RESOLUTION NO.2024- 012
RESOLUTION FOR THE APPROVAL
OF AN AMENDMENT TO THE FINAL PLAT FOR 628 SETTLER'S LOOP
AND 45 HAWLEY COURT
Eagle County File No.AFP-009377-2023
WHEREAS,on or about May 19,2023,the County of Eagle, State of Colorado,accepted for
filing Eagle County File No.AFP-009377-2023 (the"AFP"or"Application")submitted by Matthew
Stovall(the"Applicant")on behalf of the property owner Brilliance LLC; and
WHEREAS,the Applicant requests an amendment to the Final Plat of Cordillera Subdivision,
Filing No. 26 regarding property located at 628 Settler's Loop and 45 Hawley Court in the Squaw Creek
West area(Parcel Nos. 2107-103-08-001 and Nos. 2107-103-08-002), legally described in Exhibit A(the
"Property"); and
WHEREAS, the intent of the AFP is to vacate the property boundary between Lot 9 and Lot 10,
and eliminate the existing building envelope on Lot 10 as depicted in Exhibit B and;
WHEREAS,pursuant to Section 5-290.B.3 and Section 5-290.G.3 of the Eagle County Land Use
Regulations (the"ECLUR")and Section 1.05.3 of the Cordillera Subdivision Eleventh Amended and
Restated Planned Unit Development Control Document(the"PUD Guide"),the AFP is the appropriate
process for a lot line vacation, a building envelope amendment,and/or the vacation of a utility/drainage
easement; and
WHEREAS,in accordance with Eagle County Land Use Regulations(the"ECLURs"), Section
5-210.E -Notice of Public Hearings, notice of the proposed Amended Final Plat was mailed to all owners
of property adjacent to the Property concerning the subject matter of the application and setting forth the
dates and times of meetings for consideration of the applications by the Board of County Commissioners
of the County of Eagle(the"Board"), and;
WHEREAS,at its public hearing held on December 19,2023,the Board considered the AFP,
associated plans,the statements and concerns of the Applicant,the Eagle County Community
Development Department,Engineering staff, other interested persons,and;
WHEREAS,based on the evidence,testimony, exhibits,and study of the Comprehensive Plan
for the unincorporated areas of Eagle County,as well as the comments of the Eagle County Community
Development Department,comments of public officials and agencies,and comments from all interested
parties,the Board finds as follows:

THAT,the AFP complies with the standards in ECLUR Section 5-290.G.3 -Amendment to Final
Plat, as set forth below:
1. Adjacent Property.Pursuant to Section 5-290.G.3.a,the proposed Amendment will not have an
adverse impact on adjacent property owners as it will reduce potential impacts(noise, viewshed,
traffic,wildlife, irrigation, etc.)of two dwellings to only one dwelling.
2. Final Plat Consistency.Pursuant to Section 5-290.G.3.b,the amendment is consistent with the
Original Final Plat as it maintains existing plat notes,retains necessary easements,and is in
accordance with the overall intent thereof for single family development.
3. Conformance with Final Plat Requirements.Pursuant to Section 5-290.G.3.c,the proposed
Amended Final Plat conforms to the Final Plat parameters and applicable regulations,policies,
and guidelines. Water Supply is provided by the Upper Eagle Regional Water Authority and
sewer is provided by the Eagle River Water& Sanitation District who will monitor the removal
of existing taps at 45 Hawley Court. Access to the combined lot will continue to be from
Settler's Loop. The Eagle River Fire Protection District will continue to serve the parcel and the
parcel is not within an identified geologic hazard area. A Site Plan was not required for the
Application and school land dedication fees were addressed at the time of the original Cordillera
Planned Unit Development(PUD). All technical requirements for the Plat have been met.
4. Improvements Agreement.Pursuant to Section 5-290.G.3.d,this standard is not applicable as no
public improvements or infrastructure are proposed by the Application.
5. Restrictive Plat Note Alteration.Pursuant to Section 5-290.G.3.e,this standard is not applicable
as all original Cordillera PUD plats notes have been carried forward.
THAT,the Application also complies with the standards in Section 1.05.03.vii of the PUD Guide
as set forth below:
1. Wildlife Corridors and Ridgeline Analysis. Pursuant to Section 1.05.03.vii of the PUD Guide,
the proposed Amended Final Plat does not adversely impact wildlife corridors or ridgelines.
NOW,THEREFORE,BE IT RESOLVED bythe Board of County
ty Commissioners of the
County of Eagle, State of Colorado:
THAT,this application for an Amended Final Plat is hereby approved.
THAT,the Board directs the Department of Community Development to provide a copy of this
Resolution to the Applicant.
THAT,the Board hereby finds,determines and declares that this Resolution is necessary for the
health, safety, and welfare of the citizens of Eagle County.
