RECORDER AND 11, COUNTY OF EAGLE, STATE OF COLORADO 6.",IR 16 10 28 AN'84 THIS AGREEMENT, made this �5 day ofAi2ri1 1984, by and between ARROWHEAD AT VAIL, a joint venture, hereinafter referred to as the "Subdivider", and THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO, hereinafter referred to as the "County", W I T N E S S E T H: WHEREAS, the Subdivider and the County did on October 18, 1983, enter into a Subdivision Improvements Agreement relative to the final plat of Arrowhead at Vail Subdivision, Filing Nos. 10 and 11, County of Eagle, State of Colorado, said Subdivision Improvements Agreement being set forth at length in Book 375 at Page 881 of the real property records of the County of Eagle, State of Colorado; and WHEREAS, it has been brought to the attention of the parties hereto that Exhibit B of the aforementioned Subdivision Improvements Agreement was inadvertently omitted; and WHEREAS, it has been brought to the attention of the parties hereto that certain signatures on behalf of the Sub- divider were inadvertently omitted; and WHEREAS, the Subdivider and the County desire to administratively amend the aforementioned Subdivision Improvements Agreement to include therein Exhibit B attached hereto and incorporated herein by this reference, and to confirm and ratify the aforementioned Subdivision Improvements Agreement by the Subdivider; NOW, THEREFORE, in consideration of the following mutual covenants and agreements, the Subdivider and the County agree as follows: 1. The Subdivision Improvements Agreement dated October 18, 1983, between ARROWHEAD AT VAIL, a joint venture, and the BOARD OF COUNTY COMMISSIONERS OF EAGLE COUNTY, regarding the final plat of Arrowhead at Vail Subdivision, Filing Nos. 10 and 11, County of Eagle, State of Colorado, as the same is recorded in Book 375 at Page 881 of the real property records of the County of Eagle, State of Colorado, is hereby amended by the insertion therein of Exhibit B attached hereto and in- corporated herein by this reference. 2. The entirety of the aforementioned Subdivision Improvements Agreement, as herein amended, is hereby readopted, confirmed, and ratified. 3. The aforesaid amendment and readoption of the subject Subdivision Improvements Agreement shall not constitute or be construed as a waiver of any violations existing at the time of execution of this Agreement by the parties hereto. 4. Should any section, clause, provision, sentence or word of the subject Subdivision Improvements Agreement, as amended by this Agreement and Exhibit B attached hereto, be declared by a court of competent jursidiction to be invalid, such decision shall not affect the validity of the aforementioned documents as a whole, or any part thereof, other than the part so declared to be invalid. For this purpose, the aforementioned documents are declared to be severable. IN WITNESS WHEREOF, the parties hereto have executed this Agreement the day and year first above written.
