HomeMy WebLinkAboutC24-319 SpeakUp ReachOut_MHAC GRANT AGREEMENT BETWEEN EAGLE COUNTY, COLORADO AND SPEAKUP REACHOUT THIS GRANT AGREEMENT (“Agreement”) is effective as of July 1, 2024 by and between Eagle County Public Health and Environment and SpeakUp ReachOut (hereinafter “Grant Recipient”) and Eagle County, Colorado, a body corporate and politic (hereinafter “Grantor”) RECITALS WHEREAS, the County, through its Department of Public Health and Environment (“ECPHE”) works to promote the health, safety and welfare of County residents of all ages; and WHEREAS, the County uses outside providers and professionals to enhance the ability of County to promote such health, safety and welfare; and WHEREAS, this Agreement is entered in reference to Eagle County Ballot Measure 1A, approved by voters on November 2, 2017, which provides for a sales and excise tax on recreational marijuana to establish earmarked funding to further the valid public purpose of addressing mental health needs in Eagle County (“Marijuana Tax Revenue”); and WHEREAS, ultimate approval for use of Marijuana Tax Revenue lies with the Eagle County Board of County Commissioners (“Board”); and WHEREAS, Eagle County Resolution No. 2018-007 established a Mental Health Advisory Committee (“MHAC”) within ECPHE to provide recommendations to the Eagle County Board of County Commissioners regarding the use of Marijuana Tax Revenue; and WHEREAS, the MHAC has identified a community need for funding of services dedicated to the ‘health promotion’ and ‘recovery or aftercare’ phases of care, and on the recommendation of the MHAC, the Board has allocated Marijuana Tax Revenue funds to address this community need by supporting programs and services offered by local organizations providing culturally responsive care to the public; and WHEREAS, the parties acknowledge and agree that the programs and services funded by Marijuana Tax Revenue promote the health, safety and welfare of the people of Eagle County and are intended to serve a valid public purpose and provide services that could otherwise be performed by County directly; and WHEREAS, Grant Recipient has elected to perform services that help create and sustain a healthy, environmentally and economically vital and socially diverse community in Eagle County on its own and County has, therefore, elected to compensate Grant Recipient to perform the Services for the public to fulfill an important public purpose; and Docusign Envelope ID: 3F53C8C1-FB5C-436E-903C-193A88D4A8A1 2 Eagle County Grant Final 5/14 WHEREAS, compensation paid by County to Grant Recipient enables Grant Recipient to perform the services for the public and County shall have no responsibility for the performance of the services; and WHEREAS, Grant Recipient is authorized to do business in the State of Colorado and has the time, skill, expertise, and experience necessary to provide the Services as defined below in paragraph 1 hereof; and WHEREAS, this Agreement shall govern the relationship between Grant Recipient and County in connection with the services. GRANT AGREEMENT Now, therefore, in consideration of the foregoing premises and the following promises, Eagle County and Grant Recipient enter into this Agreement for payment of the grant award in the amount of ten thousand dollars ($10,000, the “Grant Award”) to Grant Recipient. A. Grant Recipient agrees that funds awarded by Grantor may be used and expended solely for SpeakUp ReachOut programming and services, specifically the ‘Suicide Prevention Service Expansion to Hispanics and Latinos in Eagle County’ as specified in its 2024 Mental Health Advisory Committee Mini-Grant Application, attached hereto as Exhibit A, incorporated herein by reference. All funds will be expended in by Grant Recipient before the end of the grant cycle in January, 2025 (the “Grant Period”). The Grant Award set forth herein is for the specific Grant Period and the Grantor makes no representations, nor should Grant Recipient rely on this award as a representation of any future awards for other grant periods. B. In return for the Grant Award, Grant Recipient agrees to the terms of funding, deliverables, and deadlines outlined in the Scope of Work attached hereto as Exhibit B, and incorporated herein by reference. Grant Recipient shall submit a report discussing how the funds were expended, deliverables as outlined in the Grant Application and in Exhibit B, and how they tie back to creating and sustaining a healthy environmentally and economically vital and socially diverse community. The report will be due no later than January 15, 2025. Grant Recipient agrees to use the Colorado Common Grant (CCG) Report format which can be downloaded and printed from the following website: http://www.coloradocommongrantforms.org/CGR/default.htm. C. Payment of the Grant Award will be made in one installment. D. Grant funds under this Grant Agreement are to be used and expended within the Grant Period. Any funds not used or expended during the Grant Period must be returned to Grantor. E. If, after payment of the Grant Award, Eagle County reasonably determines that payment was improper because the purposes for which the payment was made were misrepresented, or the terms of this Agreement were breached, then upon written notice of such determination and request for reimbursement from Eagle County, Grant Recipient shall forthwith return such payment to Eagle County. Grant Recipient shall comply at all times and in all respects with all applicable federal, state and local laws, resolutions and codes; and specifically, with the requirements of the Civil Rights Act of 1964 and Section 504, Rehabilitation Act of 1973, concerning discrimination on the basis of race, color, sex, age, religion, political beliefs, national origin or handicap. G. Grant Recipient shall not assign any of its rights or duties under this Grant Agreement to a third party without the prior written consent of the Grantor. The Grantor shall terminate this Grant Agreement in the event of any assignment without its prior written consent, in which case, any unused Grant Funds must be returned to Grantor. H. Grant Recipient agrees that no agent, employee or volunteer of Grant Recipient shall be deemed an agent, employee or volunteer of County. I. Grant Recipient shall maintain, for a minimum of three (3) years, adequate financial and programmatic records for reporting to Grantor on performance of its responsibilities hereunder. Grant Recipient shall be subject to financial audit by federal, state or county auditors or their designees. Grant Recipient authorizes Grantor to perform audits or to make inspections during normal business hours, upon 48 hour notice to Grant Recipient for the purpose of evaluating performance under this Grant Agreement. Grant Recipient shall cooperate fully with authorized Eagle County representatives in the observation and evaluation of the program and records. Grant Recipient shall have the right to dispute any claims of misuse of funds and seek an amicable resolution with Grantor. J. This Agreement shall be governed by the laws of the State of Colorado. Jurisdiction and venue for any suit, right or cause of action arising under, or in connection with this Agreement shall be exclusive in Eagle County, Colorado. K. This Grant Agreement supersedes all previous communications, negotiations, and/or agreements between the respective parties hereto, either verbal, or written, and the same not expressly contained herein are hereby withdrawn and annulled. L. This Grant Agreement does not, and shall not be deemed or construed to confer upon or grant to any third party or parties any right to claim damages or to bring any suit, action or other proceeding against either Grant Recipient or Grantor because of any breach hereof or because of any of the terms, covenants, agreements and conditions contained herein. M. Invalidity or unenforceability of any provision of this Grant Agreement shall not affect the other provisions hereof, and this Grant Agreement shall be construed as if such invalid or unenforceable provision was omitted. N. To the extent required to perform under this Grant Agreement, Grant Recipient represents and warrants that it has the expertise and personnel necessary to properly perform the Grant Agreement and its professional personnel are duly licensed to perform. No failure or delay by either party in the exercise of any right hereunder shall constitute a waiver thereof. No waiver of any breach shall be deemed a waiver of any preceding or succeeding breach. P. The signatories to this Grant Agreement aver to their knowledge, no employee of the County has any personal or beneficial interest whatsoever in the matters described in this Grant Agreement. The Grant Recipient has no beneficial interest, direct or indirect, that would conflict in any manner or degree with the performance of the Grant Agreement and Grant Recipient shall not employ any person having such known interests. Q. Grant Recipient shall be responsible for the completeness and accuracy of its performance under the Grant Agreement, including all supporting data or other documents prepared or compiled in performance of the Grant Agreement, and shall correct, at its sole expense, all significant errors and omissions therein. The fact that the Grantor has accepted or approved the work performed shall not relieve Grant Recipient of any of its responsibilities. Grant Recipient shall perform the Grant Agreement in a skillful, professional and competent manner and in accordance with the standard of care, skill and diligence applicable to Grant Recipients performing similar services. This paragraph shall survive termination of this Grant Agreement. S. Grant Recipient shall carry workers compensation insurance as required by law and automobile and commercial general liability insurance as necessary and appropriate during the term of the Grant Agreement. T. The Grant Recipient shall indemnify and hold harmless Grantor, and any of its officers, agents and employees against any losses, claims, damages or liabilities for which Grantor may become subject to insofar as an such losses, claims, damages or liabilities arise out of, directly or indirectly, this Grant Agreement, or are based upon any performance or nonperformance by Grant Recipient or any of its sub-recipients hereunder including claims for bodily injury or personal injury including death, or loss or damage to tangible or intangible property; and Grant Recipient shall reimburse Grantor for reasonable attorney fees and costs, legal and other expenses incurred by Grantor in connection with investigating or defending any such loss, claim, damage, liability or action. This indemnification shall not apply to claims by third parties against the Grantor to the extent that Grantor is liable to such third party for such claims without regard to the involvement of the Grant Recipient. This paragraph shall survive expiration or termination hereof. U. Grant Recipient certifies that it has read the Grant Agreement, understands each and every term and the requirements set forth herein, and agrees to comply with the same. Our partners include: Law Enforcement, Mental Health Clinicians, the School District, Non-Profit Par tners, concerned community members, and those with lived experience. Between 2009-2013, SpeakUp ReachOut worked under the umbrellas of Eagle River Youth Coalition and Samaritan Counseling Center. In 2014 we became an independent 501c3. Five years later, in 2018, we hired our first full time employee, and shortly thereafter, in 2021, the team grew to five full time employees. Today, SpeakUp ReachOut uses a public health framework known as the Colorado National Collaborative to reduce instances of suicide in our community and help those affected by it address their pain. The Colorado Violent Death Reporting System(COVRDS) reports the rate of suicide in Eagle County in 2022 was 30.75 (n-17). This is an increase from 2020 rate 21.57, n-12 and 2021 14.34 rate n-8. In 2020-2022 the rate of suicide for those with hispanic ethnicity was 11.94. The average rate for suicide in Eagle County over the past ten year was 18.22, n-109. Description: Reduce instances of suicide in Eagle County and help those affected by it address their pain. Through educational programs, events, peer groups, and par tnerships, we will bring community members together to learn and share their unique experiences. Specifically this project will move SpeakUp ReachOut closer to our goal of program and resource parity by the end of 2027. In the past, SpeakUp ReachOut has also focused on adapting our programs to better serve the workplace, those with lived experience and many of the most impacted demographics including LGBTQIA+, older adults and first responders. We are working towards equitable access to culturally appropriate services within SpeakUp ReachOut, which this grant award will help us do. And finally all of our work is designed to increase healthy behaviors that lead to long-term, holistic, positive outcomes. At the listening sessions we asked the following questions: 1) What is the biggest challenge facing Latino and Hipsanic behavioral health in Eagle County? (If we already know that lack of Spanish speaking clinicians is a BIG issue, what is the next biggest challenge?) Can we narrow it down to 3 priorities? 2) Is SpeakUp ReachOut the right organization to be addressing the following: Suicide Awareness and Prevention Education and Events Peer Support related to suicide attempt, suicide loss, supporting a loved one with suicide ideation Loss suppor t after a suicide 3) What organizations should SpeakUp ReachOut collaborate with for upstream (proactive, prosocial) behavioral health and boosting protective factors, while mitigating risk factors. 4) What do you think is the most effective way for SpeakUp ReachOut to reach the Hispanic and Latino community? (Large group, small group, times of day, types of presentations and events) 5) What haven't we talked about that you think SpeakUp ReachOut needs to know. The three priorities that were identified are: Provide Awareness presentations to address stigma around mental health and share data Provide Education around mental health and suicide is needed for all generations Build and Implement Peer Suppor t Groups as an additional opportunity to seek help With the goal that SpeakUp ReachOut will reach programming and resource parity for the Hispanic and Latino population but the end of 2027 we are focusing 2024 on our digital resources (website, social media, communications) and expanding our programs to include Spanish speaking peer suppor t groups and 2 (up from 1) Spanish language first edutainment events. All SpeakUp ReachOut events are open to anyone that wishes to par ticipate. We pride ourselves on creating safe spaces where people can learn and share. In 2024 SpeakUp ReachOut has also identified these target audiences: Young Adults 19-25 yo, Older Adults 55+ and the Workplace. All of our staff have lived experience with suicide that informs their work. We have seven peer suppor t leads (contractors) that lead the Peer Suppor t Groups offered by SpeakUp ReachOut. Each of these individuals has their own lived experience with suicide, mental health challenges and/or substance use. One peer lead is Spanish speaking and bicultural. The board consists of one Latina, one Latino, one Irishman, three Anglo females, and three Anglo males. Two members are under thirty, one identifies as LGBTQ+, and all are hard-working, wage earners in the community. Currently SpeakUp ReachOut offers the following services in Spanish language and a culturally competent manner: peer suppor t, edutainment events (2), MHFA, YMHFA, QPR, Awareness presentations, 5th-12th grade school training continuum, loss care packages, Gun Shop Project, and Coping Cards for Resilience. Peer Support is a known recovery or after care method which uses those that have been through something similar to support the person currently going through the struggle. Peer suppor t is used to help maintain improvement, prevent relapse, and aid adjustment of an individual to the community after a mental health crisis, suicide attempt or suicide death. The goal of our peer support groups in a culturally and linguistic relevant matter, as proposed by this application, is to improve individuals health and wellness, ability to live self-directed lives, and reach their full potential. SpeakUp ReachOut uses Retrospective Fatality Analysis to review all suicide deaths in Eagle County. The finding from this analysis allow us to suppor t governments, communities, and individuals to cope with and address health challenges and specifically suicide attempt and death, by informing public policy, creating suppor tive environments and strengthening community action as well as individual mental health promotion skills. This is all considered when creating any project, program or initiative at SpeakUp ReachOut, including this project. I. Entity Name: SpeakUp ReachOut II. Project Description: This project serves to increase community engagement of the Latinx/Spanish language community by providing no less than 2 ‘edu-tainment’ events in Spanish, increase culturally competent peer support facilitators, and finalize Spanish-specific resources materials and distribution. III. Definitions: Culturally Responsive Care: The ability of providers and organizations to effectively deliver services that meet the social, cultural, and linguistic needs of patients .A culturally competent system can help improve health outcomes and quality of care and can contribute to the elimination of racial and ethnic health disparities. Aftercare/Recovery: A program of outpatient treatment and support services provided for individuals discharged from an institution, such as a hospital or mental health facility, to help maintain improvement, prevent relapse, and aid adjustment of the individual to the community. Resolution of Non-Compliance: The Grant Recipient will be notified in writing within 15 calendar days of discovery of a compliance issue. Within 30 calendar days of discovery, the Grant Recipient and Eagle County Government will collaborate, when appropriate, to determine the action(s) necessary to rectify the compliance issue and determine when the action(s) must be completed.
