Box 57, Eagle, CO 81631 Terms and Conditions: • The Sponsor/Lessee has inspected the Park and is familiar with the present condition thereof and agrees to accept the Premises as such condition at the commencement of the lease term unless noted above. • EagleVail Metropolitan District reserves the right at any time to enter onto the premises to review Lessee actions and/or for any other reasonable purpose. • The Sponsor/Lessee will be responsible for the conduct and control of participants and will ensure that all federal, state and county regulations are followed for this event. • The Sponsor/Lessee agrees, to the extent permitted by law, to assume liability for all injuries and damages resulting from its use of the Park and to the extent permitted by law, to indemnify, defend and hold the EagleVail Metropolitan District harmless from and against all claims, loss or liability resulting from such use. • The parties hereto understand and agree that Sponsor/Lessee is relying on, and does not waive or intend to waive by any provision of this Agreement, the monetary limitations or rights, immunities and protections provided by the Colorado Governmental Immunity Act, as from time to time amended, or otherwise available to Sponsor/Lessee, its affiliated entities, successors or assigns, its elected officials, employees, agents and volunteers (“CGIA”). • Sponsor/Lessee agrees that during the term of this Agreement, it will maintain any such liability insurance, whether by commercial policy or self-insurance, as is necessary to meet any liability under the CGIA. Sponsor/Lessee agrees to include the EagleVail Metropolitan District as an additional insured under Sponsor/Lessee’s insurance policy for purposes of this Agreement. DocuSign Envelope ID: 17F286EE-3B71-462E-B4B8-A542D38494A1 • Notwithstanding anything to the contrary contained in this Agreement, Sponsor/Lessee shall have no obligations under this Agreement without an appropriation therefor by Sponsor/Lessee in accordance with a budget adopted by the Eagle County Board of County Commissioners in compliance with Article 25, title 30 of the Colorado Revised Statutes, the Local Government Budget Law (C.R.S. 29-1-101 et. seq.) and the TABOR Amendment (Colorado Constitution, Article X, Sec. 20). No parking on grass or mounds. Park in designated areas only. □ Pick up and remove all trash created from the event. □ Be respectful of property and others who have reserved the parks. □ No glass containers are allowed on the parks. □ Dogs must be on leashes. Please cleanup after your pet. □ No bounce houses, inflatable castles, or other large play equipment is allowed without prior notification. The District wants to make sure placement is correct to eliminate any problems of staking irrigation lines. No staking is allowed, only the use of sandbags as anchors.
