D._first amendmentFIRST AMENDMENT TO AGREEMENT BETWEEN EAGLE COUNTY, COLORADO AND Hector Fernando Burga Ph.D. - Qualitative Research Consultant THIS FIRST AMENDMENT (“First Amendment”) is effective as of ________________ by and between Hector Fernando Burga Ph.D. a qualitative research consultant (hereinafter “Consultant” or “Contractor”) and Eagle County, Colorado, a body corporate and politic (hereinafter “County”). RECITALS WHEREAS, County and Consultant entered into an agreement dated the 09 day of May, 2024, for certain Services (the “Original Agreement”); and WHEREAS, the Original Agreement contemplated that the Consultant would perform certain duties with compensation in an amount not to exceed $49,972.00; and WHEREAS, County and Consultant desire by this First Amendment to expand the scope of Services and compensation as set forth in the Original Agreement; and WHEREAS, the term of the Original Agreement expires on the 1st day of April, 2025, and the parties desire to extend the term of the Original Agreement until October 31st, 2025, on the same terms and conditions as set forth in the Original Agreement. FIRST AMENDMENT NOW THEREFORE, in consideration of the foregoing and the mutual rights and obligations as set forth below, the parties agree as follows: 1. The Original Agreement shall be amended to include additional Services as described in Exhibit 1, which is attached hereto and incorporated herein by reference. 2. The compensation for the additional Services set forth in Exhibit 1 shall not exceed $35,000.00 or a total maximum compensation under the Original Agreement and this First Amendment of $84,972.00. 3. This First Amendment is executed pursuant to the terms of Paragraph 4 (“Extension or Modification”) of the Original Agreement. 4. Capitalized terms in this First Amendment will have the same meaning as in the Original Agreement. To the extent that the terms and provisions of the First Amendment conflict with, modify or supplement portions of the Original Agreement, the terms and provisions contained in this First Amendment shall govern and control the rights and obligations of the parties. Except as expressly altered, modified and changed in this First Amendment, all terms and provisions of the Original Agreement shall remain in full force and effect, and are hereby ratified and confirmed in all respects as of the date hereof. 6. This First Amendment shall be binding on the parties hereto, their heirs, executors, successors, and assigns. The training will be conducted in Spanish and embrace culturally appropriate methods. The formats will include PowerPoint presentations, group consultations, discussion on readings, and face-to-face meetings through Zoom and in-person. The training will also include the delivery of foundational concepts, practices, and tools pertinent to qualitative research methods. This amendment is to encompass an extension of the phases established in the program. These funds will cover an extension to a medium and advanced phase of the program. The specific topics that will be included are: ● General principles of research design ● Identification of problem and research question ● Research ethics ● Conducting literature reviews and a policy analysis ● Interviewing: Protocols, design & methods ● Focus groups: Protocols, design & methods ● Sampling & recruitment ● Observations: Fieldwork, ethnography and data collection ● Transcription, coding & analysis ● Synthesis and reporting ● Advocacy: Linking reporting to new project goals Scholarship Production Fernando Burga will produce a peer review scholarship from this scope of work with the consultation and participation of Eagle County public health and environment staff, residents, and project participants. Virtual session topics and Timeline Fees Project Activity Cost Virtual meetings -Conducted Weekly -Each virtual meeting will be 2 hours $20,000.00 -In-person meeting -Conduct three in-person meetings between March and June of 2025 (this includes traveling and lodging cost) $15,000.00 Total Cost: $35,000.00 Payment: The full amount will be provided once agreement has been signed.
