Constituent Input Chairman Scherr opened constituent input. Joanne Rock, Town of Eagle resident, spoke about the benefits of the triplex. She believed the construction costs would be less, less parking, less maintenance, lower value, and solar power may be more easily obtainable. These savings would contribute to more obtainable and affordable housing. Chairman Scherr closed constituent input. Commissioner Updates Commissioner McQueeney stated that she had no updates. Chairman Scherr congratulated all the graduating seniors and wished them the best of luck in the future. He also recognized all the teachers that got them through school. County Manager Updates Jeff Shroll stated that he had no updates. Consent Agenda 1. CDOT Discretionary Aviation Grant Resolution 2024 for Matching Funds David Reid,Airport 2. Approval of the Minutes for the Board of County Commissioner Meetings for April 16, April 23, and April 30, 2024 Kathy Scriver, Clerk&Recorder's Office Commissioner McQueeney moved to approve the Consent Agenda for May 21, 2024, as presented. Chairman Scherr seconded the motion. Of the two voting commissioners,the vote was declared unanimous. Business Item 1. Resolution 2024-033 Adopting the Restated Eagle County Open Space Rules and Regulations Peter Suneson, Open Space Executive Summary: The proposed resolution will repeal and restate the County's current Open Space Rules and Regulations as established by Resolution No. 2021-027. The new Rules and Regulations establish updated penalties and procedures consistent with recently revised state law and also further refine Open Space operations. Peter Suneson, Eagle County Open Space Coordinator, gave a presentation detailing the purpose of the Rules and Regulations and the 2024 updates. Phil Kirkman,Eagle County Open Space Specialist and Ranger,reviewed the changes. The changes were in response to new management challenges and changes in ticket types,payment, and fine structure. Increased signage and support from the Eagle County Sheriffs Office and Colorado Parks and Wildlife would be implemented due to new challenges related to hunting and unauthorized trail use. Mr. Suneson reviewed the commercial fee structure. Beginning in 2025 they would be implementing a 3%of gross profits generated on Open Space or$115,whichever was greater. All fee-for-service programs would be required to obtain commercial activity permits. He also reviewed the updates to programs and special events which clarified the definition of"commercial activities,""fundraisers,"and"special events"in the new regulations. Commissioner McQueeney asked what the additional fines were for violations. Mr. Kirkman stated that the fines for any violation of the Rules and Regulations, except those provisions related to hunting, fishing, firearms, and fireworks were$100 for the first offense, $250 for the second offense, and$500 for the third offense plus a mandatory court sentence. Violations related to hunting, fishing, firearms, and fireworks shall constitute a civil infraction, and the fines were greater. Matt Peterson,Assistant Eagle County Attorney, added that the statute authorizing the county's Open Space Rules and Regulations program allowed the commissioners to adopt a graduated fine schedule consistent with the intent of the Open Space program. He stated that he supported the recommendation. Commissioner McQueeney stated that she appreciated the separate fines and believed it was important for the public to understand that there were penalties for not being cautious. Commissioner McQueeney moved to approve the Resolution Adopting the Restated Eagle County Open Space Rules and Regulations. Chairman Scherr seconded the motion. Of the two voting commissioners,the vote was unanimous. 2 05/21/2024 Commissioner McQueeney moved to adjourn as the Eagle County Board of County Commissioners and reconvene as the Eagle County Housing and Development Authority. Chairman Scherr seconded the motion. Of the two voting commissioners,the vote was unanimous. Eagle County Housing and Development Authority 1. Amended and Restated Terms Sheet for Eagle Villas Special Limited Partnership and Acquisition Subordinate Loans Tori Franks,Resiliency Executive Summary: The Amended and Restated Eagle Villas Special Limited Partnership and Acquisition Subordinate Loan Term sheet amends the priority of the ECHDA loan to accommodate an additional loan from the State. Tori Franks, Eagle County Resiliency Director,reviewed the terms of the first agreement between the Eagle Counting Housing and Development Authority and Ulysses Development Group. Due to the State's guidelines,the term sheet simply adjusted how the loans were stacked. The majority of the loans, $4.9 million, would go into second position,the State's$5 million would go into third position, and the remaining amount would go into fourth position. She expected the closing date for the acquisition to be June 5th. She anticipated this structure to remain in effect for 12 months or less. Joanne Rock, Town of Eagle resident,mentioned that she was a current resident of Eagle Villas and wondered what the effect on her rent would be. Ms. Franks stated that the rental rates based at AMI wic;u1d4aQt change in the acquisition period,however, the rent on 12 units would increase in the future. Amendment to the Purchase and Sale Agreement for Eagle County Housing and Development Authority and 7 Hermits Condominiums Kim Bell Williams,Housing Executive Summary: In April 2023,the Eagle County Housing and Development Authority entered into a Purchase and Sale Agreement for the purchase of 43 units and 21 garages at Haymeadow in Eagle,Colorado. This contract Amendment will increase the number of garages by 5 for a total of 26 garages, and 17 storage units. The purchase price of the garage is$30,000 each, and the storage unit is $10,000 each for a total of$320,000 at the time of each unit purchase. The total purchase price for 43 units,26 garages, and 17 storage units shall now be $26,750,000. Units are under construction with the first building anticipated to be occupied in July 2025. Kim Bell Williams,Eagle County Housing Director,reviewed the purchase and sale agreements between Eagle County Housing and Development Authority(ECHDA) and 7 Hermits Condominiums. ECHDA would be purchasing 43 units,21 garages,and 17 storage units. The units would be price-capped for-sale units. Starting in June they would be purchasing up to five units a month. The first buyers would be moving in as soon as July. 3 05/21/2024 Commissioners McQueeney moved to approve the Amendment to the Purchase and Sale Agreement for Eagle County Housing and Development Authority and 7 Hermits Condominiums. Chairman Scherr seconded the motion. Of the two voting commissioners,the vote was unanimous. Commissioner McQueeney moved to adjourn as the Eagle County Housing and Development Authority and reconvene as the Eagle County Board of County Commissioners. Chairman Scherr seconded the motion.
