This being a scheduled Public Hearing,the following items were presented to the Board of County
Commissioners for their consideration:
Constituent Input
Tim McMahon of Avon, a.k.a"Chicken Man"on social media, spoke about the Family Learning Center's
lease ending August 2025. He wondered if there was anything the county could do to help by either purchasing
land for them or utilizing some property already owned by the county. Over half of the students there were
receiving assistance and 75%were English as a second language. This was the only place in the valley that
provided three meals. He hoped there was a way to save it.
Commissioner Updates
Commissioner McQueeney expressed her appreciation for the hundreds of people who participated in the
Highway Cleanup on Saturday. There was a lot of trash, and there were a lot of folks working on getting it all
cleaned up.
Chairman Scherr shared a message from the Eagle River Coalition, the organization that put on the event.
The bags of trash along the roadside would be picked soon. He also mentioned that Commissioner Chandler-Henry
was off saving water for the Western Slope again.
County Manager Updates

Commissioner McQueeney moved to approve the Consent Agenda for May 7, 2024 as presented.
Commissioner Scherr seconded the motion. Of the two voting commissioners,the vote was declared
unanimous.

programs, including:
• Addressing Food Insecurity through The Community Market: We'll share relevant statistics and discuss
our strategies for tackling food insecurity in the community.
• MIRA Bus Data Analysis: We'll present both qualitative and quantitative data gathered from the MIRA
Bus initiative and outline our responses based on this information.
• ELEVAR Program Participant Engagement: We're excited to bring a couple of our program participants
to share their experiences, including what they've been working on and their plans for the upcoming year.

Housing- Special Use Permit-at 545 Nottingham Ranch Road(Parcel 2103-074-07-006)in Avon. The site visit
is intended for orientation purposes only and is open to the public. However,members of the public should
refrain from asking questions concerning the merits of the application,reserving comments for the public hearing.
This site visit is intended to familiarize the Board of County Commissioners with the Property in anticipation of
the public hearing.

Executive Summary: Request for an additional dwelling unit on Lot 12, at approximately 3,034 square feet of
habitable space. The use is allowed for consideration under the Special Use Permit process in PUD—File No.
PDA-00026.
Staff Report Summary:
On or about August 15,2023, Greg Macik,on behalf of the Eagle River Presbyterian Church(the"Applicant"),
submitted a Consolidated Special Use Permit("SUP")to allow for a dwelling unit at 3,034 square feet of habitable
space upon a 1.44 acre parcel of land within the McGrady Acres Pup (the"Application"), located at 545
Nottingham Ranch Road designated as Eagle County parcel number 2103-074-07-006(the"Property").Application
materials are included as Attachment 1 of the staff report. In conjunction with the SUP,the Applicant requests
driveway standards variations to accommodate the proposal to achieve desired design qualities on a lot encumbered
by a ditch. The McGrady Acres PUD Guide(PUD Guide)allows for the proposed dwelling unit through the SUP
process, subject to standards as outlined in Eagle County Land Use Code(the"ECLUR") Section 5-250.B. These
items are detailed in the Standards and Analysis section VI of the staff report. Pursuant to the standards set forth in
ECLUR Section 5-250 - Special Uses, staff has reviewed all information presented by the Applicant,as provided by
referral agencies, and research of additional background information. Based on this review, staff recommends
approval with conditions of the Application as it meets the standards in ECLUR Section 5-250.B.
Greg Macik,with TAB Associates, stated that this was a Special Use Request for a single family housing
unit on a lot currently owned adjacent to the church. The intent was for pastor housing and/or staff housing.
David McWilliams, staff planner reviewed the project summary. The applicant was requesting a 3,700
square foot dwelling unit on a 1.44 acre parcel of land within the McGrady Acres PUD. The PUD guide allowed
for a dwelling unit through the Special Use process. The proposal adhered to the PUD Guide in terms of
architectural principles,height,material, and the platted 50 ft. stream set back on the property. A driveway variation
was requested to achieve design qualities for the property as a full turnaround was not possible due to a ditch on the
property. The Nottingham&Puder Ditch was owned by the Town of Avon and created encumbrances on the
property in terms of access and building location. Copies of the application were sent to 26 agencies for review and
six agencies responded. The Town of Avon Public Works approved the design that minimized additional water flow
in the nearby ditch. The Town of Avon Community Development had no objections but recommended a deed
restriction of the housing units. The Eagle County School District supported the project. The Eagle Vail Metro
District recommended mitigation steps be taken if golf balls were of concern. CDOT had no comments and the
Eagle County Paramedics requested that no additional vehicles be parked improperly to achieve a three point turn.
No public comment had been received. He reviewed the standards and indicated that the application was in
compliance with the standards.A condition was added per the Eagle River Fire Protection District that expressed
that they did not have concerns with the lack of a turnaround if the residences provided a fire-suppression sprinkler
system. Staff recommended a condition of approval to clarify the requirement. The Eagle County Planning
Commission reviewed the application and after deliberation, no revision of the staff-suggested conditions of
approval was made. The application received a unanimous recommendation of approval with conditions.
Chairman Scherr opened and closed public comment,as there was none.
Commissioner McQueeney stated that the application was straightforward, and she was satisfied with
staff's findings as presented including the variance to the driveway. She saw no issues with approving the
application.
Chairman Scherr believed that application met all the standards for approval for a Special Use Permit and
agreed with the driveway variation.

Commissioner McQueeney moved to approve file no. ZS-009383-2023 -Eagle River Presbyterian-Pastor
Housing- Special Use Permit incorporating staff's findings and recommended conditions,because this application,
as conditions,meets the standards for approval of a Special Use Permit.
Chairman Scherr seconded the motion. Of the two voting commissioners,the vote was unanimous.
