HomeMy WebLinkAboutR85-80 expenditure of unanticipated contingencyCommissioner 941S7i?F-Sold moved adoption of the following Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 85- 'K RESOLUTION AUTHORIZING THE EXPENDITURE FROM THE CONTINGENCY FUND FOR THE PAYMENT OF AN UNANTICIPATED CONTIN- GENCY WHEREAS, on December 23, Commissioners of the County of Eagle, ter the "Board ") , was notified of a the sale of a motor vehicle, VIN nc County public auction, said motor belonged to Mike Frimml (hereinafter sale; and 1985, the Board of County State of Colorado (hereinaf- potential claim arising from OC144K115325, at an Eagle vehicle having purportedly "Frimml") at the time of its WHEREAS, the Board deemed it appropriate that further controversy respecting such potential claim be terminated and, by reason thereof, directed that settlement be made in the amount of six hundred dollars and no cents ($600.00) in exchange for a full and final release of all claims to be executed by Frimml; and WHEREAS, the Board has determined that such settlement requires the expenditure of funds from the County's Contingency Fund to cover the unanticipated disbursement of funds; and WHEREAS, the Board established the Contingency Fund, and budgeted and appropriated funds therein, to provide for expendi- tures caused by an act of God, or the public enemy, or some contingency that could not have been reasonably foreseen at the time of the adoption of the budget; and WHEREAS, the Board further finds, determines and de- clares that the aforementioned expenditure complies with the intent of the Contingency Fund and the provisions of §§ 29 -1 -114, 29 -1 -115, and 30 -25 -107, respectively, C.R.S. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the Board hereby authorizes the expenditure in the amount of six hundred and 00 /100 dollars ($600.00) from the County's Contingency Fund for the settlement of the expenses specified herein. THAT, pursuant to §§ 29 -1 -114, 29 -1 -115, and 30 -25 -107, respectively, C.R.S., the Board hereby directs the Eagle County Attorney's office to publish this Resolution in full one time in a newspaper having general circulation within the territorial limits of the County of Eagle, State of Colorado. THAT, the Eagle County Attorney's office is hereby further requested and directed to immediately transmit an original or certified copy of this Resolution to the affected spending agencies and the officer or employee of the County of Eagle whose duty it is to draw warrants or orders for the payment of money. THAT, the Eagle County Attorney's office is hereby further requested and directed to file an original or certified copy of this Resolution with the Division of Local Governments in the Department of Local Affairs. THAT, this Resolution is necessary for the public health, safety and welfare of the County of Eagle, State of Colorado.
