RESOLUTION NO. 85- 619—
REPRESENTATION OF EAGLE COUNTY SHERIFF A.J.
JOHNSON - David L. Wade v. A.S. Johnson, as
Sheriff of Eagle County. Colorado - County
ty, Case
WHEREAS, A.J. Johnson, Eagle County Sheriff, has
been named a Defendant in the above - referenced litigation
in the nature of a Rule 104, C.R.C.P., replevin action; and
WHEREAS, pursuant to Section 20 -1 -105, C.R.S., the
District Attorney, upon a request in the form of a resolution
by the board of county commissioners of any county within
his district, shall represent any county officer enumerated
in Article 10 of Title 30, C.R.S., in the defense of
any civil suit or civil proceeding brought against such
officer in any court of this state or federal court if
such action directly relates to the duties of the county
officer; and
WHEREAS, due to the nature of the allegations set
forth in the Order to Show Cause and Complaint in the
above - referenced litigation, and the District Attorney's
familiarity with the factual circumstances surrounding
the instant litigation, the Board of County Commissioners
of the County of Eagle, State of Colorado, has determined
it would be in the best interest of A.J. Johnson, Eagle
County Sheriff, to request the District Attorney for the
Fifth Judicial District to assume his legal representation
pursuant to the provisions of Section 20 -1 -105, C.R.S.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF
COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF
COLORADO:
THAT, pursuant to Section 20 -1 -105, C.R.S., the
Board hereby requests the District Attorney for the Fifth
Judicial District to represent Eagle County Sheriff A.J.
Johnson named as a Defendant in the lawsuit entitled
David L. Wade v. A.J. Johnson, as Sheriff of Eagle Countv
Uoiorado,

THAT, a copy of this Resolution shall forthwith
be transmitted to the District Attorney for the Fifth
Judicial District and the Eagle County Sheriff.
MOVED, READ AND ADOPTED by the Board of County
Commissioners of the County of Eagle, State of Colorado,
at its regular meeting held on the 12th day of November,
1985.
