Commissioner Updates Commissioner McQueeney spoke about attending the NACo conference in Washington,D.C. last week. There were some really good presentations and information shared. Commissioner Chandler-Henry concurred with Commissioner McQueeny's comments. She believed it was a worthwhile use of the commissioners'time. She was able to be part of a panel presentation on housing and issues in rural resort communities as part of the public lands steering committee. Chairman Scherr stated that it was the beginning of political season and that everyone should have received their Presidential Primary ballots. He also reminded folks about the upcoming caucuses and assemblies. One must be a registered Democrat or Republican to attend one of those. County Manager Updates Jeff Shroll gave a shout out to David Ried's team out at the airport and highlighted that summer flights would be returning from both Chicago and Houston on the weekends. Consent Agenda _ 1. Commissioner Chandler-Henry seconded the motion. The vote was declared unanimous. Commissioner McQueeney moved to adjourn as the Eagle County Board of County Commissioners and reconvene as the Eagle County Housing and Development Authority. Commissioner Chandler-Henry seconded the motion. The vote was unanimous. Eagle County Housing and Development Authority 1. Subordination Agreement(Receivership Rights)between the Eagle County Housing Development Authority, Lake Creek Village Apartments Owner,LLC, and Berkadia Commercial Mortgage LLC Jill Klosterman,Admin/Housing Executive Summary: The owner of Lake Creek Village Apartments is in the process of financing the property. The owner,Lake Creek Village Apartments Owner LLC, and lender,Berkadia Commercial Mortgage LLC,have requested a subordination agreement from the Eagle County Housing and Development Authority related to certain aspects of the Land Use Regulatory Agreement, specifically the receivership rights within that agreement. No other rights under the Land Use Regulatory Agreement are being impacted, including maximum allowable rents. Beth Oliver,Interim Eagle County Attorney, explained that the subordination agreement was requested related to refinancing by the owner of the Lake Creek Village Apartments and the lender. The lender,Berkadia Commercial Mortgage LLC, requested the agreement and receivership rights within the agreement. It set certain rents on the property, and in the event there was a default,the Authority would subordinate it's rights to collect rents or charges in connection with operation of the project,take possession of the project,or restore the property as a result of damage. Commissioner Chandler-Henry moved to approve the Subordination Agreement(Receivership Rights) between the Eagle County Housing Development Authority,Lake Creek Village Apartments Owner,LLC,and Berkadia Commercial Mortgage LLC. Commissioner McQueeney seconded the motion. The vote was declared unanimous. 2 02/20/2024 2. Ratification of Intergovernmental Agreement Between Eagle County Housing and Development Authority and the Town of Avon Melinda Dow,Housing Executive Summary: The Eagle County Housing and Development Authority shall provide housing services to the Town of Avon through The Valley Home Store. TVHS has been providing housing services to the Town of Avon since 2017. The Valley Home Store is a one stop shop for buyers and sellers of deed restricted housing for Eagle County. ECHDA loves working with the Town of Avon and look forward to continuing this partnership to provide more housing. Daniel Murray,Eagle County Housing Manager, stated that this was a renewal of an agreement with the Town of Avon and the Valley Home Store. The Housing Authority was paid a 2%fee for all the sales of their units as well as a$2600 per month service fee for everything they did. The agreement was for three one-year terms moving forward. Commissioner Chandler-Henry asked about the number of units. Megan Scallen with The Valley Home Store stated that there were roughly 63 units. Commissioner McQueeney moved to approve the Ratification of Intergovernmental Agreement Between Eagle County Housing and Development Authority and the Town of Avon. Commissioner Chandler-Henry seconded the motion. The vote was declared unanimous. Commissioner Chandler-Henry moved to adjourn as the Eagle County Housing and Development Authority and reconvene as the Eagle County Airport Terminal Board. Commissioner McQueeney seconded the motion. The vote was unanimous. Eagle County Airport Terminal (ECAT) Board 1. First Amendment to Agreement for the Operation of Retail Concession at Eagle County Regional Airport Terminal Building Between Eagle County Regional Air Terminal Corporation and Tailwind EGE David Reid,Airport Executive Summary: ECAT entered into an agreement with Tailwind,LLC for operations of a gift and news shop, retail, food, and beverage concession on September 8, 2021. Both parties wish to amend the original contract to increase rental space to the concessionaire, and to modify the Fee and Rent structure to better reflect activity levels at EGE. Additional language was added to update reporting expectations by ECAT regarding required local, state, and federal inspections of the concessionaire. This agreement is set to expire on June 30,2024 with the option to extend. David Reid,Aviation Director, stated that this amendment to the agreement with Tailwind, LLC would modify the fee structure,clarify some of the percentages,and add some lease space for a mobile beverage cart. The agreement would run through the summer,and they would be eligible for a couple of one year extensions after that. Commissioner McQueeney moved to approve the First Amendment to Agreement for the Operation of Retail Concession at Eagle County Regional Airport Terminal Building Between Eagle County Regional Air Terminal Corporation and Tailwind EGE. Jill Klosterman seconded the motion. The vote was declared unanimous. 3 02/20/2024 Commissioner Chandler-Henry moved to adjourn as the Eagle County Airport Terminal Board and reconvene as the Eagle County Board of County Commissioners. Commissioner McQueeney seconded the motion. The vote was unanimous. Work Session - Holy Cross Room 1. Front Country Ranger Program Marcia Gilles, Open Space and Natural Resources Executive Summary: The Eagle Holy Cross Ranger District will provide an annual update on the U.S. Forest Service Front Country Ranger Program agreement(FCRP). From April through October, FCRP focuses their time, resources, and energy emphasizing visitor contacts, dispersed campsite monitoring,high-use trailhead monitoring, developed site operation/maintenance, natural resource projects at high recreation areas, and fire prevention messaging on the White River National Forest within Eagle County, Colorado. Administrative Update - Holy Cross Room 1. Commissioner Calendar& Schedule Review Planning File - Holy Cross Room 1. Tabling Request: Twin Acres Riding Stable and Boarding Stable ZS-009260-2022 Vince Hooper,Community Development Executive Summary: Consideration of a tabling request to March 26,2024 for a Consolidated Special Use Permit for the development and operation of a 25-stall horse boarding stable and a 100 x 200 foot covered riding stable, proposed to be commercial operations and open to the public on a reservation basis as space allows to accommodate horse boarding&horse riding,training and lessons. Vince Hooper,Eagle County Staff Planner, stated that the applicant had requested a continuance to allow additional time to finalize approvals for water. It was his understanding that the applicant had resolved all the water issues and was just trying to secure the final documentation. Doug Pratte with Land Studio, Inc., representative for the applicant,added that he received an email update from the applicant indicating that they resolved any opposition in the water case, and all 15 opposers had either stipulated or withdrawn their statements of opposition. Commissioner Chandler-Henry asked about the details of the water case. Mr. Pratt stated that the opposition to the case was related to the use of spring water. Bill Gibson,Director of Community Development, stated that the file would be re-noticed and a notice would be re-posted on the property as well. Commissioner Chandler-Henry moved to table file no. ZS 009260-2022,Twin Acres Riding Stable and Boarding Stables to March 26,2024. Commissioner McQueeney seconded the motion.
