This being a scheduled Public Hearing,the following items were presented to the Board of County
Commissioners for their consideration:

Executive Summary: Amended Final Plat(AFP) for the vacation of the boundary between 111 Granite Springs
Trail and 75 Pommel Place Filling 37, Lot 26 and 29 of the Cordillera Subdivision.

On or about April 22,2024,Matthew Stovall,representative for TJP Ventures, LLC (the "Applicant"), submitted an
application for an Amended Final Plat(the"AFP"or the"Application")with the purpose of vacating the boundary
between 111 Granite Springs and 75 Pommel Place, Lot 26 and Lot 29, Filing 37,of the Cordillera Subdivision
(collectively, the"Property"). Additionally,the Application proposes to eliminate the existing building envelope on
the75 Pommel Place parcel.
The Property was originally platted in 2000 as a part of the Cordillera Subdivision,Filing 37 recorded at reception
no. 730389 in the Office of the Eagle County Clerk and Recorder, as Lot 26 and Lot 29. Currently, a residence
exists at 111 Granite Springs(Lot 26). 75 Pommel Place(Lot 29) is vacant. The Applicant intends to use the
combined lot for one single family residence. The Property is located within the Cordillera Subdivision Planned
Unit Development("PUD"); therefore,the PUD Guide dictates the zoning/dimensional requirements of the
Property. The PUD Guide states that lot line vacation and building envelope elimination(per Cordillera PUD
Guidelines Section 1.05.3)may be amended by submitting an amended final plat to Eagle County for either
administrative approval or approval through a public hearing. The administrative approval process is only available
to applicants who have obtained written approval from all adjacent property owners within 75 feet of their property.
Since the Applicant has not obtained such approval,the public hearing process is required.
The purpose of this Application is to vacate the boundary between 111 Granite Springs Trail and 75 Pommel Place.
Additionally, the building envelope on 75 Pommel Place,will be eliminated.

Staff recommends approval with conditions,as the Application met the standards in ECLUR Section 5-250.G.3.
Troy Hangen, Eagle County staff planner, stated that he would be presenting an Amended Final Plan
presentation.
Matthew Stovall,representative for TJP Ventures,LLC stated that the application was fairly
straightforward. His client was looking to vacate the lot line between their two properties. The final plat was
approved by the owner of both parcels, and the applicant had complied with all the policies and requirements.
There were no proposed improvement agreements or other offsite road improvement agreements. Lastly,the
amendment would not alternate or restrict any plat notes.
Mr. Hangen stated that the purpose of the application was to vacate the boundary between 111 Granite
Springs Trail and 75 Pommel Place. The building envelope on 75 Pommel Place would be eliminated. Staff
recommended approval with a condition. Staff did the property referral distribution; 23 agencies received the file
and had 14 days to respond. Three agencies responded, Eagle County Wildfire Mitigation had no concerns,
Colorado Department of Public Health had no concerns,and Eagle River Water and Sanitation's only comment was
that the district required existing water and sewer service stub outs to 75 Pommel Place to be abandoned. He
indicated that the application met the standards.
Commissioner Chandler-Henry asked if this would remove the applicant's ability to add a second home.
Mr. Hangen stated that nothing would be allowed on the vacated lot.
Chairman Scherr asked if this was the type of application that would typically come before the board or if it
was a PUD requirement.
Mr. Hangen stated that this application was required to be presented to the board because the applicant did
not have the approval of the people living nearby.
Chairman Scherr opened and closed public comment, as there was none.
Commissioner Chandler-Henry concurred with staff's findings that all the standards have been met.
Commissioner McQueeney agreed that this was a straightforward application.
Chairman Scherr also agreed that the application met the approval standards.
Commissioner McQueeney moved to approve File No. AFP-009438-2024,AFP for Cordillera Subdivision
Filing 37, incorporating staff's findings and one recommended condition,because this application, as conditioned,
meets the standards for approval of an Amended Final Plat.
Commissioner Chandler-Henry seconded the motion. The vote was declared unanimous.
