HomeMy WebLinkAboutMinutes 12/12/2023 PUBLIC HEARING December 12, 2023 Present: Kathy Chandler-Henry Chairman Matt Scherr Commissioner Jeanne McQueeney Commissioner Jill Klosterman Chief Financial Officer Kathy Scriver Deputy Clerk to the Board This being a scheduled Public Hearing,the following items were presented to the Board of County Commissioners for their consideration: Constituent Input Chairman Chandler-Henry opened and closed constituent input, as there was none. Commissioner Updates Commissioner Scherr had no updates. Commissioner McQueeney gave a shout out to the residents of Eagle County who fully supported Colorado Gives Day. Eagle County would not be the same without the work by all the local non-profits. Chairman Chandler-Henry gave a shout out to the Vail Valley Foundation and all the volunteers and nonprofits who worked on the Birds of Prey downhill and Super-G this year which was unfortunately canceled due to weather. County Manager Updates Jill Klosterman encouraged anyone interested in property tax revenue options to participate in the discussion later in the day. Business Item 1. Resolution 2023-075 Approving ZS-009252-2022 Boat Launch on Highway 131 in Bond Area David McWilliams, Community Development Executive Summary: At its public hearing held on September 5,2023,the Board of County Commissioners considered the application,the staff report, a presentation from the<=E:igle County Planning Department staff,and statements and concerns of the Applicants and all other interested parties,including members of the public, and unanimously approved Land Use Application ZS-009952-2022 Special Use permit for Boat Launch at 18503 Hwy 131 in the Bond area. The Resolution memorializes the decision. Trent Hyatt with Eagle County Community Development stated that the board reviewed this application back on September 5, 2023 and this was the resolution approving that action taken on that date. 1 12/12/2023 Commissioner Scherr moved to approve the Resolution Approving ZS 009252-2022,Boat Launch on Highway 131 in the Bond Area. Commissioner McQueeney seconded the motion. The vote was declared unanimous. Discussion Item - Holy Cross Room 1. State of the County Planning Discussion Work Sessions - Eagle County Room 1. Eagle County Land Use Regulation Policy Discussion Beth Oliver,Attorney's Office Executive Summary: This is the final work session for identification and discussion of key policy issues related to the reform of the ECLUR. We will continue our discussion with consideration of ECLUR provisions for nonconformities and development review. Nonconformities are those uses of land,structures and lots that were lawfully established before the ECLUR was adopted or amended,that now do not conform to the standards of the ECLUR. The purpose of nonconformity regulations is to regulate and limit the continued existence of those uses, structures and lots that do not conform to the ECLUR. We will discuss options for reform of the nonconformity provisions, including discussion of circumstances in which nonconformities should be allowed to continue; provisions related to re-investment in uses,buildings or sites with nonconformities;updating and modernizing categories of nonconformities; and discussing whether additional uses on nonconforming lots could be approved via a limited review as opposed to special use permit(non-conforming Resource zoned lots). For development review,we will discuss options for delegation of certain decisions to staff(subdivision exemptions, final plats, amended final plats, SIA approval); examination of application requirements;review of the public benefit standard(currently applied to zone district amendments);review of the PUD amendment process; consideration of streamlining approval of special use permits and whether administrative approval is warranted for amendments; consideration of expedited procedures for disaster recovery and consideration of procedural incentives for affordable housing projects. 2. Property Tax Revenue Options Anna Earl,Finance Executive Summary: In this work session we will discuss property tax revenue options for the 2024 budget.
