Commissioner Updates Commissioner Scherr spoke about the ECO transit drivers and expressed appreciation for their efforts getting everyone around town safely. Commissioner McQueeney spoke about the start of the legislative session. She recently attended a legislative luncheon with the Human Services folks and discussed the three bills they would be working on. She believed things were starting to roll and encouraged the community to reach out with their ideas. Chairman Chandler-Henry added a holiday new year's greetings and gave a shout out to everyone who worked so hard over the holidays. County Manager Updates Jeff Shroll spoke about the AT&T tower being installed on the building. This should improve cell service in and around the county building. Consent Agenda 1. Commissioner Scherr seconded the motion. The vote was declared unanimous. Business Item 1. Resolution 2024-004 Re the Matter of the Adoption of the Budget and the Making of Appropriations for the County of Eagle, State of Colorado,For Fiscal Year 2024 Anna Earl,Finance Executive Summary: A public meeting for the 2024 budget presentation was held on December 18,2023. Public notices were completed on December 7,2023,December 14,2023, and again on January 4, 2024. Appropriations will be made in the January 9,2024 public meeting. 2 01/09/2024 Anna Earl,Eagle County Finance Director,outlined the process and mentioned a couple changes that had been made since the December 18,2023 budget presentation which were detailed in the memo she presented. These changes as outlined below: 1. On 12/19/2023,we received the updated Net Total Assessed Valuation(including the gross total assessed valuation less the tax increment financing district valuations)of$4,985,289,190. This valuation was different from the estimate we had been using and resulted in an overall property tax revenue reduction of$1,231,758.A portion of the property tax revenue allocated to the Road and Bridge Fund is shared with the towns, so the lower property tax revenue within that fund caused the transfers to town expense to reduce by$10,217. 2. Based upon the final net total assessed valuation and a review of the 2002 Open Space ballot language,the open space fund will offer a 0.100 mill levy temporary property tax credit to stay within its$7 million property tax revenue maximum. The impact of this credit is a reduction of revenue of$495,787. 3. Eagle County Public Health and Environment received a grant to coordinate the Regional Opioid Settlement Funds. The receipt of these funds will allow us to retain and fully fund a term limited and grant funded position. This added$106,613 to both revenue and expenditure and increased our personnel count by 1.0 FTE. 4. We added$40,000 of grant revenue to the Sheriff's Office that will be used for mental health crisis services. The expenditures were already included,but we were informed that additional grant funding will be received in 2024. Ms. Earl stated that as part of the budget they included a Budget in Brief that included the strategic priorities and allocated budget for initiatives for 2024. The second page outlined the revenues and expenditures. The total expenditure was$280,756,425. The budget induced some large capital projects,the largest being the Edwards building. Overall the budget was balanced. There were just some big things planned for 2024. Chairman Chandler-Henry believed the two page document was helpful for anyone in the public wanting to view how the county prioritized spending. Part of the reason for large reserves in Open Space was because they were wisely saving money towards a future purchase. Ms. Earl stated that the official Budget Book and Budget in Brief would be added to the website once approved. Chairman Chandler-Henry asked about the credit on the Open Space being handled. Ms. Earl stated that there would be a temporary credit of 0.100 mills for 2024. Commissioner McQueeney stated that there had been a lot of public comment received with regards to the proposed budget. There had been four presentations on the budget, and she wanted the public to be aware that their comments had been heard. The Budget in Brief was helpful in explaining why the decision to not mess with the mill levy was decided. It was important to note that the future was uncertain with regards to property tax and sales tax and any long term relief. She believed that the county was investing in the priorities of the county. If the county was to reduce the mill levy,it was uncertain if it would benefit the local community. Commissioner Scherr believed the Budget Book really outlined what the county was investing in services such as housing, childcare,and mental health. The increase in revenue provided an opportunity for the county to invest in community members. Chairman Chandler-Henry pointed out that the Budget in Brief had some very specific goals so the public could hold the county accountable and each of the items had accountability tied to them. Commissioner Scherr moved to approve the Resolution Regarding the Matter of the Adoption of the Budget and Making of Appropriations for the County of Eagle, State of Colorado, for Fiscal Year 2024. Commissioner McQueeney seconded the motion. The vote was declared unanimous. Commissioner McQueeney moved to adjourn as the Eagle County Board of County Commissioners and reconvene as the Eagle County Housing and Development Authority. 3 01/09/2024 Commissioner Scherr seconded the motion. The vote was unanimous. Eagle County Housing and Development Authority 1. Review and Adoption of the 2024 Riverview Budget as the ECHDA Anna Earl,Finance Executive Summary: Review and approval of the 2024 Riverview budget by the Eagle County Housing and Development Authority. Anna Earl provided some highlights for the budget. Total expenditures for 2024 were$554,260. There were no large changes from 2023 to 2024. The rental rates were increasing 3.8%which was set by Housing Urban Development(HUD). Overall, expenditures were decreasing 7%. There were some capital projects included in the budget. Chairman Chandler-Henry believed the current team was making this a great place to live. It was an affordable option in Eagle County. Commissioner Scherr moved to approve the Adoption of the 2024 Riverview Budget as the ECHDA Commissioner McQueeney seconded the motion. The vote was declared unanimous. Commissioner McQueeney moved to adjourn as the Eagle County Housing and Development Authority and reconvene as the Eagle County Board of County Commissioners. Commissioner Scherr seconded the motion. The vote was unanimous. Business Item(s) Continued 1. Resolution 2024-005 Concerning adoption of the 2024 Fiscal Budget Mill Levy. Anna Earl,Finance Executive Summary: This resolution adopts Eagle County Government's 2024 Mill Levies. Anna Earl stated that the resolution included all the mill levies. The total was 8.499 mills with a temporary property tax credit in the Open Space Fund of 0.100 mills for a total of 8.399 mills for fiscal year 2024. Commissioner Scherr moved to certify the Eagle County Government 2024 Mill Levy. Commissioner McQueeney seconded the motion. The vote was unanimous. 2. Resolution 2024-006 Establishing Regular Public Meeting Days for the Eagle County Board of Commissioners, Office Hours, Legal Holidays,and Payroll for Fiscal Year 2024 Rhea silverkorn,Administration Executive Summary: The Board of Commissioners will be considering the county offices'operating hours and payroll schedules for 2024. Rhea Silverkorn,Eagle County Executive Coordinator,presented the annual resolution which was done at the start of each new year. She noted the changes. Traditionally in the past,there had been 12 holidays. This year Juneteeth was added, and after looking at other counties and municipalities, it was decided that Christmas Eve and the day following the Fourth of July would be added. This brought the holiday schedule to 15 days including the floating holiday. She believed it was a team effort and a lot of information was gathered to base this on. 4 01/09/2024 Commissioner Scherr appreciated the input by HR and the value of this for employees. Chairman Chandler-Henry stated that it may look like a simple resolution but there was a lot of work that went into figuring out all those meeting days. Commissioner McQueeney believed it came down to the culture of the organization and that the county valued its employees. Commissioner McQueeney moved to approve the Resolution Establishing Regular Public Meeting Days for the Eagle County Board of Commissioners, Office Hours, Legal Holidays,and Payroll for Fiscal Year 2024 Commissioner Scherr seconded the motion. The vote was unanimous. 3. Resolution Annual Appointments Resolution for the year 2024-TABLED Dani Moore,Administration Executive Summary: This resolution includes administrative appointments and designations for the year 2024. Commissioner Scherr moved to table the Annual Appointments Resolution for the year 2024 until January 16,2024. Commissioner McQueeney seconded the motion. The vote was unanimous. Event - Golden Eagle Senior Center 1. Golden Eagle Senior Center Lunch and Visit Carly Rietmann,Public Health Executive Summary: The county commissioners will be visiting the Golden Eagle Senior Center to talk with residents. Eagle County Housing & Development Authority - Eagle County Room 1. Eagle County Housing and Development Authority-2024 Housing Updates Include Sales Process for Haymeadow Units Kim Bell Williams,Housing Executive Summary: The Eagle County Housing and Development Authority would like to provide an update to the Board as we start 2024 to include 2023 successes,changes to housing programs, sales of Haymeadow units, and a new mission statement. The proposed new mission statement is "Housing Eagle County is elevating our community through mentorship and housing solutions". Planning File - Eagle County Room 1. SMB-009393-2023 - Comerford Minor B Subdivision Troy Hangen, Community Development Executive Summary: Minor B Subdivision(SMB)to subdivide Lot 1,.Filing 6 of the Cordillera Subdivision PUD into two (2) separate lots. File Type: Minor Type B Subdivision File Name: Comerford Minor B Subdivision 5 01/09/2024 File Number: SMB-009393-2023 Location of Land: 2 Stag Gulch Court,Cordillera/Edwards area, Parcel No. 2107-142-02-016 Applicant: James and Jane Comerford Staff Report Summary: On or about September 26,2023,Eagle County received an application for a Minor Type B Subdivision(the "SMB"or the"Application"),by James"Jim"and Jane Comerford(the"Applicant") at 2 Stag Gulch Court(the "Property"). The Property is also known as parcel number 2107-142-02-016,or Filing 6,Lot 1 of the Cordillera Subdivision. The purpose of this Application(Attachment 1)is to divide the Property into two separate parcels creating a new developable lot. The proposed lot split results in two parcels,Lot lA(1.568 acres)and Lot 2A(1.156 acres). The portion of the property referred to as Lot lA currently has a single family residence. The portion of the property referred to as Lot 2A currently is vacant. Section 5-290.B.2.a. of the Eagle County Land Use Regulations(the "ECLUR") allows the division of land through a Minor Subdivision process when the Application complies with applicable zone district and related standards. The Application must be heard before the Board of County Commissioners(the"Board")through a public hearing process to review applicable review standards. Staff conducted a review of the Application materials and supplemental information against the ECLUR Section 5-290.G.2 -Standards for Type B Subdivision. This review and evaluation of the Application against the standards of approval has led staff to conclude that a positive finding can be made for all standards of approval. Therefore, staff recommends Approval with One Condition. Jim Comerford,the applicant, introduced himself and provided some background with regards to his request. His goal was to reinstate a lot line that had been vacated in 2013. Troy Hangen,Eagle County Staff Planner,presented a PowerPoint presentation demonstrating the lot line and providing photos of the existing conditions. The application was sent to 24 agencies for 14 days, and 4 agencies responded with comments. All of the agencies had no concerns,and the Eagle River Water and Sanitation District did provide a Will Serve letter. Mr. Hangen reviewed the standards for approval and indicated that the application complied with the standards. Chairman Chandler-Henry opened and closed public comment, as there was none. Commissioner Scherr stated that he had no concerns with the application. Commissioner McQueeney had no comments and believed that the file was straightforward. Chairman Chandler-Henry concurred with the staff recommendations. Commissioner McQueeney moved to approve File No. SMB 009393-2023, SMB for Stag Gulch Court NO. 1-A Resubdivision of Lot 1,Cordillera Subdivision,Filing No. 6 Lot 1 and 2 and building envelope re-establishment in Lot 2A,incorporating staff's findings and recommended condition,because this application, as conditioned,meets the standards for approval of a MInor B Subdivision.
