HomeMy WebLinkAboutC84-023 Christine Dawkins4 AGREEMENT kern kgr THIS AGREEMENT, made and entered into this rI day of ex, 1984, by and between the Eagle County Attorney rs Office (hereinafter referred to as the "County Attorney"), the Board of County Commissioners of the County of Eagle, State of Colorado (hereinafter referred to as the "County"), and Christine Dawkins, an employee of the Eagle County Attorney's Office (hereinafter referred to as "Employee"). WHEREAS, the County Attorney is desirous of training Employee as a paralegal to more fully serve the needs of the legal department of the County; and WHEREAS, the County is cognizant of the need for such paralegal training and is agreeable to Employee's enrollment in an institution which offers and supplies the instructors, course materials and other pertinent facilities relevant thereto; and WHEREAS, in order to obtain the proficiency required for the acquisition of a paralegal certificate, it will be necessary for the Employee to effect a four -month leave -of - absence in 1985 from her current employment with the County; and WHEREAS, at the conclusion of the training, Employee is willing to return to the employ of the County for one year at her current salary. NOW, THEREFORE, for and in consideration of the mutual covenants, promises and conditions set forth hereinbelow, the parties hereto agree as follows: 1. Employee agrees to remain in her current position as legal secretary to the County Attorney up to and including two (2) working days prior to the commencement of the first summer semester of an appropriate institution offering paralegal training to ensure that her current job duties are fully and satisfactorily assumed by the individual who will fill her position during her absence. On the first available summer program commencement date in the summer of 1985, she will begin the leave -of -absence in order to initiate the training which is the subject of this Agreement, such leave -of -absence to terminate two (2) working days subsequent to the completion of the training, when Employee shall resume employment with the County. 2. The County agrees to pay all tuition costs for the training, such costs not to exceed three thousand two hundred and 00/100 dollars ($3,200.00). In the event further costs 7► should arise relative to the obtainment of the paralegal certificate, i.e., books, course materials, etc., Employee shall be solely responsible for such costs. 3. Employee agrees to assume sole responsibility for all living expenses incurred over the course of her training and, further, is agreeable to the suspension of her salary and all other employment entitlements as identified in the Eagle County Personnel Policy during her leave -of -absence from the County. 4. Employee agrees to undertake with due diligence all responsibilities and duties assigned to her by the County Attorney relative to her status as a fully trained paralegal at her current salary of one thousand five hundred sixty-nine and 00/100 ($1 569.00) per month for the duration of one (1) year from the time of completion of training; provided, however, Employee remains eligible for the merit and cost -of -living increases available to all County employees as set forth in the Eagle County Personnel Policy. At the conclusion of such one-year period, Employee shall be eligible for job reclassification pending the County's assessment of the continuing need for a paralegal on the County Attorney's staff and, further, pending the County's evaluation of Employee's merits with respect to the fulfillment of her obligations to her employers under the merit evaluation process then in effect. 5. In the event Employee resigns from employment with Eagle County prior to one (1) year from the date of the training's completion, she agrees to reimburse the County for the cost of tuition in the amount specified in paragraph 2 hereinabove, in accordance with the following schedule: a. If Employee resigns from her position with the County prior to three (3) months from the date of the training's completion, she will reimburse the County in the full amount of the cost of tuition, or three thousand two hundred and 00/100 dollars ($3,200.00). b. If Employee resigns from her position with the County prior to six (6) months from the training's completion date, she will reimburse the County for 75% of the total amount, or two thousand four hundred and 00/100 dollars ($2,400.00). c. If Employee resigns from her position with the County prior to nine (9) months after the training's completion date, she will reimburse the County for 50% of the total amount of tuition, or one thousand six hundred and 00/100 dollars ($1,600.00). -2- d. If Employee resigns from her position prior to one year from the training's completion date, she will reimburse the County for 25% of the total amount of tuition, or eight hundred and 00/100 dollars ($800.00). e. Once Employee has remained in the employment of the County for one (1) full year from the training's completion date, the debt will be considered to have been satisfied in full and no monies will be owing from the Employee to the County. 6. Employee further agrees that, should she fail or refuse to repay the amount due under this Agreement in the event of default hereunder within six (6) months of her resignation from the County, the County may pursue all legal remedies available for the collection of the above -stated amount. Employee agrees to jurisdiction and venue in Eagle County, Colorado. 7. It is further agreed that, in the event the County files suit against Employee, Employee will be liable for the cost of the suit and reasonable attorney's fees should a judgment be obtained by the County, and that such expense shall be included in the judgment. 8. All provisions of the Eagle County Personnel Policy not contrary to nor inconsistent with the intent of this Agreement shall remain in full force and effect throughout the term of this Agreement.
