RESOLUTION NO. 85- 6d
REPRESENTATION OF EAGLE COUNTY SHERIFF A.J.
JOHNSON AND EAGLE COUNTY DEPUTY SHERIFF
RANDY PARKER - Mark C. Trimble v. Greg
Ulrick, et al. - U.S. District Court, Civil
Action No. 85 -2203
WHEREAS, A.J. Johnson, Eagle County Sheriff, and
Randy Parker, Eagle County Deputy Sheriff, have been named as
Defendants in the above - referenced litigation for alleged
violations of Plaintiff Mark C. Trimble's civil rights arising
out of the said Defendants' alleged participation in the arrest
and subsequent incarceration of the Plaintiff on or about
October 26, 1983; and
WHEREAS, pursuant to Section 20 -1 -105, C.R.S., the
District Attorney, upon a request in the form of a resolution by
the board of county commissioners of any county within his
district, shall represent any county officer enumerated in
Article 10 of Title 30, C.R.S., or the employees of any such
officer, in the defense of any civil suit or civil proceeding
brought against such officer in any court of this state or
federal court if such action directly relates to the duties of
the county officer; and
WHEREAS, due to the nature of the allegations set
forth in the complaint filed in the above- referenced litigation
and the District Attorney's previous familiarity with the
factual circumstances surrounding the instant litigation, the
Board of County Commissioners of the County of Eagle, State of
Colorado, has determined it would be in the best interests of
the named County Defendants to request the District Attorney for
the Fifth Judicial District to assume the legal representation
of Defendants A.J. Johnson and Randy Parker pursuant to the
provisions of Section 20 -1 -105, C.R.S.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF
COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, pursuant to Section 20 -1 -105, C.R.S., the
Board hereby requests the District Attorney for the Fifth
Judicial District to represent Eagle County Sheriff A.J. Johnson
and Eagle County Deputy Sheriff Randy Parker named as defendants
in the lawsuit entitled Mark C. Trimble v. Greg Ulrick et al.,
U.S. District Court, Civil Action No. 85 -2203.
THAT, a copy of this Resolution shall forthwith be
transmitted to the District Attorney for the Fifth Judicial
District and the named County Defendants.
MOVED, READ AND ADOPTED by the Board of County
Commissioners of the County of Eagle, State of Colorado, at its
regular meeting held on the 15th day of October, 1985.
