eagle,and Avon,but the area covered Dotsero, Bond, Minturn and Red Cliff. She presented the recommended appointments. Commissioner Chandler-Henry moved to approve the Resolution Concerning an Appointment to the Eagle Valley Library Board-Hiren Patel. Commissioner McQueeney seconded the motion. The vote was declared unanimous. 3. Resolution 2024-073 Concerning an Appointment to the Eagle Valley Library Board-Deborah Cohen 2 10/29/2024 Dani Moore,Administration Executive Summary: The Eagle Valley Library District is recommending the appointment of Deborah Cohen to fulfill the current vacancy on the board. Commissioner McQueeney moved to approve the Resolution Concerning an Appointment to the Eagle • Valley Library Board-Deborah Cohen. Commissioner Chandler-Henry seconded the motion. The vote was declared unanimous. 4. Resolution 2024-074 of the Board of County Commissioners of Eagle County Consenting to the Dissolution of Smith Creek Metropolitan District Tracy Stowell,Attorney's Office Executive Summary: The Board of Directors of the Smith Creek Metropolitan District has determined it is in the best interest of the District to file a Petition for Dissolution with the EC District Court by resolution of the SCMD approved on July 11,2024. The district court may enter an order dissolving a metro district without an election if the district lies wholly within a county, if the district has no financial obligations or outstanding bonds, and the metro district's board and the board of county commissioners of the county consent to the dissolution. This resolution serves as consent for the dissolution of the Smith Creek Metro District. Christina Hooper,Assistant County Attorney, introduced the item. The request was for Board's consent to the proposed dissolution of the Smith Creek Metro District. Trisha Harris, council for the Smith Creek Metro District,was online and provided some background. The District was organized in 1994 in conjunction with the Bachelor Gulch Metro District. It was intended to be the Service District that coordinated the construction of public improvements and the financing of those improvements in conjunction with Bachelor Gulch Metro District with the intent that once all the improvements were complete it would be turned over to Bachelor Gulch. Smith Creek has fulfilled its purpose and does not have any improvements that it owns and maintains, carries any debt, or has any financial obligations,which was why they were requesting dissolution of the District. Commissioner Chandler-Henry wondered if there was any reason a Board of County Commissioners would not agree to a dissolution. Ms. Hooper stated that she'd reviewed all the background and documentation provided by the Smith Creek Metro District, and there were no existing tax dollars or remaining revenues derived from tax dollars. Any debt that may be incurred in connection with the dissolution proceedings has agreed to be paid for by the underlying land owner. She had no legal concerns. Commissioner McQueeney moved to approve the Resolution of the Board of County Commissioners of Eagle County Consenting to the Dissolution of Smith Creek Metropolitan District. Commissioner Chandler-Henry seconded the motion. The vote was declared unanimous. 5. Resolution 2024-075 Approving an Amendment to the Intergovernmental Agreement Between the Eagle County Clerk and Recorder and Eagle River Fire Protection District Concerning the Tuesday,November 4, 2024 General Election Regina O'Brien, Clerk&Recorder's Office Executive Summary: Based on recent guidance from the Secretary of State's Office for counties coordinating a • mail ballot election with any Title 32 Special District such as the Eagle River Fire and Protection District ("ERFPD"),the parties wish to amend Appendix D to the ERFPD Election IGA so that ballots are sent to all 3 10/29/2024 voters who own taxable real or personal property within the ERFPD's district, instead of only voters who return an affidavit of eligibility to vote in said election. Regina O'Brien,Eagle County Clerk and Recorder, stated that this was a minor amendment to the IGA between the county and ERFPD, specifically to Appendix D. ERFPD was coordinating with the county and was a Title 32 Special District, which meant that property owners were eligible to vote. Her office received guidance from the Secretary of State's Office in the beginning of October before ballots were mailed to proactively send the property owner ballots and her office was able to do that by the deadline. Appendix D clarified this process. Commissioner Chandler-Henry moved to approve the Resolution Approving an Amendment to the Intergovernmental Agreement Between the Eagle County Clerk and Recorder and Eagle River Fire Protection District Concerning the Tuesday,November 4, 2024 General Election. Commissioner McQueeney Y seconded the motion. The vote was declared unanimous. Commissioner McQueeney moved to adjourn as the Eagle County Board of County Commissioners and reconvene as the Eagle County Airport Terminal Board. Commissioner Chandler-Henry seconded the motion. The vote was unanimous. Eagle County Airport Terminal Corporation (ECAT) 1.Agreement for On Call Services between Eagle County Air Terminal Corporation and Conner Constructors,LLC Josh Miller,Airport Executive Summary: Agreement for on call construction services between ECAT and Connor Constructors,LLC Josh Miller, Deputy Director of Aviation, stated that the agreement covered on-call general contracting services for emergency services around the terminal. The contractor was selected through an RFP process that ended a month ago. Jill Klosterman moved to approve the Agreement for On Call Services between Eagle County Air Terminal Corporation and Conner Constructors, LLC. Jeff Shroll seconded the motion. The vote was declared unanimous. Commissioner Chandler-Henry moved to adjourn as the Eagle County Airport Terminal Corporation and reconvene as the Eagle County Housing&Development Authority. Commissioner McQueeney seconded the motion. The vote was unanimous. Eagle County Housing & Development Authority 1.Agreement for Procurement and Installation between Eagle County Housing and Development Authority and Vision Security Daniel Murray,Housing Executive Summary: Beginning in the fall of 2022,the Eagle County Housing and Development Authority began working with the Eagle County Airport on the oversight of their employee housing home,the ECHO House. This house was refurbished and houses licensed and approved Eagle County Airport employees. ECHDA has continually worked to improve the livability, quality,and safety of the home for the employees living there. One major improvement that will go a long way towards additional safety is a full replacement of the fire alarm and 4 10/29/2024 monitoring system. This project will fully update the system and replace outdated equipment. The contract is through ECHDA because of the Property Management Agreement,but the project will be funded through the Eagle County Airport budget and has been approved by their department prior to execution. Daniel Murray,Housing Manager, stated that the agreement was for the update of the fire alarm system and alarm stations. The cost of the project was $21,134.11 and would be completed before winter. Commissioner McQueeney moved to approve the Agreement for Procurement and Installation between Eagle County Housing and Development Authority and Vision Security. Commissioner Chandler-Henry seconded the motion. The vote was declared unanimous. Commissioner Chandler-Henry moved to adjourn as the Eagle County Housing and Development Authority and reconvene as the Eagle County Board of County Commissioners. Commissioner McQueeney seconded the motion. The vote was unanimous. Event - Eagle County Justice Center 1.
