This being a scheduled Public Hearing,the following items were presented to the Board of County
Commissioners for their consideration:
Constituent Input
Chairman Scherr opened and closed constituent input, as there was none.
Commissioner Updates
Commissioner McQueeney made an announcement. Eagle County was no longer in the bus transportation
business. The transition has occurred and she wished the Core Transit team all the best.
Commissioner Chandler-Henry reported that she would be heading to Cheyenne,Wyoming,this afternoon
to participate in a panel at the Wyoming Planners Association. They were interested in learning more about using
Forest Service administrative parcels for housing.
Chairman Scherr stated that he looked forward to seeing how Val Constien would do in the 3,000-meter
steeplechase today at the Paris Olympics. It was exciting to have a local competitor in an Olympic event.
County Manager Updates
1. Wildfire Conditions Outlook
Birch Barron
Birch Barron,Director of Emergency Management for Eagle County,presented the long-term drought
outlook. Currently, Eagle County is staying out of drought for July 2024. Eagle County had trended right around
normal for this time of year temperature-wise. Much of the area was at or below normal precipitation. Much-needed
precipitation was forecasted for the 8-14-day outlook. The Rocky Mountain Area was forecasted to remain at
average significant fire potential.
Commissioner Chandler-Henry asked if anyone considered restoration work in the Glenwood Canyon to
prevent mudslides.
Mr. Barron stated that last year there were some normal amounts of debris. So far there hadn't been any
unmanageable burn scar runoff.

1. Resolution 2024-048 Adopting the Eagle County Colorado Open Record Act Policy

Executive Summary: The County Attorney's Office has revised the County's Open Records Act policy to allow
for an increase in the fee permitted by the Colorado Open Records Act for research and retrieval of public
records, and to incorporate other changes permitted by the Open Records Act. The revised policy is attached to
the resolution as Exhibit A.
Ms. Oliver stated that the Open Records Act requires that public records be open to inspection. The Act
also authorizes local jurisdictions to adopt policies and procedures. The county adopted a policy back in 2012,
this amendment relates to certain changes in state statute. Both the policy and the form for submitting a records
request are located on the county website on the County Attorney page. Many of the public records are on the
county website, so often,people are simply directed to the website as opposed to making them go through the
formal CORA request process.
Commissioner Chandler-Henry asked about the type of requests they received.
Ms. Oliver stated that the types of requests varied.
Chairman Scherr asked if there was an automatic adjustment for fees built in.
Ms. Oliver stated that they added to the most recent policy language that allows them to adjust without an
amendment to the policy based on whenever the Director of Research of the legislative council adjusts the
maximum fee and posts it on the legislative council website, then they can increase the hourly rate.
Commissioner Chandler-Henry moved to approve the Resolution Adopting the Eagle Count Colorado
Open Record Act Policy.
Commissioner McQueeney seconded the motion. The vote was declared unanimous.
Work Session(s) - Eagle County Room
1. Eagle River Community Water Final Plan presentation
Marcia Gilles, Op[en Space and Natural Resources
Executive Summary: The Eagle River Community Water Plan(CWP)considers past,present,and future human
needs and river health issues to identify opportunities to correct historical degradation and prevent and mitigate
against non-desirable future conditions for environmental and recreational water uses. The plan seeks to understand
the independent and interactive impacts of population growth,water use,reservoir development, and climate
change(air temperature and precipitation patterns)on human and ecosystem water needs. It is intended as a guide
rail to help current and future leaders make conservative, low-regrets decisions that provide water security to our
communities while sustaining the productive,healthy, and beautiful river systems that have provided for our needs
from past to present. James Dilzell,with Eagle River Coalition,will present the final plan and discuss the next
milestones and implementation of the plan. County Commissioners will be asked to consider formal adoption of the
plan.
2. Vail Mountain Rescue Group Annual Update (2023/2024)

Executive Summary: Vail Mountain Rescue Group will give an update to the Eagle County Commissioners on
their operations over the past year. Vail Mountain Rescue Group provides backcountry search and rescue as well as

public education on backcountry safety in Eagle County. The team is responsible for all search and rescue
operations in the unincorporated areas of Eagle County and works under the jurisdiction and with the authority of
the Eagle County Sheriff's Office.
3. Eagle County Land Use Regulation Policy Discussion 8/6

Executive Summary: The purpose of this meeting is to continue our discussion of Module 1 of the new proposed
code, including review of proposed new zoning districts,the land use table,definitions, and standards for certain
uses; as well as discussion of the proposed sign code. We will begin our discussion of Chapter 3, Subdivision and
Site Design. Attached is the preliminary draft of Module 1.
Planning File - Eagle County Room
1. Tabling Request: PR-009447-2024, Warner Building Special Use Permit Extension#2

Executive Summary: The Applicant requests a two(2)year extension of a previously approved Special Use
Permit(Resolution No. 2019-070)for the conversion of an office building to a 35-unit boarding house on a 0.48
acre parcel at 20 Eagle Road in the EagleVail Planned Unit Development, and also known as Warner Professional
Building#2.
Janet Aluise,Eagle County staff planner, stated that the applicant had requested a tabling of the public
hearing for Warner Building Special Use Permit Extension#2 to provide the Board with more information. The
date is October 9,2024.
Ms. Oliver stated that a tabling(continuance)could be granted at the board's discretion based upon good
cause shown. In this case,the applicant requested additional time so they could provide additional information
that speaks in further detail to the Eagle-Vail Property Owners Association(EVPOA). If the board determines that
it is a good cause,the board can grant the continuance.
Commissioner Chandler-Henry moved to table file no. PR 00947-2024,Warner Building Special Use
Permit Extension#2.
Commissioner McQueeney seconded the motion. The vote was declared unanimous.
