HomeMy WebLinkAboutMinutes 10/01/2024 PUBLIC HEARING October 1, 2024 Present: Matt Scherr Chairman Jeanne McQueeney Commissioner Jill Klosterman Chief Financial Officer Beth Oliver County Attorney Kathy Scriver Deputy Clerk to the Board Absent: Kathy Chandler-Henry Commissioner This being a scheduled Public Hearing,the following items were presented to the Board of County Commissioners for their consideration: Constituent Input Chairman Scherr opened constituent input. Kara Heide ceded her time to Joanna Kerwin. Joanna Kerwin, Edwards resident, spoke. She requested that the board revisit the Loop Road file. She didn't believe the public was notified of what was in the application. It was unclear what was approved on the Loop Road variance. Both staff and the West End developers should have shared any changes. She believed the file should be brought back to the board for review. Full packets should be provided to the community,and the community should trust that things are being done correctly. She was appalled to hear that the Fire Marshall was notified about the changes to the retaining wall as the retaining wall supported the fire access road. The board should be making decisions based on accurate information. Regarding the traffic study, she asked the board if they just approved a service level"E"or inadvertently approved a service level of"F"because the traffic counts were not accurate. She didn't believe the updates made to the traffic study were realistic. She again asked that the board reconsider Loop Road, do the right thing, and listen to the community. Tim McMahon of Avon spoke. He apologized for his post about last week's BoCC meeting being canceled. He knew there was no meeting,but the general public wouldn't have known,which is why he mentioned what he had done in a post. It was his understanding that all the scheduling had been corrected. He also stated that he believed it should be a requirement for anyone wanting to be on the ballot for a county commissioner to attend commissioner meetings because they'd have a better understanding of what they would be getting into,and it shows that they care about the community before they are elected and paid. Lastly,he wondered why the county couldn't invest in workforce housing that would be managed by the county so that it would remain affordable instead of relying on companies looking to make a profit. He also wondered if it was possible to make it illegal for corporations to buy homes in the valley just to rent them out. Meg Wagner, Edwards resident, spoke. She commented on the West End development. She believed traffic would increase significantly at the Edwards roundabout. She wondered if the board considered the traffic in Edwards when there were accidents on the interstate and traffic was diverted to Hwy 6. DeDe Dickerson, an Edwards resident, expressed disappointment in how the West End hearings were handled. It was upsetting to her with regards to the misinformation. The board knew that a traffic study was done in 2023 by a professional engineering firm and chose to ignore the information. County staff calculated a 14% increase in traffic when in 2023 study indicated the traffic had increased 141%since 2020. The application should not have been approved without a current traffic study. The roundabout did not have multiple lanes or the distance needed for the residents of the West End to exit and get on the interstate. She did not believe that the current infrastructure supported a project of this size and the project was not offering enough affordable housing. 1 10/01/2024 Beth Oliver, County Attorney, stated that she appreciated everyone voicing their concerns but public comment on the West End file had closed at the last meeting. The board could consider none of this public comment and would not serve as a basis to re-open the file. The board's decision was based on evidence in the record and could not be re-opened by public comment outside the record. Heidi Troester wondered why the file could not be re-visited. Ms. Oliver stated there was no reason to reopen the board's decision. Chairman Scherr closed constituent input. Chairman Scherr mentioned Commissioner Chandler-Henry was absent but would return this afternoon for the Edwards groundbreaking ceremony. Commissioner Updates Commissioner McQueeney thanked Sam Markovitz,who managed the Eagle County earl y childhood initiatives. She and Ms. Markovitz recently participated in a panel discussion with Temple Hoyne Buell about the lodging tax and how it could be used for early childhood. She expressed appreciation for Ms. Markovits putting together a nice presentation. Chairman Scherr reiterated a message from the Eagle River and Sanitation District that this was Water New Year. October 1st was a new year for water monitoring for Water Authorities. County Manager Updates Jill Klosterman, Chief Financial Officer, stated that Jeff was out at the airport meeting with the folks from Frontier Airlines to announce that Frontier would be flying in and out of Eagle County Regional Airport this winter. August 2024 Payment Report Christina Andrews, Finance Commissioner McQueeney moved to approve the Consent Agenda for October 1, 2024 as presented. Commissioner Scherr seconded the motion. Of the two voting commissioners,the vote was declared unanimous. Business Item 1. Strong Communities Grant Contract for West Eagle Tori Franks,Resiliency/Housing Executive Summary: This $4,000,000 Strong Communities Grant from DOLA will fund a portion of the infrastructure for Eagle County's West Eagle Housing project. Ms. Franks stated that before the board was a grant contract from the Strong Communities Grant fund. These were federal dollars deployed after the COVID pandemic. These grant dollars would fund part of the infrastructure costs for the West Eagle development. This was about 40%of the total cost of the infrastructure phase. The development was a 113 deed-restricted unit, all for sale; the majority would be price-capped. The application was going through the Town of Eagle's land use process. Approval from the town's Planning Commission was received on September 17th, and it was anticipated that there would be two meetings by the town board. She hoped to have a final decision on October 22. Commissioner McQueeney moved to approve the Strong Communities Grand Contract for West Eagle Commissioner Scherr seconded the motion. Of the two voting commissioners,the vote was unanimous. Commissioner McQueeney moved to adjourn as the Eagle County Board of County Commissioners and reconvene as the Eagle County Airport Terminal Board. Commissioner Scherr seconded the motion. Of the two voting commissioners,the vote was unanimous. Eagle County Airport Terminal (ECAT) Board 1. Eagle County Air Terminal Corporation Terminal Building Use Permit-Alaska Airlines David Reid,Airport Executive Summary: At the January 3, 2023 Board of Commissioners Meeting, Resolution 2023-002 was passed updating/establishing the Schedule of Airline Rates and Charges for EGE. In conjunction with these rates, each airline is required to sign a Terminal Use Permit to operate into EGE. The attached permit has been signed by Alaska Airlines and requires ECAT approval and signature as we 3 10/01/2024 Wallace Olivera,Airport Project Manager, stated that it was recently announced that Alaska Airlines would offer flights in and out of EGE. They would fly three times a week to Seattle and San Diego,beginning in mid-December and running through March. The permit, if approved,would go into effect today and run through December 31,2025,with auto-renewals each year after. Jill Klosterman moved to approve the Eagle County Air Terminal Corporation Terminal Building Use Permit-Alaska Airlines. Commissioner McQueeney seconded the motion. The vote was unanimous. Commissioner McQueeney moved to adjourn as the Eagle County Airport Terminal Board and reconvene as the Eagle County Board of County Commissioners. Commissioner Scherr seconded the motion.
