HomeMy WebLinkAboutC24-474 CORE Transit_Lease Assumption Addendum with Son Ray LLCLEASE ASSUMPTION ADDENDUM This Lease Assumption Addendum ("Addendum") is made and entered into as of August 4, 2024, by and between the following parties: Landlord: Son Ray LLC Trybe Property Management LLC (Agent for Owner) 999 South Logan Street, Suite 300 Denver, CO 80209 Previous Tenant: ECO Transit 3289 Cooley Mesa Road P.O. Box 1070 Gypsum, CO 81637 New Tenant: Core Transit 3289 Cooley Mesa Road P.O. Box 1070 Gypsum, CO 81637 Property Address: 435 Eby Creek Road Eagle, CO 81631 Units: 302, 303, 412 WHEREAS, the Landlord and Previous Tenant entered into a lease agreement for the above referenced units on January 8, 2024 (the "Lease"); and WHEREAS, the Previous Tenant has requested, and the Landlord has agreed, to allow the New Tenant to assume all obligations and rights under the Lease effective August 4, 2024. NOW, THEREFORE, in consideration of the mutual promises contained herein, the parties agree as follows: 1. Assumption of Lease and Consent by Landlord: Effective August 4, 2024, the New Tenant, Core Transit, hereby assumes all rights, responsibilities, and obligations under the Lease for Units 302, 303, and 412 at 435 Eby Creek Road, Eagle, CO 81631. The Lease remains in full force and effect, with Core Transit assuming the role of tenant in place of ECO Transit. Landlord consents to assumption of the lease by Core Transit. 2. Transfer of Security Deposit: The security deposit held by the Landlord under the Lease will be transferred to Core Transit Docusign Envelope ID: 21A28C73-8656-4F6E-A382-140EA704B8D9 upon the effective date of this Addendum. Core Transit agrees to the terms and conditions of the security deposit as outlined in the original lease agreement. 3. Terms and Conditions: All terms, conditions, and provisions of the original Lease between the Landlord and ECO Transit shall continue in full force and effect and are binding upon the New Tenant. 4. Release of Previous Tenant: Upon the effective date of this Addendum, the Previous Tenant, ECO Transit, is released from any further obligations or liabilities under the Lease. 5. Effective Date: This Addendum shall be effective as of August 4, 2024. IN WITNESS WHEREOF, the parties have executed this Lease Assumption Addendum as of the date first written above.
