HomeMy WebLinkAboutR24-099 Authorizing Executive Dir of ECHDA to Execute Agreements Associated with Fox Hollow Units Docusign Envelope ID:996A5849-EF4E-4909-96EF-9C861 BB0172A Commissioner Chandler-Henry moved adoption of the following Resolution: EAGLE COUNTY HOUSING AND DEVELOPMENT AUTHORITY RESOLUTION NO. 2024- 099 RESOLUTION AUTHORIZING EXECUTIVE DIRECTOR OF THE EAGLE COUNTY HOUSING AND DEVELOPMENT AUTHORITY TO EXECUTE AGREEMENTS AND DOCUMENTS ASSOCIATED WITH THE RECORDING OF DEED RESTRICTIONS FOR FOX HOLLOW UNITS WHEREAS, the Eagle County Housing and Development Authority(the "ECHDA") has an interest in certain residential units within the Fox Hollow development for the purpose of generating affordable housing opportunities for Eagle County residents and workers; and WHEREAS, it is ECHDA's intent that such units be conveyed subject to deed restrictions pertaining to price and/or residency in Eagle County, consistent with the Affordable Housing Guidelines, the Fox Hollow PUD Guide, and PUD Preliminary Plan; and WHEREAS, certain scrivener's errors have been found in the legal description of specific units on the Declaration for Fox Hollow Condominium, recorded February 28, 2024, at Reception No. 202402032, and Second Amendment recorded July 23, 2024 at Reception No. 202408068, and the Condominium Plat recorded February 28, 2024 at Reception No. 202402033 in the office of the Clerk and Recorder of Eagle County, Colorado, and as supplemented by the Fox Hollow Condominium Plat, Lot 2 Second Amendment, according to the Final Plat of Fox Hollow PUD, "Buildings A, B, C, D, E, J, K, L &M" Section 6, Township 5 South, Range 82 West of the 6th P.M., County of Eagle, State of Colorado, recorded July 23, 2024 at Reception No. 202408069, which will necessitate that new and corrected documents be recorded with the proper legal descriptions; and WHEREAS,ECHDA desires to delegate to the Executive Director of ECHDA and in her absence, the Eagle County Housing Manager, the authority to execute and record on its behalf all documents, instruments and other forms that may be necessary to correct any and all errors found as noted above, all subject to prior review by the Eagle County Attorney's Office. NOW,THEREFORE,BE IT RESOLVED BY THE COMMISSIONERS OF THE EAGLE COUNTY HOUSING AND DEVELOPMENT AUTHORITY: Docusign Envelope ID:996A5849-EF4E-4909-96EF-9C861BB0172A THAT the ECHDA Board hereby authorizes the Executive Director of ECHDA and in her absence, the Eagle County Housing Manager, to execute and record on its behalf all documents, instruments and other forms that may be necessary to correct any and all errors found as noted above, all subject to prior review by the Eagle County Attorney's Office. THAT,the Board of County Commissioners finds, determines and declares that this Resolution is necessary for the public health, safety and welfare of the citizens of Eagle County, State of Colorado.
