This being a scheduled Public Hearing,the following items were presented to the Board of County
Commissioners for their consideration:
Chairman Pro-Tern McQueeney noted that Chairman Scherr was unable to attend the meeting this
morning.
Constituent Input

Joanna Kerwin, a resident of Edwards, spoke. She stated that the meeting yesterday with regard to the West
End PUD was difficult. She requested that the board reconsider their decision with regard to the application. One
of the commissioners commented in a prior meeting on the question of affordability over availability. She hoped
that this would have been one of the topics discussed yesterday. It was disappointing to see that during the
commissioner's hearings, it was said over and over again that the traffic study was updated in 2023 when in fact,
staff knew that the traffic count had been done on March 4 and 5,2020. The traffic in the Edwards roundabout had
increased significantly. More pedestrians will be walking across the active intersection to take the bus eastbound.
This will create more traffic backups. She believed that many of the concerns expressed by the Planning
Commission were not shared by staff. She believed that staff misrepresented the truth to influence elected officials
and that this was not okay. She expressed disappointment in the final decision. She believed certain statements by
the applicant with regard to CDOT were untrue. Based on all this information, she asked the commissioners to
reconsider their decision.

County Manager Updates
Jeff Shroll stated that he recently traveled in the northern part of the county and gave a shout out to the
Road&Bridge team, as the condition of the Trough Road and the Colorado River Road were looking good. He
expressed appreciation for keeping the roads open and clean.

1. Resolution 2024-059 Declaring September as Suicide Prevention Month in Eagle County

Executive Summary: The nonprofit organization, SpeakUp ReachOut,would like to recognize September as
Suicide Prevention Month in Eagle County
Leslie Robertson, SpeakUp ReachOut Awareness and Brand Manager requested that the BoCC declare
September as Suicide Prevention Month in Eagle County. She encouraged folks to wear yellow for hope and
talked about an upcoming community event.
Kerry Bindley thanked the commissioners for their support of the program.

2. Resolution 2024-060 Adopting a 3rd Supplementary Budget and Appropriation of Unanticipated Revenues for
Fiscal Year 2024, and Authorizing the Transfer of Budgeted and Appropriated Monies Between Various Spending
Agencies

Executive Summary: We would like to discuss a couple of significant items that will be considered as part of the
3rd supplemental to the 2024 budget. Final consideration of the supplemental will be on September 10. This work
session is to discuss a few of the larger items, including the transfer of the 2023 ECO Transit net revenue.
Anna Earl, Eagle County Finance Director,presented the request. The total revenues in the 3rd
Supplemental were $8,201,806, and expenditures totaled$9,614,156. She reviewed each of the requests, a
summary of personnel changes, fund balance/net position,and project descriptions as presented in the BoardDoc
document dated September 5, 2024.
Commissioner Chandler-Henry moved to approve the Adopting a 3rd Supplementary Budget and
Appropriation of Unanticipated Revenues for Fiscal Year 2024, and Authorize the Transfer of Budgeted and
Appropriated Monies Between Various Spending Agencies.
Chairman Pro-Tern McQueeney seconded the motion. Of the two voting commissioners,the vote was
declared unanimous.
3. Resolution 2024-061 Authorizing the Assignment of the County's Private Activity Bond Allocation for 2024
to the Eagle County Housing and Development Authority; Providing Other Details in Connection Therewith; and
Providing an Effective Date

Executive Summary: The Colorado Private Activity Bond Ceiling Allocation Act allows each county in the state
of Colorado to receive a Private Activity Bond Allocation based on population. In 2024, Eagle County was
awarded$3,478,699 in Private Activity Bond Allocation. Eagle County shall assign their portion of the bonds to
the Eagle County Housing and Development Authority,who will allocate that same portion to Ulysses
Development Group,who was applying for the allocation for the Eagle Villas property, located in Eagle within
Eagle County.
Kim Bell Williams,Housing Director reviewed the bond allocations,Eagle County was awarded a little
over$3.4 million, and it's being requested that the 2024 bonds be assigned to the Eagle County Housing and
Development Authority.
Commissioner Chandler-Henry moved to approve the Resolution Authorizing the Assignment of the
County's Private Activity Bond Allocation for 2024 to the Eagle County Housing and Development Authority;
Providing Other Details in Connection Therewith; and Providing an Effective Date.
Chairman Pro-Tern McQueeney seconded the motion. Of the two voting commissioners,the vote was
declared unanimous.
4. Assignment of Eagle County's 2024 Allocation for Multifamily Housing Facility Bonds/Single Family
Mortgage Revenue Bonds to Eagle County Housing and Development Authority

Executive Summary: The Eagle County Housing and Development Authority requests the Assignment of
Allocation for Multifamily Housing Facility/Single Family Mortgage Revenue Bonds,as assigned to Eagle

County. In 2024, the Private Activity Bond allocation from Eagle County is $3,478,699 to be assigned to
ECHDA on behalf of the Eagle Villas project, located in Eagle within Eagle County.
Ms. Bell Williams stated that this document was a form to be filled out for the state to let them know that
the funds were being assigned back to the Housing Authority.
Commissioner Chandler-Henry moved to approve the Assignment of Eagle County's 2024 Allocation for
Multifamily Housing Facility Bonds/Single Family Mortgage Revenue Bonds to Eagle County Housing and
Development Authority.

declared unanimous.
5. Certificate of the County of Eagle,Colorado Concerning Assignment of 2024 Private Activity Bond Volume
Cap Allocation to the Eagle County Housing and Development Authority

Eagle County Attorney.
Commissioner Chandler-Henry moved to approve the Certificate of the County of Eagle,Colorado
Concerning Assignment of 2024 Private Activity Bond Volume Cap Allocation to the Eagle County Housing and
Development Authority.

declared unanimous.

and reconvene as the Eagle County Housing and Development Authority.

Eagle County Housing and Development Authority
1.Resolution 2024-062 Authorizing the Eagle County Housing and Development Authority to Receive Private
Activity Bond Allocations, and to make a Carryforward Election

Executive Summary: The Eagle County Housing and Development Authority shall receive carryforwards, and
issue Private Activity Bonds from a variety of partners in order to effectuate the resyndication of the Eagle Villas
Tax Credit application in 2025. ECHDA shall partner with the current owner of Eagle Villas,Ulysses
Development Group,to issue bonds for both 2024 and 2025 allocations. To that end, ECHDA outlines the Private
Activity Bond overview in this resolution.
Ms. Bell Williams stated that the ECHDA is accepting the Private Activity Bonds from Eagle County and
making a carryforward election. She thanked Pitkin County for signing their 2024 Private Activity Bond
allocation to the Housing Authority in support of the Eagle Villas project.

2. Eagle County Housing and Development Authority's Acceptance of Assignment of Pitkin County's 2024

Executive Summary: Pitkin County is providing the Eagle County Housing and Development Authority with
Pitkin County's 2024 Private Activity Bond allocation of$1,060,516 in order to support the Eagle Villas project in
Eagle, Colorado. This Assignment to ECHDA will be formalized with this signature and acknowledgement of the
assignment.
Commissioner Chandler-Henry moved to approve the Eagle County Housing and Development
Authority's Acceptance of Assignment of Pitkin County's 2024 Allocation for Multifamily Housing Facility
Bonds/Single Family Mortgage Revenue Bonds.

3. Eagle County Housing and Development Authority's Acceptance of Assignment of Eagle County's 2024

Executive Summary: The Eagle County Housing and Development Authority acknowledges the assignment of
Eagle County's Private Activity Bond Allocation for 2024 of$3,478,699 in order to support the Eagle Villas project
in Eagle, Colorado. This Assignment to ECHDA will be formalized with this signature and acknowledgement of
the assignment.
Ms. Bell Williams stated that the next step was for the Housing Authority to take the assignment of Eagle
County's allocations to carryforward,which ties into Item 4,which is the IRS form to be filed and the due diligence
certificate that would be filed with the carryforward.

Authority's Acceptance of Assignment of Eagle County's 2024 Allocation for Multifamily Housing Facility

4. IRS Form 8328—Eagle County Housing and Development Authority Carryforward Election of Unused Private
Activity Bond Volume Cap
Executive Summary: The Eagle County Housing and Development Authority("ECHDA") shall be the issuing
authority responsible for the supervision of the issuance of bonds in partnership with Ulysses Development Group
("UDG") for the acquiring,rehabilitating and equipping the Eagle Villas project in Eagle, Colorado.

Through Section 24-32-1709(2)(d)of the Colorado Private Activity Bond Ceiling Allocation Act,to issue at total
volume cap of$17,739,215 in Private Activity Bonds. The total includes $13,200,000 in 2024 statewide balance
bonds, $3,478,699 in Eagle County allocation, and$1,060,516 in Pitkin County allocation has been assigned to
ECHDA. In partnership,ECHDA and UDG shall proceed with diligence to ensure the issuance of the bonds within
the carryforward period to benefit Eagle Villas within Eagle County.
Commissioner Chandler-Henry moved to approve the IRS Form 8328—Eagle County Housing and
Development Authority Carryforward Election of Unused Private Activity Bond Volume Cap.
Chairman Pro-Tern McQueeney seconded the motion. Of the two voting commissioners,the vote was
declared unanimous.
5. Due Diligence Certification regarding the issuance of bonds for the Eagle Villas project within the Carryforward
Period

Executive Summary: The Eagle County Housing and Development Authority shall receive the 2024 Private
Activity Bond Allocations to include$13,200,000 from the statewide balance, $3,478,699 from Eagle County, and
$1,060,516 from Pitkin County. These combined bonds in the amount of$17,739,215 will be included in the IRS
Form 8328 as the Carryforward Election of Unused Private Activity Bond Volume Cap into 2025 by ECHDA.
Commissioner Chandler-Henry moved to approve Due Diligence Certification regarding the issuance of
bonds for the Eagle Villas project within the Carryforward Period.

declared unanimous.
6. Resolution 2024-063 Authorizing ECHDA Application for Community Development Block Grant and
Delegating Signature Authority
Executive Summary: This Resolution approves the submittal of a CDBG application for funding for Eagle Villas
Apartments and assigns signatory authority for the application and resulting reporting.
Tori Franks,Eagle County Resiliency Director, stated that all of the paperwork would assign Eagle
County's Private Activity Bond cap to Eagle Villas. This was important in allowing Ulysses Development Group to
refinance and make capital improvements to the property. This item allowed the Housing Authority to apply for a
Community Development Block Grant for Eagle Villas. This was a$5 million grant that the Housing Authority
would apply for that would flow through to the Eagle Villas. The resolution was just approving the application due
on October 1,2024.
Commissioner Chandler-Henry moved to approve the Resolution Authorizing ECHDA Application for
Community Development Block Grant and Delegating Signature Authority.
Chairman Pro-Tern McQueeney seconded the motion. Of the two voting commissioners,the vote was
declared unanimous.
Commissioner Chandler-Henry moved to adjourn as the Eagle County Housing and Development
Authority and reconvene as the Eagle County Airport Terminal Board.

1. Agreement for On-Call and Preventative Maintenance Services Between Eagle County Air Terminal Corporation
and D.H. Pace Company INC for Garage Door and Pedestrian Door Services

the doors.
Jeff Shroll moved to approve the Agreement for On-Call and Preventative Maintenance Services Between
Eagle County Air Terminal Corporation and D.H. Pace Company INC for Garage Door and Pedestrian Door
Services.
Jill Klosterman seconded the motion. The vote was unanimous.
Commissioner Chandler-Henry moved to adjourn as the Eagle County Airport Terminal Board and
reconvene as the Eagle County Board of County Commissioners.
